RESOLUTION NO. 1324
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, APPROVING
CERTAIN AND DISAPPROVING CERTAIN OF THE
FINDINGS AND DETERMINATIONS OF THE CITY
PLANNING COMMISSION OF SAID CITY AS SET
FORTH IN RESOLUTION NO. 146 OF SAID COM-
MISSION WITH REFERENCE TO THE USE OF
"CEMENT BATCHING PLANT" SOMETIMES REFERRED
TO AS "READY MI% CONCRETE OPERATIONS" AND
AUTHORIZING THE USE REFERRED TO IN SAID
RESOLUTION NO. 146 SUBJECT TO THE TECHNI-
CAL CONDITIONS THEREIN SPECIFIED, AS TO
CERTAIN REAL PROPERTY WITHIN SAID CITY
ONLY.
WHEREAS, the City Planning Commission of the City of
E1 Segundo did heretofore on the 11th day of May, 1953, after
due consideration, adopt Resolution No. 146 of said Commission
in words and figures as follows;
"RESOLUTION NO. 146
"WHEREAS, Ordinance No. 306 (Zoning Ordinance)
of the City of E1 Segundo, lists certain specified uses
as permissible in each of the various zones therein
designated; and
"WHEREAS, Robert K. Cary, 220 Ipswich Avenue,
Playa del Rey, California, of the Associated Ready -Mix
Company, has made inquiry concerning a classification
for a proposed cement batching plant to be built on
that certain property known as Lots 345, 346 and 347,
Block 123,.1f.1 Segundo, California; and
"WHEREAS, Section 12, Paragraph A. Use, of
said Section provides that where ambiguities exist con-
cerning classification of a ►use+; or if any +user is
omitted from the lists of those specified as permissi-
ble under various zones, the Planning Commission shall
ascertain all pertinent facts and render its findings,
which findings and recommendations, when approved by the
City Council, shall thereafter prevail; and

"WHEREAS, this matter was referred to Gordon
Whitnall and Associates, Staff Consultants, for re-
port; and
"WHEREAS, the Commission concurred with the
findings of the report;
"NOW, THEREFORE, BE IT RESOLVED, that as a re-
sult of such facts presented, the Planning Commission
finds as follows:
"1. That the tM -lt Light Industrial Zone pre-
sently permits zany kind of manufacture or treatment of
products other than those which may be obnoxious or of-
fensive by reason of emission of odor, dust, smoke, gas,
noise or similar causest,
"2. That ready -mix concrete operations would
not be considered to be in conflict with uses classi-
fied as M -1, provided they conform to the following
technical conditions;
"(a)That any cement (powder) storage be contained
in an entirely enclosed structure,
"(b) That the bucket elevator used to transport
the cement from the storage silo or tanks to
the mixing hopper also be enclosed so as to
prevent dust.
"BE IT FURTHER RESOLVED, that by reason of the
aforesaid findings, the Commission concludes that a ce-
ment batching plant, based on the above conditions,
qualifies as an M -1 use, and permissible at said loca-
tion;
"AND FINALLY RESOLVED, that a copy of this
Resolution be forwarded to the City Council for its con-
sideration in the manner prescribed by law, and that, if
concurred with by said Council, thatappropriate offi-
cers authorized to issue licenses and permits be in-
formed and instructed accordingly.

WHEREAS, said resolution was duly certified to the
City Council of said City for its consideration and action
thereon, all as contemplated under the provisions of Ordinance
No. 306 (the land use plan - Zoning Ordinance) of said City,
as amended; and

WHEREAS, said City Council has duly and carefully
considered and discussed the said resolution and all of the
terms, conditions and provisions thereof, and does not agree
with the findings of the Commission that ready -mix concrete
operations as described in said resolution, or otherwise, is
a general M -1 use; now, therefore, -
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALI-
FORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, FIND AND
ORDER AS FOLLOWS:
SECTION 1. Said Council does hereby find that the
facts recited in the preamble of this resolution are true.
SECTION 2. The City Council is willing to approve,
and does hereby approve, the use of ready -mix concrete oper-
ations, subject to the technical conditions expressed in said
Resolution No. 146 of said Commission for the particular real
property described in said Resolution No. 146, to wit:
Lots 345, 346 and 347, Block 123, E1 Segundo,
and does hereby authorize such use, subject to said technical
conditions for said particular properties only.
SECTION 3. That said City Council does hereby ac-
cordingly establish the use of "cement batching plant" some-
times referred to as "ready -mix concrete operations" as a use
which properly may be, and is hereby authorized to be, located
in the M -1 zone as established under said Ordinance No. 306,
as amended, when such use is conducted as described and limited
in said Resolution No. 146, and for the particular properties
hereinabove described only.
SECTION 4. That this resolution shall take effect
immediately.
SECTION 5. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same
in the book of resolutions of said Council; shall make a minute

of the passage and adoption thereof in the records of the pro-
ceedings of said City Council in the minutes of the meeting at
which the same is passed and adopted; shall forward a certified
copy of this resolution to the said City Planning Commission
for its information and files; and shall furnish a like copy
thereof to the said Associated Ready -Mix Company, in care of
Robert K. Cary, 220 Ipswich Avenue, Playa del Rey, California,
for its information and files; and shall furnish a copy there-
of to each of the departments of said City concerned with the
enforcement of the zoning or land use regulations of said
City for their information in the premises.
Passed, approved and adopted this 20th day of May,
1953.
