CC RESOLUTION 1311RESOLUTION NO. 1311, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING THE FIND- INGS AND DETERMINATIONS OF THE CITY PLANNING COMMISSION OF SAID CITY AS SET FORTH IN RESO- LUTION NO. 139 OF SAID COMMISSION THAT SAND- BLASTING OPERATIONS BE CLASSIFIED AS ZONE "M -1" USE PROVIDED THEY CONFORM TO THE TECHNICAL CONDITIONS SET FORTH IN SAID RESOLUTION NO. 139 OF SAID COMMISSION. WHEREAS, the City Planning Commission of the City of El Segundo, California, did heretofore on the 9th day of March, 1953, duly and regularly adopt its Resolution No. 139 in words and figures as follows: "RESOLUTION NO. 139 "WHEREAS, Ordinance No. 306 (Zoning Ordinance of the City of E1 Segundo lists certain specified uses as permissible in each of the various zones therein designated, and "WHEREAS, William Watkins of 122 Sheldon Street, E1 Segundo, has made inquiry concerning whether or not sandblasting operations, when properly conducted, are a permitted use in the 'M -1t Light Industrial Zone, and "WHEREAS, upon investigation by staff and report to the Planning Commission it was determined that sand- blasting operations - properly controlled and contained - are no more obnoxious nor offensive or hazardous than other uses presently permitted and allowed in the M -1 Zone, and "WHEREAS, Ordinance No. 306, under Section 12A as amended by Ordinance No. 348 provides that - -- ' - -If any 'use+ is for any reason omitted from the lists of those specified as permissible in each of the various zones herein designated, or if am- biguity arises concerning the appropriate classifica- tion of a particular use within the meaning and in- tent of this ordinance, or if ambiguity exists with reference to matters of height, yard requirements, or area requirements as set forth herein and as they may pertain to unforseen circumstances, it shall be the - 1 - duty of the Planning Commission to ascertain all pertinent facts concerning said use and by resolu- tion of record set forth its findings and the rea- sons therefor, and such findings and resolutions shall be referred to the City Council and, if ap- proved by the City Council, thereafter such inter- pretation shall govern.' "NOW THEREFORE BE IT RESOLVED, that the Plan- ning Commission finds as follows - - -- "l. That the 'M -1' Light Industrial Zone pre- sently permits 'any kind of manufacture or treatment of products other than those which may be obnoxious or offensive by reason of emission of odor, dust, smoke, gas, noise or similar causes', 112. That sandblasting operations would not be considered to be in conflict with uses classified as M -1, provided they conform to the following technical conditions - -- "(a) If sand is used, all sanding operations must be conducted within a dustproof chamber. If such chamber is not used, the building within which such operations are conducted must be airtight. "(b) In lieu of the dustproof chamber a bag house can be utilized for large articles. rr(c) All operations must be wholly contained with- in an entirely enclosed building. "(d) If Blastite (carborundum product containing less than 2% silica) or a similar steel grit or carborun- dum grit is used, d chamber will not be necessary. rr(e) All installations shall comply with all regu- lations of the (1) Division of Industrial Safety Orders, State of California and (2) the Health and Safety Code of the State of California, and "FINALLY RESOLVED, that a copy of this resolution be transmitted to the City Council for its attention in the manner provided by law and, if approved by the City Coun- cil, that all administrative officials in the City be ad- vised of these findings and conclusions and be directed to administer the zoning ordinance accordingly. Allen Chairman of the City Planning Commission of the city of E1 Segundo, California - 2 - "; and WHEREAS, pursuant to the provisions of law in such cases made and provided, the City Council has duly and regularly con- sidered the said Resolution No. 139 and the matters, subjects and things therein referred to and after such consideration believes that the action hereinafter taken is in the interests of said City; now, therefore - THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DUES RESOLVE, DECLARE AND ORDER AS FULLOWS: SECTION 1. Said Council does hereby find that the facts recited in the preamble to this resolution are true. SECTION 2. That said City Council does hereby approve the findings, determinations and recommendations of the City Plan- ning Commission of the City of E1 Segundo, California, all as set forth in said Resolution No. 139 of said Commission, hereinabove quoted in the preamble to this resolution and does hereby make the same findings and determinations on its own part as are made by said Commission in its said Resolution No. 139. SECTION 3. That said City Council does hereby accord- ingly establish the use of "sandblasting operations" as a use which properly may be, and is hereby authorized to be, located in the M -1 zone as established under said Ordinance No. 306, as amended, when such use is conducted as described and limited in said Resolution No. 139. mediately. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said Council; shall make a minute of the passage and adoption thereof in the records of the proceed- ings of said City Council in the minutes of the meeting at which the same is passed and adopted; shall forward a certified copy - 3 - of this resolution to the said City Planning Commission for its information and files; and shall furnish a copy thereof to each of the departments of said City concerned with the enforcement of the zoning or land use regulations of said City for their infor- mation in the premises.
