CC RESOLUTION 1306RESOLUTION NO. 1306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING THE FINDINGS AND DETERMINATIONS OF THE CITY PLANNING COMMISSION OF SAID CITY AS SET FORTH ITV RESOLUTION NO. 142 OF SAID CON11I3- SION THAT THE USE OF "MAGNETIC INSPECTION" BE CLASSIFIED A ZONE 110-2" USE, WHEN CONDUCTED AS DESCRIBED AND LIMITED IN SAID RESOLUTION NO. 142. WHEREAS, the City Planning Commission of the City of El "Segundo did heretofore on the 2nd day of April, 1953, after due consideration, adopt Resolution No. 142 of said Commission in words and figures as follows: "RESOLUTION NO. 142 "WHEREAS, the question was raised on March 30, 1953, by the Aeromagnetic Inspection Service, through Mr. Matt Kleinhaus, 7725 Atlantic Blvd., Bell, California, as to which zone under Ordinance No. 306 their business would be permitted to operate; and "WHEREAS, Section 12, Paragraph A, Use, of said ordi- nance provides that where ambiguities exist concerning classification of a ruse'; or if any ruse' is omitted from the lists of those specified as permissible under various zones, the Planning Commission shall ascertain all pertinent facts and render its findings, which findings and recom- mendations, when approved by the City Council, shall there- after prevail; "NOW, THEREFORE, BE IT RESOLVED, that the Planning Com- mission finds as follows: 1. That 'magnetic inspection' is not specifically mentioned in Ordinance No. 306. 2. That the inspection service as described involves no manufacturing. 3. That the inspection process involves iron filings mixed with oil. 4. That a small commercial degreasing apparatus uti- lizing five gallons of tri- chloral ethylene is used to clean objects to be inspected. - 1 - 5. That upon inquiry and investigation, said de- greasing equipment was found to be proven safe, and non - hazardous if properly installed; and the tri- chloral ethylene to be non - inflammable. 6. That there will be only light trucking from the alley. %. That this type of enterprise is of a lighter na- ture than some uses now permitted under C -2, com- mercial zone of Ordinance No. 306. "BE IT FURTHER RESOLVED, that by reason of the afore- said findings, the Commission concludes that 'magnetic in- spection', as described in the findings, qualify within the meaning and intent of Ordinance No. 306 as a ruse+ which may properly locate in the 'C -2' zone; "AND FTNALLY RESOLVED, that a copy of this Resolution be forwarded to the City Council for its consideration in the runner prescribed by law, and that if concurred in by said Council, that appropriate officers authorized to issue licenses and permits be informed and instructed accordingly. Allen Chairman of the City Planning Commission of the City of El Segundo, California "; and WHEREAS, said resolution was duly certified to the City Council of said City for its consideration and action there- on, all as contemplated under the provisions of Ordinance No. 306 (the land use plan - Zoning Ordinance) of said City, as amended; and WHEREAS, said City Council has duly and carefully con- sidered and discussed the said resolution and all of the terms, conditions and provisions thereof and is sati -Tied that the de- termination and decision made by said City Council, with reference thereto as hereinafter set forth, is correct and in the interests of said City and of the citizens thereof; now, therefore, - THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, FIND AND ORDER AS FOLLOWS: SECTION 1. Said Council does hereby find that the facts recited in the preamble of this resolution are true. - 2 - SECTION 2. That said City Council does hereby approve the findings, determinations and recommendations of the City Plan- ning Commission of the City of El Segundo, California, all as set forth in said Resolution No. 142 of said Commission hereinabove quoted in the preamble to this resolution;and does hereby make the same findings and determinations on its own part as are made by said Commission in its said Resolution No. 142. SECTION 3. That said City Council does hereby accord- ingly establish the use of "magnetic inspection" as a use which properly may be, and is hereby authorized to be, located in the C -2 zone as established under said Ordinance No. 306, as amended, when such use is conducted as described and limited in said Resolution No. 142. mediately. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said Council; shall make a minute of the passage and adoption thereof in the records of the proceed- ings of said City Council in the minutes of the meeting at which the same is passed and adopted; shall forward a certified copy of this resolution to the said City Planning Commission for its information and files; and shall furnish a copy thereof to each of the departments of said City concerned with the enforcement of the zoning or land use regulations of said City for their in- formation in the premises.
