A RESOLUTION CF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING
A CERTAIN CONTRACT TO AMERICAN CAST IRON
PIPE COMPANY FOR FURNISHING AND DELIVERING
TO SAID CITY CERTAIN CAST IRON PIPE.
WHEREAS, the City Council of the City of E1 Segundo,
California, has heretofore in the manner provided by law, duly and
regularly advertised for bids under notice to bidders entitled
"NOTICE INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDO".
dated March ¢, 1953, which is now on file in the office of the City
Clerk, open to public inspection, and hereby referred to and by
this reference incorporated herein and made a part hereof, for fur-
nishing and delivering certain cast iron pipe to said City; and
WHEREAS, at the time fixed for opening and considering
said bids, to wit: the hour of 7:00 otclock p.m. on Wednesday, the
25th day of March, 1953, said Council did publicly open, examine
and declare all bids received; and
WHEREAS, at said hour, the Director of Public Works re-
commended to said Council that the bid of American Cast Iron Pipe
Company, the low bidder, be accepted; and
WHEREAS, said Council concurs in the recommendation of
said Director of Public Works and has reached its decision in the
said matter;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the bid of American Cast Iron Pipe Com-
pany, of Los Angeles, California, dated March 24, 1953, which said
Council determines to be substantially as follows, to wit:

"With reference to your official advertisement of the
12th proposals would be received by you until 7:00
otclock p.m., Wednesday, March 25, 1953 for furnishing
the Cast Iron Pipe referred to therein, we are pleased
to quote as follows:

"The above prices are delivered on trucks City Pipe Yard, El
Segundo, California, for shipment from our foundries in Bir-
mingham, Alabama, via rail and steamer, through Los Angeles
Harbor, or for truck delivery where available to large truck
and trailer. Minimum shipment 40,000 pounds. Prices, however,
do not include California State Use Tax of 3%, and terms
are net thirty days.
"Our Mono -Cast pipe, on which we have quoted, would conform
to Federal Specification WW -P -421, Type II, and would have
our tEnamelinet lining, which is a cement lining 1/1611 in
thickness applied by method embodying both mechanical and
centrifugal forces, together with seal coat.
"As required, attached is bid bond in the amount of 44,000.00.
"Based on our present commitments, if favored with your order
we could make delivery complete within approximately 50 to
60 days, sooner if possible, but subject to delays beyond
our control.

"Assuring you our Mono-Cast pipe would fulfill your every
requirement as to performance and service, as has that we
have previously had the privilege of furnishing you, and
again thanking you for the opportunity of quoting, and
trusting we may have the pleasure of serving you, we are

and which said bid was submitted in response to and under the terms,
conditions, provisions and requirements set forth in said "NOTICE
INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDO", be, and
the same is hereby accepted on the basis of truck delivery as set
forth in the above quoted bid as to Items Nos. 1, 2, 3, 4 and 5 of
said Notice Inviting Bids at the prices set forth in said bid,
which is now on file in the office of the City Clerk of said City,
and which said bid so on file is hereby expressly referred to and
by this reference incorporated herein and made a part hereof for all
further particulars.
SECTION 2. The Contractor agrees, responsive to the pre-
Terence of the City Council of said City as expressed in the
notice inviting bids, pursuant to which this contract is made, that
only American -made materials, and, so far as reasonably possible,
California -made materials will be used in the work or improvement
contemplated under this contract, all in conformity with the pro-
visions of Sections 4300 to 43050 both inclusive, and Sections 4330
to 4334, both inclusive, of the Government Code of the State of
California.
SECTION 3. The Contractor, insofar as said Contractor
is legally required so to do, must observe and abide by the pro-
visions of all laws of the State of California and of the United
States of America relating to contracts of the nature contemplated
herein, whether herein specifically mentioned or not.
SECTION 4. That all bids received for said cast iron
pipe are hereby rejected with the exception of the bid of AMERICAN

CAST IRON PIPE COMPANY, hereinabove referred to, and the City
Clerk is hereby authorized and instructed to return the checks of
all unsuccessful bidders.
SECTION 5. That the City Clerk shall prepare copies of
this resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerk's Certifi-
cate, forms for the approval of the successful bidder and on the
part of the said City; and such copies of this resolution, so ap-
proved and accepted by the successful bidder and by and on behalf
of said City, shall constitute the contract for furnishing and
delivering to said City certain cast iron pipe, pursuant to the
award hereinabove made; and the Mayor of the City of E1 Segundo is
hereby authorized on behalf of said City to affix the approval and
acceptance of said City to such contract, and said City Clerk is
hereby authorized and instructed to attest the same on behalf of
said City and to affix the seal of said City thereto.
SECTION 6. That the City Clerk shall certify to the pas-
sage and adoption of this

ing of the said Council held on the 25th day of March, 1953, and
that the same was so passed and adopted by the following vote:
