CC RESOLUTION 1264Q-) RESOLUTION NO. 1261+. RESOWTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, IN THE MATTER OF THE IMPROVEMENT OF ACACIA AVENUE, BETWEEN HILLCREST STREET AND CEDAR STREET WHEREAS, the City Council of the City of E1 Segundo, California, did on the 5th day of November , 1952 receive a petition from the property owners for the improvement of Acacia Avenue, between Virginia Street and Hillerest Street, and also a petition for the improvement of said Acacia Avenue, between Cedar Street and Virginia Street, and attached to each of said petitions is a plat or map showing the exterior boundaries of the proposed assessment district for said improvements; and WHEREAS, the City Engineer has reported to this City Council that he has checked and examined the said petitions with the report of owners furnished by the Title Insurance and Trust Company and finds that the petition for the improvement of Acacia Avenue, between Virginia Street and Hillorest Street, represents 60.60% of the qualified owners in area of the property subject to assessment for the proposed improvement, as shown and delineated upon the plat or map attached to said petition, and also finds that the petition for the improvement of Acacia Avenue, between Cedar Street and Virginia Street, represents 61.52% of the qualified owners in area of the property subject to assessment for the proposed improvement, as shorn and delineated upon the plat or map attached to the last mentioned petition; and WHEREAS, the said City Council has duly considered the said petitions and report of the City Engineer with reference to the proposed improvements referred to in said petitions and are of the opinion that it is to the best interests of the property owners to consolidate these two petitions into one project. - 1 - NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS: SECTION 1. That the improvements referred to in said petitions are to be done and carried through in accordance with the provisions of the "Improvement Act of 1911 ", Division VII of the Streets and HighwaysCode of the State of California• SECTION 2, That this City Council does hereby find and determine that the combined qualified signatures to the said petitions, as shown by the report of such owners furnished by the Title Insurance and Trust Company, represent more than sixty per cent (60%) of the total assessable area of the proposed districts, as shown and delineated upon the plat or map attached to each petition. SECTION 3. That this City Council does hereby further find and determine that the said petitions for said improvements represent all the requirements prescribed by Section 2801 of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Division IV of the Streets and Highways Code of the State of California, and the City Council intends to met each and every condition and make each and every finding necessary on its part in order to permit the proceedings for said improvements to go forward to completion, without further reference to or application of the provisions of said Division 1V of said Streets and Highways Code. SECTION h. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
