CC RESOLUTION 1258' RESOLUTION OF INTENTION NO. 1258 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS IN- TENTION TO ORDER THE VACATION (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS OF WAY) OF CERTAIN POR- TIONS OF ARENA STREET, PALM AVENUE AND THE PUBLIC ALLEY WHICH RUNS EASTERLY AND WESTERLY THROUGH BLOCK 89, 'WITHIN SAID CITY. The City Council of the City of El Segundo, Cali- fornia, pursuant to the provisions of the "Street Vacation Act of 1941 ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, determine and order as follows: SECTION 1. That it is the intention of the City Council of the City of E1 Segundo, California, to order the vacation (subject to the reservation and exception of ease- ments and rights of way as set forth hereinafter) of the fol- lowing portions of the following public streets and alley within the said City, to wit: (1) All of that portion of Palm Avenue lying between the west line of Arena Street and the west line of Sheldon Street as shown on the map recorded as E1 Segundo Sheet No. 3 in Map Book 20, pages 22 and 23, on file in the office of the Recorder of Los Angeles County, California; (2) All of that portion of Arena Street lying be- tween the north line of Palm Avenue and a line which is parallel with said north line and dis- tant southerly 219.63 feet therefrom, said line being also the prolongation of the north line of the east -west alley through Blocks 88 and 89 as shown on the map recorded as E1 Segundo Sheet No. 3 in Map Book 20, Pages 22 and 23, on file in the office of the Recorder of Los Angeles County, California; and (3) All of that portion of the east -west alley in Block 89 lying between the west line of Sheldon Street and the east line of the north -south alley in said Block 89 as shown on the map recorded as E1 Segundo Sheet No. 3 in Map Book 20, Pages 22 and 23, on file in the office of the Recorder of Los Angeles County, California. - 1 - tr. w C-1, N For further particulars as to the proposed vacation of said portions of said streets and alley, reference is here- by made to a map entitled, "MAP SHOWING PORTIONS OF ARENA STREET, PALiv AVENUE AND OF PUBLIC ALLEY IN BLOCK 89 PROPOSED TO BE VA- CATED UNDER RESOLUTION OF INTENTION NO. 1258 ", on file and open to public inspection in the office of the City Clerk of the City of E1 Segundo, California, in the City Hall of said City, located at 203 Richmond Street therein. SECTION 2. The City Council does hereby determine that the public convenience and necessity require the reser- vation of the easements and rights of way for structures enu- merated in Section 8330 of the Streets and Highways Code of the State of California, and these proceedings are taken, subject to such reservations and exceptions. The easements and rights of way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time or from time to time, to construct, maintain, operate, re- place, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street, or alley, or part, or portion thereof proposed to be vacated hereby and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines and lines for the transportation or distribution of electric ener- gy, petroleum and its products, ammonia, water and incidental purposes, including access and the right to keep the property free from inflammable materi- als, and wood growth, and otherwise protect the - 2 - same from all hazards in, upon, and over the portions of the public streets and alley proposed to be vacated hereby. SECTION 3. That the hour of 7 :00 o'clock p.m. on Wednesday, the 21,th day of September , 19520 in the Council Chamber in the City Hall, 203 Richmond Street, in said City, be and the same is hereby fixed as the time and place when and where any and all persons interested in or objecting to the proposed vacation of said portions of said public streets and alley may appear before said City Council and be heard and offer testimony and submit evidence in relation thereto. SECTION 4. That the Superintendent of Streets of the City of E1 Segundo, California, be and he is hereby directed to cause "NOTICE OF STREET VACATION (PORTIONS (,F ARENA STREET, PAINT AVENUE AND THE PUBLIC ALLEY WHICH RUNS EASTERLY AND WEST- ERLY THROUGH BLOCK 89) AND OF PUBLIC HEARING THEREON ", to be posted as required by the said "Street Vacation Act of 1941 ", being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of said City hereby elects to proceed under the provisions of said Act. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, and shall cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated in said City and hereby designated for that purpose by the said City Council.
