CC RESOLUTION 1249683_ RESOLUTION NO. 121x9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO G. J. PAYNE COMPANY, INC. THE CONTRACT FOR FURNISHING THE CITY OF EL SEGUNDO WITH THE MATERIALS CONTEMPLATED UNDER ITEMS NOS. 15 AND 16 OF THE NOTICE TO BIDDERS DATED JUNE 180 1952• WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bid- ders entitled "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS AND ASPHALTIC EMULSION TO BE FURNISHED THE CITY OF EL SEGUNDO, CALIFORNIA. ", dated the 18th day of June, 1952, which is now on file in the office of the City Clerk, open to public in- spection, and hereby referred to and by this reference incor- porated herein and made a part heroof, for furnishing said City with the items referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7 :00 otclock p.m. (California Daylight Saving Time) on Wednesday, the 23rd day of July, 1952, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under advisement until the hour of 7 :00 otclock p.m. (California Daylight Saving Time) on Wednesday, the 30th day of July, 1952, and referred said bids to the Director of Pub- lic Works for review, consideration and report thereon; and WHEREAS, said last mentioned hour has now arrived and the Director of Public Works has submitted a report to this Council substantially as follows: - 1 - 6834a "Date July 30, 1952 "To: Honorable City Council From: Director of Public Works Subject: Recommendation Regarding Awarding Contract for Petroleum Products. "General Petroleum Corporation submitted the low bid for Item 15 -A while identical bids were submitted by General Petroleum Corporation, Richfield Oil Corporation and G. J. Payne Company, Inc. for Item 15 -B. G. J. Payne Com- pany submitted the low bid for Item 16. "Under Item 15, it is expected that the City will accept delivery of this item at bidder's plant rather than having it delivered to the City warehouse. Inasmuch as the G. J. Payne Company plant is located nearer to this City than the other two bidders under this item and also that the G. J. Payne Company is low bidder for Item 161 it is respectfully recommended that your Honorable Body award the contract to G. J. Payne Company for Items 15 and 16 at the prices stated in its proposal. Short Director of Public Works DRS :VM "; and WHEREAS, said Council concurs in the recommendation of said Director of Public Works, as hereinabove set forth, and has reached its decision in the said matter; NOW, THEREFORE, the City Council of the City of El Segundo, California, does resolve, declare and determine as follows: SECTION 1. That the bid of G. J. PAYNE COMPANY, INC., of 6$10 Crenshaw Boulevard, Los Angeles, California, dated July 10, 1952, which said Council determines to be substantial- ly as follows, to wit: "P R 0 P O S A L FOR FURNISHING GASOLINE, OIL LUBRICANTS AND LIQUID ASPHALTS TO THE CITY OF EL SEGUNDO, CALIFORNIA "To the Honorable City Council City of E1 Segundo, California "Gentlemen: "The undersigned hereby proposes to furnish to the City of - 2 - 8-1?3 E1 Segundo, California, in said City, during the period August 15, 1952 to and inclusive of August 14, 1953, at midnight, the following petroleum products at the prices stated in the schedule below and all in accordance with the Notice to Bidders attached hereto and further in ac- cordance with Specifications G.O. -3 heretofore approved and adopted by the City Council of said City and on file in the office of the City Clerk of said City, as follows, to wit: "ITEM 15 - - - -- American L3X Approx. 10,000 Gal. Bitumuls Penetration Type Asphal- State Brand tic Emulsion, as follows: B. FOB Bidder's plant in 200 gallon lots, t.0825 per Gal. ITEM 16 American HRM Approx. 5,000 Gal. Bitumuls Mixing Type Asphaltic State Brand Emulsion, delivered and spread on the job site in E1 Se- gundo in lots of at least 1,600 Gal., ' .0925 per Gal. "As required in said 'Notice to Bidders', there is en- closed Bid Bond in amount of TWO HUNDRED DOLLARS ($200.00); and as further required in said tNotice to Bidders', bid- der hereby states that California 'Sales Tax' or 'Use Taxt or any other State or Federal Tax IS NOT included in the amount bid. TH DATE July 10, 1952• (SEAL) - 3 - \�� 2 � 64 � a. 683, j� be and the same is hereby accepted as to Items Nos. 15 -B and 16 under said notice to bidders dated June 1$, 1952, at the respective prices therefor set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby express- ly referred to and,by this reference incorporated herein and made a part hereof for all further particulars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this con- tract is made, that only American -made materials and Cali- fornia -made materials will be used in the work or improve- ment contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both in- clusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Con- tractor is legally required so to do, must observe and abide by the provisions of all laws of the State of Cali- fornia and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received on Items Nos. 15 and 16 under said notice to bidders, with the exception of the said bid of said G. J. PAYNE COMPANY, INC., be and the same are hereby rejected; and the City Clerk is here- by authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerkts Certificate, forms for the approval of the - 5 - 6836 successful bidder and on the part of the said City, and such copies of this resolution, so approved and accepted by such successful bidder and by and on behalf of said City, shall constitute the contract for furnishing to said City all of the asphaltic emulsion requirements mentioned in said bid, and which are to be furnished by such successful bidder pur- suant to the award hereinabove made. SECTION 6. That the Mayor of the City of E1 Se- gundo is hereby authorized and directed to execute the con- tract or agreement between said City and said successful bidder; and the City Clerk to attest the same; affix the City's seal thereto and make delivery thereof in due course, as here - inabove awarded. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of El Segundo; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
