CC RESOLUTION 12486823 RESOLUTION NO. 1248 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDTNG TO CENTURY OIL COMPANY THE CONTRACT FOR FURNISHING THE CITY OF EL SEGUNDO WITH THE MATERIALS CONTEMPLATED TINDER ITEMS NOS. 1 TO 13, BOTH INCLUSIVE, OF THE NOTICE TO BIDDERS DATED JUNE 180 1952• WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders entitled "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS AND ASPHALTIC EMULSION TO BE FURNISHED THE CITY OF EL SEGUNDO, CALIFORNIA. ", dated the 18th day of June, 1952, which is now on file in the office of the City Clerk, open to public in- spection, and hereby referred to and by this reference incor- porated herein and made a part hereof, for furnishing said City with the items referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7:00 o'clock p.m. (Califor- nia Daylight Saving Time) on Wednesday, the 23rd day of July, 1952, said Council did publicly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take all of said bids under advisement until the hour of 7:00 o'clock p.m. (California Daylight Saving Time) on Wednesday, the 30th day of July, 1952, and referred said bids to the Director of Public Works for review, consideration and report thereon; and WHEREAS, said last mentioned hour has now arrived and the Director of Public Works has reported to this Council that he has reviewed and considered all bids received under - 1 - 6824 said notice and found that the bid of Century Oil Company, here- inafter referred to, is the lowest regular responsible bid on Items Nos. 1 to 13, both inclusive, of said notice inviting bids measuring up to the specifications of the City of E1 Se- gundo referred to in said notice; and WHEREAS, this Council approves the recommendation of said Director of Public Works and has reached its decision in the said matter; NOW, THEREFORE, the City Council of the City of El Segundo, California, does resolve, declare and determine as follows: SECTION 1. The City Council hereby finds and deter- mines that the bid of Century Oil Company, hereinafter referred to, is the lowest regular responsible bid received on Items Nos. 1 to 13, both inclusive, under the notice inviting bids, as specified in the Cityts Specifications designated in the said notice inviting bids. SECTION 2. California State Sales tax is applicable and will be added to the prices above quoted on all of the products to be furnished, except gasoline. In the event, by due process of law, of the imposition of additional taxes or an increase or decrease of present taxes applicable to the products purchased hereunder, the prices herein quoted payable to the City of E1 Segundo, including maximum prices, will advance or decline in an equal amount. Ad I �yS `=t: ✓p :x u�v.� 6828 be and the same is hereby accepted as to Items Nos. 1 to 13, both inclusive, under said notice to bidders dated June 18, 1952, at the respective prices therefor set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further particulars. SECTION 3. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American- madeiraterials and California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305; both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 4. The Contractor, insofar as said Contrac- tor is legally required so to do, must observe and abide by the provisions of all laws of the State of California and of the United States of America relating to contracts of the na- ture contemplated herein, whether herein specifically mention- ed or not. SECTION 5. That all bids received on Items Nos. 1 to 13, both inclusive, under said notice to bidders, with the exception of the said bid of said CENTURY OIL COMPANY, be and the same are hereby rejected; and the City Clerk is hereby authorized and instructed to return the checks of all unsuc- cessful bidders. SECTION 6. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certificate, forms for the approval of the successful bidder - 6 - and on the part of the said City, and such copies of this re- solution, so approved and accepted by such successful bidder and by and on behalf of said City, shall constitute the con- tract for furnishing to said City all of the items and ma- terials mentioned in said Ttems Nos. 1 to 13, both inclusive, in said bid, and which are to be furnished by such successful bidder pursuant to the award hereinabove made. SECTION 7. That the Mayor of the City of El Segundo is hereby authorized and directed to execute the contract or agreement between said City and said successful bidder; and the City Clerk to attest the same; affix the City's seal thereto and make delivery thereof in due course, as herein- above awarded. SECTION 8. That the City Clerk shall certify to the passage and adoption of this re. >olution; shall cause the original of the same to be entered in the book of resolutions of the said City of El Segundo; and shall make a minute of the passage and adoption thereof in the records of the pro- ceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
