CC RESOLUTION 1228RESOLUTION OF INTINTICK NO. 1228. RESOLUTION OF THE CMT70UNcn OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF CERTAIN STREET IMPROVEMENTS AND SANITARY SEWERS IN PORTIONS OF BUNGALOW STREET, MARYLAND STREET AND WALNUT AVENUE IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND DESCRIBING TiE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES, AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of El Segundo, pursuant to the provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California, DOES RESOLVE as follows DESCRIPTION OF WORK SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of E1 Segundo, California, to order the following work to be done, to -wits First: The grading, paving with plant mix surfacing, con- .traction of cement concrete curbs and sidewalks, and appurtenant work in connection therewith; in C. Yi INS between the Southerly line of Walnut Avenue and the Northerly line of Tract 12887, as per map recorded in Map Book 249, Pages 24 and 25, Records of Los Angeles County, California; and in the Easterly 25 feet of MARYLAND STREET between the Westerly prolongation of the center line of Walnut Avenue and the Northerly line of said Tract 12887; and in the Southerly 25 feet of WALNUT AVENUE between the Westerly line of Center Street and the Northerly prolongation of the center line of Maryland Street; and in the Westerly 15 feet of between the Easterly prolongation of the center line of Walnut Avenue and a line 55 feet Southerly from and parallel with said produced line, 1 6758 Second: The removal of 147 square feet of existing cement sidewalk and 32 feet of existing cement curb along the Southerly side of Walnut Avenue and the Westerly side of Center Street, as shown on Sheet 3 of the plans hereinafter referred to. Thirds The construction of vitrified clay pipe sanitary sewer, vitrified clay pipe house connection sewers, manhole, and appurtenant work in connection therewith; in BUNGALOW STREET and WALNUT AVENUE between the existing manhole at the intersection of Bungalow Street and Walnut Avenue and a point distant 350 feet Southerly therefrom. PIANS, FROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. That all of the said work and improvement to be done shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvement in portions of Bungalow Street, Maryland Street and Walnut Avenue, being Plan and Profile No. 520402, consisting of 4 sheets, and Standard Plans S. T. 5001, Sheet 2, S.T. 5003, S. D. 410610 and S. D. 410422, all on file in the office of the City Engineer of said City and except as otherwise provided on said plans, in further accordance with the specifications for the construction of said improvement, said specifications being on file in the office of the City Clerk of said City and to which plans, profiles, drawings and specifications heretofore approved by the City Council of said City, reference is hereby made for a further, full and more particular description of said work and by reference tle reto, the same are incorporated herein and made a part hereof. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or - 2 - 6'59 ordinary public benefit and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as followsz All that certain territory of the City of E1 Segundo, California, exclusive of streets and alleys, included within the exterior boundary line shown upon that certain map or plat, being Sheet 3 of said Plan No. 520402, approved May 14, 1952 by the City Council of said City, indicating by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Engineer of said City. Reference is hereby made to said map or plat for a b rther, full and more particular description of said assessment district, and the map or plat so on file shall govern for all details as to the extent of the said assessment district. DESCRIPTION OF BONDS SECTION 4. That serial bonds, bearing interest at the rate of six per cent (6%) per annum, shall be issued to represent each assessment of Twenty -five Dollars ($25.00) or more remaining unpaid for thirty (30) days after the date of recording the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October fifteenth following their date. Payments on the principal of unpaid assessments and interest thereon shall be made by property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in the "Improvement Act of 1911" hereinafter referred to. PORTION OF COSTS AND EXPENSES TO BE PAID BY THE CITY SECTION 5. NOTICE IS HEREBY GIVEN that the said City Council Of the City of E1 Segundo has determined and declared that the City will pay out of its General Fund the sum of $121.00 toward the costs - 3 - 6'766 and expenses of the removal and replacement of existing curbs and sidewalks along the Southerly side of Walnut Avenue and the Westerly side of Center Street at the Southwesterly corner of said streets. The liability and obligation to pay such sum, as provided herein, shall accrue and become fixed upon the date of the confirmation of the assessment by the City Council of said City. TIC AND PLACE OF HEARING SECTION 6. NOTICE IS HEREBY GIM that on the 18th day of 1952 June3/at the hour of seven - thirty o'clock (7;30) P. M., in the chanbers of the City Council in the City Hall of said City of E1 Segundo, any and all persons having any objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 7. That all of the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California, designated the *Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION CF INTENTION SECTION 8. That the "E1 Segundo Herald ", a weekly newspaper, published and of general circulation in the City of E1 Segundo, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publicattions in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last - 4 - 6'761 equalized assessment roll for city taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Code, POSTING OF NOTICE OF IMPROVEMENT SECTION 9. That the Superintendent of Streets of the City of E1 Segundo shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code.
