CC RESOLUTION 1215RESOLUTION NO. 1215 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO U. S. PORCELAIN ENAMEL CO. THE CONTRACT OR ORDER FOR FURNISHING SAID CITY WITH 248 COMPLETE STREET NAME SIGN UNITS FOR USE OF THE STREET DEPARTMENT OF SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under a notice to bidders entitled, "NOTICE INVITING BIDS ON STREET NAME SIGN UNITS ", dated February 7, 1952, which is now on file in the office of the City Clerk, open to public inspection, and here- by referred to and by this reference incorporated herein and made a part hereof, for furnishing said City with certain equipment for use of said City; and WHEREAS, at the time fixed for opening and consider- ing said bids, to wit: the hour of 7 :00 o'clock p.m. on Wednesday, the 5th day of March, 1952, said Council did pub- licly open, examine and declare all bids received; and WHEREAS, at said hour said Council did take said bids under advisement until the hour of 7:00 o'clock p.m. on Wednes- day, the 12th day of March, 1952, and did refer said bids to Public Commissioner Peterson and the Director of Public Works for analysis and report thereon; and WHEREAS, said last mentioned hour has now arrived, and the Director of Public Works has submitted his recommendations to this Council in words and figures as follows, to wit: "It is respectfully recommended that your Honor- able Body award the contract for 248 street name signs, as per the list in the office of the undersigned, to U. S. Porcelain Enamel Company and that the contract specifically provide the signs to be fabricated from - 1 - {�w i.a dpi 16 gauge Armco Enameling Iron, or equal, and that the edges be buffed to permit better adhesion of the por- celain to the metal and further that the supplier guaranty these signs against defacing by atmospheric corrosion for a period of ten years. These provisions are to be in addition to and supplemental to the re- quirements of the specifications heretofore submitted. ", and WHEREAS, said Council concurs in the recommendations of said Director of Public Works, as hereinabove set forth, and feels and hereby finds that the action hereinafter taken is in the best interest of said City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: SECTION 1. That the bid of U. S. PORCELAIN ENAMEL CO. of 4635 East 52nd Drive, Los Angeles, California, dated February 28, 1952, which said Council determines to be in words and figures as follows, to wit: "U. Kimball 5 1 0 4 "February 28, 1952 "City Clerk City Hall City of E1 Segundo El Segundo, California "Gentlemen: "We are happy to bid on the 24$ street name signs per your specifications. Our price is X12.00 per complete sign unit, plus 3% sales tax. "F. 0. B. E1 Segundo - Delivery 30 to 40 days. "Terms: Net 30 days. "The sample required to be submitted has been submitted to the City Engineer. "Total of our bid is: 11248 Street Name Signs L 412.00 _ X2,976.00 3;'b Sales Tax - - - 89.28 ',3,006 - 2 - "Our check for 4310.00 (at least 10;o) is enclosed. "RBE/hh Enc. "Yours very truly, U. S. PORCELAIN ENAMEL CU. /s/ R B Evenson R. B. Evenson ". and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said "NOTICE INVITING BIDS ON STREET NAME SIGN UNITS ", be and the same is hereby accepted at the bid price of 43,065.28, subject, however, to the conditions recited in the recommenda- tions of the Director of Public Works hereinabove quoted in the preamble to this resolution. Said bid is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this refer- ence incorporated herein and made a part hereof for all fur- ther particulars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials, and, so far as rea- sonably possible, California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Contract- or is legally required so to do, must observe and abide by the provisions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mention or not. - 3 - SECTION 4. That all bids received for said equipment are hereby rejected with the exception of the bid of U. S. PORCELAIN ENAMEL CO., hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this reso- lution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing to said City 248 street name sign units, pur- suant to the award hereinabove made; and the Mayor of the City of El Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such con- tract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the origi- nal of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shallmake a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
