RESOLUTION NO. 1205
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, AWARDING A CERTAIN
CONTRACT TO PACIFIC STATES CAST IRON PIPE CO.
FOR FURNISHING AND DELIVERING TO SAID CITY
CERTAIN CAST IRON PIPE.
WHEREAS, the City Council of the City of E1 Segundo,
California, has heretofore in the manner provided by law, duly and
regularly advertised for bids under notice to bidders entitled
"NOTICE INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDO ",
dated November 23, 1951, which is now on file in the office of the
City Clerk, open to public inspection, and hereby referred to and
by this reference incorporated herein and made a part hereof, for
furnishing and delivering certain cast iron pipe to said City; and
WHEREAS, at the time fixed for opening and considering
said bids, to wit: the hour of 7 :00 ofclock p.m. on Wednesday, the
19th day of December, 1951, said Council did publicly open, examine
and declare all bids received; and
WHEREAS, at said hour, the Director of Public Works
recommended to said Council that the bid of Pacific States Cast
Iron Pipe Co., the low bidder, be accepted (on the truck delivery
basis as set forth in its said bid); and
WHEREAS, said Council concurs in the recommendation of
said Director of Public Works and has reached its decision in the
said matter;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SE-
GUNDO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That the bid of Pacific States Cast Iron
Pipe Co., of Los Angeles, California, dated December 19, 1951,

which said Council determines to be substantially as follows, to wit:

"The above prices are f.o.b. our foundry at Ironton, Utah with
full rail and truck freight allowed to your yard in E1 Segundo
in the case of our truck bid or wth full rail freight allowed
to the siding nearest your yard in the case of rail carload
delivery.
"These prices are based on current freight rates. Any change
in these rates before time of shipment would be for your ac-
count.
"Arrangements may be made to prepay the freight but it is under-
stood that this prepayment is done as an accommodation only
and will not change the f.o.b. point.
"Terms are 30 days net.
"Prices quoted are exclusive of any state or city sales or use
tax which might apply.
"Shipment could be started immediately and completed within
approximately ten days.

"Prices quoted are firm if we are allowed to make shipment of
the pipe within 30 days after date of award.
"This quotation is offered for acceptance within three weeks.
"We are attaching a bid bond to cover ten per cent of the
amount of our bid.

and which said bid was submitted in response to and under the terms,
conditions, provisions and requirements set forth in said "NOTICE
INVITING BIDS ON CAST IRON PIPE FOR THE CITY OF EL SEGUNDO ", be, and
the same is hereby accepted on the basis of truck delivery as set
forth in the above quoted bid as to Items Nos. 1, 2, 3 and 4 of said
Notice Inviting Bids at the prices set forth in said bid, which is
now on file in the office of the City Clerk of said City, and which
said bid so on file is hereby expressly referred to and by this
reference incorporated herein and made a part hereof for all further
particulars.
SECTION 2. The Contractor agrees, responsive to the
preference of the City Council of said City as expressed in the
notice inviting bids, pursuant to which this contract is made, that
only American-made materials, and, so far as reasonably possible,
California -made materials will be used in the work or improvement
contemplated under this contract, all in conformity with the pro-
visions of Sections 4300 to 4305, both inclusive, and Sections 4330
to 4334, both inclusive, of the Government Code of the State of
California.
SECTION 3. The Contractor, insofar as said Contractor
is legally required so to do, must observe and abide by the pro-
visions of all laws of the State of California and of the United

States of America relating to contracts of the nature contemplated
herein, whether herein specifically mentioned or not.
SECTION 4. That all bids received for said cast iron
pipe are hereby rejected with the exception of the bid of PACIFIC
STATES CAST IRON PIPE CO., hereinabove referred to, and the City
Clerk is hereby authorized and instructed to return the checks of
all unsuccessful bidders.
SECTION 5. That the City Clerk shall prepare copies of
this resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerk's Certifi-
cate, forms for the approval of the successful bidder and on the
part of the said City; and such copies of this resolution, so ap-
proved and accepted by the successful bidder and by and on behalf
of said City, shall constitute the contract for furnishing and de-
livering to said City certain cast iron pipe, pursuant to the award
hereinabove made; and the Mayor of the City of E1 Segundo is hereby
authorized on behalf of said City to affix the approval and accep-
tance of said City to such contract, and said City Clerk is hereby
authorized and instructed to attest the same on behalf of said City
and to affix the seal of said City thereto.
SECTION 6. That the City Clerk shall certify to the
passage and adoption of this resolution; shall cause the original
of the same to be entered in the book of resolutions of the said
City of E1 Segundo, and shall make a minute of the passage and adop-
tion thereof in the records of the proceedings of the City Council
of said City, in the minutes of the meeting at which the same is passed
and adopted.

ing of the said Council held on the 19th day of December, 1951, and
that the same was so passed and adopted by the following vote:
