CC RESOLUTION 118265.`222 RESOLUTION NO. 1182 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO A. M. DONAHER & SON THE CONTRACT OR ORDER FOR FURNISHING SAID CITY WITH ONE NEW STREET SWEEPER FOR USE OF THE STREET DEPARTMENT OF SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders en- titled, "NOTICE TO BIDDERS ON STREET SWEEPER ", dated July 25, 1951, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated herein and made a part hereof, for furnishing said City with the item referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7 :00 o'clock p.m. on Wednes- day, the 15th day of August, 1951, said Council did publicly open, examine and declare all bids received; and did duly and regularly take all of said bids under advisement between said date and the date upon which this resolution is adopted; and WHEREAS, said City Council, after having observed field demonstrations of the various items of equipment offered in said bids and having received the recommendations of the Director of Public Works with reference thereto, has reached its decision as hereinafter setfbrth; now, therefore, - THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALI- FORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: - 1 - 6 d3 SECTION 1. That the bid of A. M. DONAHER & SON, of 1625 Glendon Avenue, West Los Angeles 24, California, dated August 15, 1951, which said Council determines to be substan- tially as follows, to wit: "A. M. "Also in accordance with your notice, we as Dis- tributors for the Elgin Sweeper Company, offer the City of E1 Segundo the sum of Seven Hundred Fifty Dollars ($750.00) for one Used 'Guttersnipe' model Street Sweeper. Elgin, Illinois, freight allowed to destination, the following machine in accordance with specifications a tached: One (1) ELGIN 81 Motor Sweeper - Gross Hippo - Hopper volume capacity - -86 cubic feet - Loading capacity of Hi po- Hopper--3 cubic yards (81 cubic feet) - 2 - n "Standard Accessories (included): 1 extra Main Broom Core 1 extra set (5) Side Broom 1 Broom Cable Segments Fibre for filling one broom 50 pounds Steel Broom Wire Painting -- Chrome Orange or Fawn Grey Standard lettering (black) as specified by buyer. 6<524 "For the sum of NINE THOUSAND NINE HUNDRED AND 00 /100 Dollars $9,900.00. Dona er, Distributor and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said "NOTICE TO BIDDERS ON STREET SWEEPER ", be and the same is hereby accepted at the bid price of $9,900.00, plus State Sales Tax in the sum of $297.00 and subject to an allowance of $750.00 for the used equipment therein referred to. Said bid is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further parti- culars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials, and, so far as reasonably possible, California -made materials will be used in the work or improvement contemplated under this contract, all in conformity - 3 - 65 ^5 , with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Contractor is legally required so to do, must observe and abide by the pro- visions of all laws of the State of California and of the United States of America relating to contracts of the nature contem- plated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for said equipment are hereby rejected with the exception of the bid of A. M. DONAHER & SON, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all un- successful bidders. SECTION 5. That the Mayor and /or City Clerk of the City of E1 Segundo are, and each of them is, hereby authorized and instructed to execute any written evidence of transfer which may be required from the City of E1 Segundo to the said success- ful bidder of any used equipment, credit for which is to be ap- plied on the purchase price of said new equipment, and make delivery thereof in due course. SECTION 6. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnish- ing to said City one (1) certain Street Sweeper for use in the Street Department, pursuant to the award hereinabove made; and the Mayor of the City of E1 Segundo is hereby authorized on be- half of said City to affix the approval and acceptance of said - 4 - 65n6 City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. 1951.
