CC RESOLUTION 11456387, RESOLUTION NO. 1145 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTED PURSUANT TO PROVISIONS OF SECTION 2808 OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 ", OF DIVISION IV OF THE STREETS AND HIGHIiNAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council of the City of E1 Segundo, California, has received a communication from the Health Officer of the County of Los Angeles (who acts as Health Officer in the City of El Segundo under an agreement with said County), and which communication is In words and figures as follows: m February 1, 1951. City of E1 Segundo Office of Engineering 209 West Franklin E1 Segundo, California Attention: Mr. Donald R. Short, Dir:ctor of Public Works Gentlemen: SUBJECT; Proposed Sanitary Sewer District No. 501115, City of El Segundo RECOMMENDATION. It is respectfully recommended that sanitary sewers be installed in this District. ANALYSIS; This Department has made an investigation of the area of the proposed sanitary sewer district #{501115, located in that portion of East Maple Avenue, lying and being between California and Center Streets and in that portion of California Street lying and being between Walnut and Palm Avenues. The results of this investigation indicate that six property owners or tenants were contacted. This is a newly developed and sparsley populated section of town. Most of the homes are from three months to two and one -half years of age. One property owner stated that their cesspool overflowed after eight months use and they made arrangements to connect to the sewer. The soil in the area of this District consists of fine sand silt and some clay. This type of soil is not conducive to any type of individual sub - surface sewage disposal system and systems installed in this area cannot be expected to function satisfactorily over any great period of time without creating an insanitary condition. - 1 - 633'7 1 Several domestic water wells of the El Segundo City Water Department are located in very close proximity to the homes in this District. In fact one residence at 836 California Street has a cesspool within approximately one hundred feet of one of these wells. This cesspool is located to the North of this water well and in what this Department would assume as directly in line - from North to South - with the underground water flow. This Department has also been informed that on other vacant lots adjacent to this well, restrictions have been imposed to prevent building on these lots until such time as sewers are available. This restriction was a measure necessary to preclude the possibility of contaminating this city water supply well with sewage. In view of our survey and due to the close proximity of the E1 Segundo Water Supply wells to this area, this Department respectfully recommends that proceedings be instituted at once for the installation of sanitary sewers as an improvement necessary to the protection of public health. This recommendation is made pursuant to the provisions of Section 2808 of the Streets and Fighways Code. n Very truly yours, (signed) ROY 0. GILBERT, M. D. Los Angeles County Health Officer It AND WHEREAS, the City Council has duly considered the said communication and has received information from the City Engineer with reference to the proposed sewer improvements, referred to in said communication; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS; SECTION 1. That the improvements referred to in said communication above quoted is the construction of sanitary sewers and appurtenant work in Maple Avenue, between the center line of Center Street and the center line of California Street, and in California Street, between points distant 315 feet Southerly and 600 feet Northerly frow the center line of Maple Avenue. - 2 - SECT "ON 2. That the said City Council does hereby find and determine that the construction of said sanitary sewers and incidental work in connection therewith, and each of them, is necessary as a health measure and such necessity for such construction is found to exist. SECTION 3. That the City Clerk is hereby authorized and instructed to spread the contents of said original communication upon the minutes of this meeting of the said City Council at which this resolution is adopted. SECTION b. That this resolution is adopted under and pursuant to the provisions of Section 280B of the "Special Assessment Investigation, Limitation and Majority Protest Act of 193111, Division IV of the Streets and Highways Code of the State of California, and the City Council in adopting the same intends to meet each and every condition and to make each and every finding necessary on its part in order to permit the proceedings for said sewer improvements to go forward to completion without further reference to, or application of, the provisions of said Division IV of said Streets and Highways Code, PASSED, APPROVED AND ADOPTED this 2nd day of May , 1951.
