CC RESOLUTION 113363 RESOLUTION NO. 1133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL BEGUND09 CALIFORNIA, AWARDING A CERTAIN CONTRACT TO CLARK TROBOUGH FOR THE CONSTRUC- TION AND COMPIM1014 OF A CERTAIN WALL AND APPURTENANCES IN AND FOR SAID CITY. WHEREAS, this Council has heretofore at this meeting approved "City of E1 Segundo, California, Concrete Retaining Wall, S. Wall - New Fire Station, Dwg. No. Fire -1 ^; and WHEREAS, the Director of Public Works has reported to this Council that Clark Trobough, Contractor, of Los Angeles, California, California License No. 115171, is willing to con- struct the said wall in accordance with the said drawing and in accordance with specifications therefor, to be furnished by the Director of Public Works for the sum of $788.00; and WHEREAS, this Council feels that the said improvement is a desirable and necessary improvement in conjunction with the fire station premises now occupying the property to which the said wall is adjaeent; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: SECTION 1. That the contract for the construction and completion of said wall and appurtenances and the furnishing of all materials, supplies, work, labor and services necessary there- for, shall be and the same is hereby awarded to the said Clark Trobough, Contractor, at the said contract price of $788.00, pay- able upon completion of the said improvement to the satisfaction and approval of the Director of Public Works and the City Council, in accordance with said drawing and specifications therefor. - 1 - 63 _Z SECTION 2. Said Contractor agrees that all work shall be done in accordance with the provisions of the „Labor Code„ of the State of California, and to pay not less than the general prevail- ing rates of wages in the City of E1 Segundo, California, (the locality in which the said work or improvement is to be performed) for each craft or type of workman or mechanic needed to execute this contract for said work or improvement. Any classification omitted herein, not lessthan -------- ------ --- ----- --- ---- ---- --- - -- ----1.65 overtime - one and one -half (1 *) times the above rates. Sundays and Holidays - one and one -half (1 *) times the regular rates. Saturday is treated not as a legal holiday or overtime work unless same falls upon a calendar day, the whole of which is declared a legal holiday by law. The minimum rates of wages hereinabove set forth contem- plate in each instance a working day of eight hours, and it shall be mandatory upon the contractor and upon any subcontractor under such contractor, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the exeou- tion of the within contract. The Contractor agrees that its attention has been directed to Sections 1810 to 1817, both inclusive, of the California Labor Code relating to working hours, and to Sections 1850 to 1854, both inclusive, of said Code relating to employment of aliens upon pub - lio works; and said Contractor does hereby agree to observe and be bound by each and all of the provisions of said Code Sections in the execution of this contract. The Contractor, insofar as said Contractor is legally re- quired so to do, must observe and abide by the provisions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. - 3 - SECTION 3. Said Contractor agrees that only American- made materials and California -made materials will be used in the work or improvement contemplated under this contract, all in con- formity with the provisions of Sections 4300 to 4305, both inclu- sive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 4. That all bids or offers received for said work or improvement, with the exception of the said bid of CLARK TROBOUGH, be and the same are hereby rejected. SECTION 5. This award is made with the understanding that the work must be commenced within ten (10) days after date of the contract hereby awarded and must be completed within thirty (30) days after such date of such contract. SECTION 6. That the said Contractor must at the time of receiving the contract hereunder, furnish and file with the City Clerk a good and sufficient surety bond in an amount equal to at least 25% of the contract price for the faithful performance of said con- tract, and a good and sufficient surety bond in an amount equal to at least 50% of the contract price to secure laborers and material - men. Both of said bonds shall be subject to the approval of the City Attorney as to form, and of the Mayor and City Council as to surety. SECTION 7. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certifi- cate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so ap- proved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for the construction and completion of a certain retaining wall adjacent to the Fire Station in said City, pursuant to the award hereinabove made; and the Mayor 4 - �I- W of the City of El Segundo is hereby authorized, on behalf of said City, to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the official seal of said City thereto. SECTION S.
