CC RESOLUTION 1114r RESOLUTION NO. 1114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO WALLACE AND TIERNAN SALES CORPORATION A CERTAIN CONTRACT FOR THE FURNISHING TO SAID CITY OF CERTAIN CHLORINATION EQUIP=T FOR USE IN THE WATER DEPA.RTYENT OF SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders en- titled "NOTICE IKVITING BIDS ON CHLORINATION EQUIPPi,ENT}T, dated September 13, 1950, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated herein and made a part here- of, for furnishing said City with the items referred to in said notice; and WHEREAS, at the time fixed for opening and considering said bids, to wit: the hour of 7 o'clock p, m. on Wednesday, the 11th day of October, 1950, said Council did publicly open, examine and declare all bids received; and [AIAF'MAS, at said hour said Council did take all of said bids under advisement until the hour of 7 o'clock p. m. on Wednes- day, the 18th day of October, 1950, and referred jaid bids to the Director of Public Works for study and report; and WHEREAS, at said last mentioned hour, said Council did take said bids under further advisement until the hour of 7 o'olock p. m. on Wednesday, the 25th day of October, 1950; and VMREAS, said last mentioned hour has now arrived and the Director of Public Works has submitted a report to this Coun- oil in words and figures as follows, to wit: M-M cI (-I�; "October 25, 1950 "Honorable City Council City Hall El Segundo, California "Gentlemen: "At your regular meeting held on October 11, 1950, your Honorable Body opened, examined and publicly declared bids received at that meeting for furnishing the City of E1 Segundo certain chlorination equipment. Following the opening and declaring of the above mentioned bids they were referred to the undersigned for study and report thereon. "Your Director of Public Works aided and assisted by the Water Foreman has conducted an extensive study and investigation of these bids, and the individual items of equipment included therein. The investigation was con- ducted by personally contacting operators of equipment identical with, or similar to, the bid items. Discussions were had with such people as Mr. Mel Lloyd, Water Super- intendent of the City of Hawthorne, 11r. Sweeney, Chlori- nation Superintendent of the Los Angeles Bureau of Water & Power, Mr. Ackerman, Assistant Sanitary Engineer of the City of Pasadena, and numerous other water works operators and officials. Wherever possible on the spot inspections were made of the equipment under actual operating condi- tions. These discussions and inspections decisively pointed up the operating weaknesses of some of the machines offered under the above described bids. "It is the considered opinion of the undersigned that the award for the permanent chlorination equipment for use at the Water Treatment Plant should be granted to Wallace And Tiernan Sales Corporation under Item 1C of their bid proposal, and that the award for the portable chlorination equipment also be made to Wallace And Tiernan Sales Corpo- ration for Item 2 of their proposal. "Respectfully submitted, DONALD R. SHORT, Director of Public Works "DRS:dw and WHEREAS, said Council approves the recommendations of said Director of Public Works as set forth in his above quoted report and does hereby find and determine that the particular equipment hereinafter referred to will best serve the needs and requirements of said City and be in its best interest; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFOM,IA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS- - 2 - SECTION 1. "A survey of the water treatment plant and discussions with the Water Superintendent were made by one of our En- gineers, and all of the equipment proposed to be furnished is based upon the studies and discussions as well as our considered recommendations to provide for sufficient and proper chlorination at the least cost to the City most con - sistant with good operational and maintenance practice. Accompanying this proposal is our bid bond in the amount of ten per cent (10%) of the highest cost combination of Items 1 and 2. "The successful Performance for any of the equipment proposed for Item 1 is based upon a minimum of thirty five pounds per square inch water pressure being available at all times to the chlorinator. This minimum pressure was stipulated by the Water Superintendent. "It is our desire to be of the greatest possible ser- vice to the City and we respectfully request that we may be permitted to further discuss this proposal with your personnel to further clarify or amplify any or all items to be considered. Bejcek - District Engineer" and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said "NOTICE INVITING BIDS ON CHLORINATION EQUIPMENT ", be, and the same is hereby accepted as to Item 1C and Item 2 of said bid at the prices set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further particulars. SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, - 5 - that only American -made materials, and, so far as reasonably possible, California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Contrac- tor is legally required so to do, must observe and abide by the provisions of all laws of the State of California and of the United States of .America relating to contracts of the nature con- templated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for said equipment are hereby rejected with the exception of the bid of Wallace and Tiernan Sales Corporation, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on ,1 behalf of said City, shall constitute the contract for furnishing to said City certain chlorination equipment, pursuant to the award hereinabove made; and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said 61(" City of El Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
