CC RESOLUTION 10996978 RESOLUTION NO. 1099 A RESOLUTION OF TIE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING A CERTAIN CONTRACT FOR THE PURCHASE BY SAID CITY OF TWO (2) ONE AND ONE -HALF (1j) TON FORD SIX CYLINDER TRUCK CHASSIS WITH CABS TO IRA E. ESCOBAR. WHEREAS, the City Council of the City of El Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders en- titled "NOTICE INVITING BIDS ON MOTOR VEHICLES", dated August 9, 1950, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this refer- ence incorporated herein and made a part hereof, for furnishing said City with the items referred to in said notice; and WHEREAS, at the time for opening and considering all of said bids, to wit: the hour of 7:00 o'clock P. M. (California Daylight Saving Time) on Wednesday, the 30th day of August, 1950, said Council did publicly open, examine and declare all bids re- ceived; and WHEREAS, at said hour said Council did take all of said bids under advisement until the hour of 7:00 o'clock P. M. (California Daylight Saving Time) on Wednesday, the 6th day of September, 1950, and referred said bids to the City Coordinator for checking; and WHEREAS, said City Coordinator has duly reported to this Council with reference to all bids received and after con- sideration of such report, the City Council feels that the ac- tion hereinafter taken is in the best interest of said City. NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: - 1 - SECTION 1. That the bid of IRA. E. ESCOBAR$ of El Segundo, California, dated August 30, 1950, which said Coun- cil determines to be substantially as follows, to wit: "IRA E. ESCOBAR E1 Segundo, California August 30, 1950 "Honorable City Council City of E1 Segundo E1 Segundo, Calif. Gentlemen: "The following is our bid on certain automobiles and equipment as appears in your notice to bidders at- tached hereto. Delivery is based on the manufacturer's ability to supply. "ITEM II: Two 1950 Four Six cylinder, 95 horse power one and one half (1) ton truck chassis with cabs. "Bid B. 158" Wh. B . .................. 31481.80 Less 10% Factory Price ....... 284.00 3,199.80 California Sales Tax .......... 95.93 Total 3131293.x75 "The City of E1 Segundo to furnish Excise tax ex- emption certificates on all bids. Escobar - 2 - C979 C O91i - 3 - 699 I and which said bid was submitted in response to and under the terms, conditions, provisions and requirements set forth in said "NOTICE INVITING BIDS ON MOTOR VEHICLES", be, and the same is hereby accepted as to Item No. 2 of said Notice Inviting Bids at the price set forth in Bid B of said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further par- ticulars. - 4 - 6 SECTION 2. The Contractor agrees, responsive to the preference of the City Council of said City as expressed in the notice inviting bids, pursuant to which this contract is made, that only American -made materials, and, so far as reasonably possible, California -made materials will be used in the work or improvement contemplated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 3. The Contractor, insofar as said Contractor is legally required so to do, must observe and abide by the pro- visions of all laws of the State of California and of the United States of America relating to contracts of the nature contem- plated herein, whether herein specifically mentioned or not. SECTION 4. That all bids received for said equipment are hereby rejected with the exception of the bid of IRA E. ESCOBAR, hereinabove referred to, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccess- ful bidders. SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the and thereof, after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing to said City two one and one -half (1Q) ton Ford Six cylinder truck chassis with cabs (as specified under Item No. 2 of said Notice to Bidders, hereinabove referred to), pursuant to the award hereinabove made; and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval - 5 - and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the seal of said City thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the origi- nal of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. ber, 1950.
