RESOLUTION NO. 1098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING A CERTAIN LEASE CONTRACT FOR THE FURNISHING TO SAID CITY OF CERTAIN AUTOMOTIVE EQUIPMENT TO CALIFORNIA RENT CAR. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids under notice to bidders en- titled "NOTICE INVITING BIDS ON MOTOR VEHICLES", dated August 9, 1950, which is now on file in the office of the City Clerk, open to public inspection, and hereby referred to and by this reference incorporated herein and made a part hereof, for fur- nishing said City with the items referred to in said notice; and WHEREAS, at the time for opening and considering said bids, to wit: the hour of 7:00 o'clock P. M, (California Day- light Saving Time) on Wednesday, the 30th day of August, 1950, said Council did publicly open, examine and declare the bid of CALIFORNIA RENT CAR, which was the only bid received on Item No. 4 of said Notice Inviting Bids; and WHEREAS, at said hour said Council did take said bid under advisement until the hour of 7 :00 o'clock P. M. (California Daylight Saving Time) on Wednesday, the 6th day of September, 1950, and referred said bid to the City Coordinator for check- ing; and WHEREAS, said City Coordinator has duly reported to this Council with reference to said bid and after consideration of such report, the City Council feels that the action herein- after taken is in the best interest of said City. NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: - 1 - w, SECTION 1. That the bid of CALIFORNIA RENT CAR, of Los Angeles, California, dated August 29, 1950, which said Coun- oil determines to be substantially as follows, to wit: *CALIFORNIA RENT CAR 507 South Flower Street Los Angeles 13, California Telephone: MIchigan 8886 August 29, 1950 "Mr. Victor McCarthy City Clerk E1 Segundo, California Dear Sir: "In agreement with the terms given in your public notice inviting bids on leased motor vehicles, I am pleased to submit the following: Four (4) New Fords, Fordors at $74.00 per month. Two (2) New 1i Ton Stake Trucks at $124.00 per month. Four (4) New, -J Ton Pick Ups at $74.00 per month. "Enclosed you will find Bidder's Bond which I am sure you will find adequate. "I am sure that should you elect to favor our bid by ac- ceptance, we would both enjoy a very satisfactory rela- tionship. "Very truly yours, CALIFORNIA RENT CAR /s/ Robert Hillman Robert Hillman RE:ar Eno. n� cl -12 be and the same is hereby accepted on the item therein set forth as "Four (4) New Fords, Fordors at $74.00 per month ", only, upon and under theterms and conditions set forth in said "NOTICE INVITING BIAS ON MOTOR VEHICLES ", dated August 9, 1950, all as con- templated in said notice and in said bid of said California Rent Car, and at the rental or charge of $74.00 per month for each such vehicle so furnished. The Lessor agrees, responsive to the pre- ference of the City Council of said City as expressed in the Notice to Bidders, pursuant to which this contract is made, that only American -made materials and, wherever possible, California - made materials will be used in the work or improvement contem- plated under this contract, all in conformity with the provisions of Sections 4300 to 4305, both inclusive, and Sections 4330 to 4334, both inclusive, of the Government Code of the State of California. SECTION 4. The Lessor, insofar as said Lessor is legally required so to do, must observe and abide by the pro- visions of all laws of the State of California and of the United States of America relating to contracts of the nature contemplated herein, whether herein specifically mentioned or not. SECTION 5. That the City Clerk shall prepare copies of this resolution after thepassage and adoption thereof, and shall affix to such copies at the end thereof, after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City; and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the lease agreement for the furnishing to said City of the new Ford Four Door Sedan type motor vehicles for the period of one year commencing November 1, 1950, and continuing thereafter until either party shall have given the other thirty days written notice of cancellation of lease, pursuant to the award hereinabove made; and the Mayor of the City of El Segundo is hereby authorized, on behalf of said City, to affix the approval and acceptance of said City to such lease agreement, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City and to affix the official seal of said City thereto. - 5 - SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the origi- nal of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
