A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, AP�'ARDING A CERTAIN
CONTRACT TO SIGNAL OIL COITANY FOR GASOLINE
FOR THE PERIOD OF CITE YEAR AND A SECOND CON-
TRACT TO CENTURY OIL CON,I'ANTY FOR CERTAIN
LUBRICANTS.
WHEREAS, the City Council of the City of E1 Segundo,
California, has heretofore in the manner provided by law, duly
and regularly advertised for bids under notice to bidders en-
titled "NOTICE TO BIDDERS ON GASOLINE, OIL, LUBRICANTS AND LIQSID
ASPHALTS, TO BE FURNISHED THE CITY OF EL SEGUNDO, CALIFORNIA. ",
dated May 17, 1950, which is now on file in the office of the
City Clerk, open to public inspection, and hereby referred to and
by this reference incorporated herein and made a part hereof, for
furnishing said City with the items referred to in said notice; and
WHEREAS, at the time for opening and considering all of
said bids, to wit: the hour of 7:15 o'clock P. M. (California
Daylight Saving Time) on Wednesday, the 14th day of June, 1950,
said Council did publicly open, examine and declare all bids re-
ceived; and
WHEREAS, at said hour said Council did take all of said
bids under advisement until the hour of 7:15 o'clock P. M. (Cali-
fornia Daylight Saving Time) on Wednesday, the 21st day of June,
1950, and referred said bids to the City Coordinator for study
and report; and
IP,MREAS, said last mentioned hour has now arrived, and
the City Coordinator has submitted a report to this Council, which
said Council determines to be substantially as follows:

"Subject: REPORT ON BIDS RECEIVED FOR GASOLINE, OIL, AND
LUBRICANTS FOR FISCAL. YEAR 1950 -51
"Pursuant to your instruction, I have checked the various
bids received Wednesday, July 14, 1950, for furnishing the
City's gasoline, oil, lubricants, and liquid asphalts re-
quirements for the period beginning July 1, 1950, and end-
ing June 30, 1951, and report with reference thereto as
follows:
"Union Oil Company of California submitted the lowest
bid on gasoline only, and its total bid, including gasoline,
oil, and lubricants, is the lowest. However, my investi-
gation discloses that the gasoline said company proposes to
furnish, to wit, 176 Gasoline ", will not meet City of E1
Segundo Specifications G.0.2 for furnishing gasoline, oil,
lubricants, etc., to the City of E1 Segundo.
"A sheet accompanying Union Oil Company's bid, titled
'Typical Test Values - 76 Gasoline', reveals that in four
particulars said gasoline will not conform to City of E1
Segundo specifications. Said company's quotations on oil,
lubricants, and liquid asphalts considered as a single unit
are higher than the next low bidder on these products alone.
"In view of the fact that the gasoline proposed to be
furnished by Union Oil Company of California does not con-
form to City of El Segundo specifications for gasoline and
that therefore its bid for this product is not responsive
to this City's call for bids on gasoline, it is my recom-
mendation that the contract for furnishing gasoline to the
City of E1 Segundo during the period July 1, 1950, to and
inclusive of June 30, 1951, at midnight be awarded Signal
Oil Company pursuant to its bid thereon, and that said Sig-
nal Oil Company's bid on lubricating oils, greases and all
other items be rejected.
"It is my further recommendation that the contract for
furnishing the City of El Segundo oils, lubricants and liquid
asphalts, as advertised for and as bid upon by Century Oil
Company, be awarded to said Century Oil Company, and that
that part of its bid with reference to furnishing gasoline to
the City of E1 Segundo during the hereinbefore mentioned per-
iod be rejected.
"It is my further recommendation that all bids of all
other bidders, to wit: Richfield Oil Corporation, Shell Oil
Company, Union Oil Company, and Tide Water Associated Oil
Company, be rejected.

City Coordinator , as hereinabove set forth, and has reached its
decision in the said matter;
NOVI, THEREFORE, the City Council of the City of El Segun-
do, California, does resolve, declare and determine as follows:
SECTION 1. That the bid of SIGNAL OIL COMPANY, of 811
W. 7th Street, Los Angeles, California, dated June 8, 1950, which
said Council determines to be substantially as follows, to wit:

ders attached hereto and further in accordance with Specifi-
cations G.O. -2 heretofore approved and adopted by the City
Council of said City and on file in the office of the City
Clerk of said City, as follows, towit:

any other State or Federal Tax IS NOT included in the amount
bid., except State Motor Vehicle Fuel Tax, which is included
in gasoline prices quoted.

"Bidder hereby states that prices, as above bid, exclude
Federal Excise taxes and California State Sales tax, but in-
clude California State Fuel tax and any and all other taxes
legally chargeable in connection with furnishing and deliver-
ing the products herein proposed.
"California State Sales tax is applicable and will be added
to the prices above quoted on all of the products to be fur-
nished, except gasoline.
"In the event, by due process of law, of the imposition of
additional taxes or an increase or decrease of present taxes
applicable to the products purchased hereunder, the prices
herein quoted payable by the City of El Segundo, including
maximum prices, will advance or decline in an equal amount.
"City of E1 Segundo to furnish Century Oil Company with neces-
sary exemption certificates covering Federal Excise taxes.
"Price of containers is not included in prices quoted on pro-
ducts to be delivered in drums. All drums not offered for
return in good useable condition within ninety days from date
of delivery will be charged for at rate of $4.00 for each full
drum, $3.00 for each half drum, $2.00 for each quarter drum.

SECTION 3. That all bids received on ITEMS NOS. 1 and
2 under said notice to bidders, with the exception of the said bid
of said SIGNAL OI'_ CO�,fPANY, and all bids received on ITEMS NOS. 30
49 5, 6, 70 81 91 100 11, 12 and 13 under said notice to bidders
with the exception of the said bid of said CENTURY OIL COMPANY, be
and the same are hereby rejected; and the City Ulerk is hereby
authorized and instructed to return the checks of all unsuccessful
bidders.
SECTION 4. That the City Clerk shall prepare copies of
this resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerk's Certifi-
cate, forms for the approval of the respective successful bidders
and on the part of the said City, and such copies of this resolu-
tion, so approved and accepted by such respective successful bid-
ders and by and on behalf of said City, shall constitute the
contracts for furnishing to said City all of the respective prod-
ucts mentioned in said bids, and which are to be furnished by such
respective successful bidders pursuant to the awards hereinabove
made.
SECTICN 5. That the Mayor of the City of E1 Segundo is
hereby authorized and directed to execute the contracts or agree-
ments between said City and said respective successful bidders;
and the City Clerk to attest the same; affix the City's seal there-
to and make delivery thereof in due course, as hereinabove awarded.

passage and adoption of this resolution; shall cause the original

of the same to be entered in the book of resolutions of the said
City of El Segundo; and shall make a minute of the passage and
adoption thereof in the records of the proceedings of the City
Council of said City in the minutes of the meeting at which the
same is passed and adopted.
