A P,ESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEG[NJO, CALIFORNIA, AWARDING TO C. 0.
SPARKS, INC. AND MUNDO ENGINEERING CO. A
CERTAIN CONTRACT FOR THE I!%TROVE1vT,NT OF MAIN
STREET, BETT'VEEN EL SEG'JZIDO BOULEVARD AND IM-
PERlU HIGHSAY, 74ZTHIN SAID CITY.
WHEREAS, the City Council of the City of El Segundo,
California, has heretofore in the manner provided by law, duly
and regularly advertised for bids under notice to bidders enti-
tled "NOTICE INVITING BIDS FOR THE ItITROVY,10ENT OF .AIN STREET
BET'• »EN EL SEGUNDO BOULEVARD AND I12ERIAL HIGHWAY ", dated May
19, 1950, which is now on file in the office of the City Clerk,
open to public inspection, and hereby referred to and by this ref-
erence incorporated herein and made a part hereof, for the improve-
ment of Main Street between El Segundo Boulevard and Imperial
Highway, within said City, by the construction of an Asphaltic
leveling course and resurfacing course and other appurtenant w rk;
and
WHEREAS, at the time for opening and considering all of
said bids, to wit: the hour of 7 :00 o'Clock P.M. (California
Daylight Saving Time) on Wednesday, the 14th day of June, 1950,
said Council did publicly open, examine and declare all bids re-
ceived; and
11,1MREAS, at said hour said Council did take all of said
bids under advisement until the hour of 7:00 o'clock P.M. (Cali-
fornia Daylight Saving Time) on Wednesday, the 21st day of June,
1950, and referred said bids to the City Coordinator, Public Works
Commissioner Peterson and Street Superintendent Gunn for study and
report; and

WHEREAS, said last mentioned hour has now arrived, and
the City Coordinator has submitted a report to this Council, which
said Council determines to be substantially as follows:

"Pursuant to assignment, I have checked all bids received
June 14, 1950, for the improvement of Main Street between
E1 Segundo Boulevard and the north City boundary, and find
that the bid of C. 0. Sparks, Inc., and Mundo Engineering
Company is the lowest bid received.
"Additional investigation discloses that C. 0. Sparks, Inc.,
and Mundo Engineering Company is a reputable firm, competent
and qualified to perform the work indicated in the City's
call for bids for the improvement of Main Street as aforesaid.
"I therefore recommend that the contract for the improvement
of Main Street between E1 Segundo Boulevard and the north
City boundary within the City of E1 Segundo be awarded said
C. 0. Sparks, Inc., and Mundo Engineering Company at the
prices named in its bid, and that the bids of all other bid-
ders for said work be rejected.
"I have discussed the award of this contract with Councilmen
Peterson and Street Superintendent Gunn, and each concurs in
my recommendation.

said City Coordinator, as hereinabove set forth, and has reached
its decision in the said matter;
NOW, THEREFORE, the City Council of the City of E1
Segundo, California, does resolve, declare and determine as fol-
lows:
SECTION 1. That the bid of C. 0. SPARKS, INC. & MUNDO
ENGINEERING COMPANY of 2727 East 17ashington Boulevard, Los Angeles

California, dated June 14, 1950, which said Council determines to
be substantially as follows, to wit:

"The undersigned further agrees that in case of default
in executing the required contract, with necessary bonds,
within ten (10) days, not including Sunday, after having re-
ceived notice that the contract is ready for signature, the
proceeds of the check or bond accompanying his bid shall be-
come the property of the City of E1 Segundo. It is under-
stood that this bid is based upon completing the work within
thirty (30) consecutive days (excluding Sundays and legal
holidays) from the date of execution of the contract.
"The undersigned, if awarded a contract for doing any of
the above work, intends to subcontract certain portions of
said contract in accordance with the following schedule:

be, and the same is hereby accepted at the prices set forth in
said bid, which is now on file in the office of the City Clerk of
said City, and which said bid so on file is hereby expressly re-
ferred to and by this reference incorporated herein and made a
part hereof for all further particulars.
SECTION 2. All of the above improvements are to be
made in accordance with PLAN NO. 500323 of the City of El Segun-
do, on file in the office of the City Clerk of said City, and
in accordance with "Specifications for Improvement of Main Street
between E1 Segundo Boulevard and the North City Boundary, City
of El Segundo, Los Angeles County, California, March 24, 1950 ".
SECTION 3. Said Contractor agrees that all work will
be done in accordance with the provisions of the "Labor Code"
of the State of California, and to pay not less than the general
prevailing rates of wages in the City of E1 Segundo, California
(the locality in which the said work or improvement is to be per-
formed) for each craft or type of workman or mechanic needed to

The Contractor, insofar as said contractor is legally requir-
ed so to do, must observe and abide by the provisions of all laws
of the State of California and of the United States of America
relating to contracts of the nature contemplated herein whether
herein specifically mentioned or not.
SECTTOY 4. Said Contractor agrees, responsive to the pref-
erence of the City Council of said City as expressed in the Notice
Inviting Bids, pursuant to which this contract is made, that only
American -made materials and California -made materials will be used
in the work or improvement contemplated under this contract, all
in conformity with the provisions of Sections 4300 to 4305, both
inclusive, and Sections 4330 to 4334, both inclusive, of the
Government Code of the State of California.
SECTION 5. That all bids received for said work or improve-
ment, with the exception of the said bid of C. 0. SPARKS, INC. AND
MUNDO ENGINEERING C01PANI', be and the same are hereby rejected; and
the City Clerk is hereby authorized and instructed to return the
checks of all unsuccessful bidders.

SECTION 6. That resident citizens of the City of El
Segundo, California, will, so far as reasonably possible be em-
ployed upon the work contemplated hereunder.
SECTION 7. That the City Clerk shall prepare copies o6'
this resolution after the passage and adoption thereof, and shall
affix to such copies at the end thereof, after the Clerk's Certifi-
cate, forms for the approval of the successful bidder and on the
part of the said City; and such copies of this resolution, so a3-
proved and accepted by the successful bidder and by and on behalf
of said City, shall constitute the contract for the improvement of
Main Street between E1 begundo Boulevard and Imperial Highway,
within said City, pursuant to the award hereinabove made; and the
Mayor of the City of E1 Segundo is hereby authorized, on behalf of
said Cite, to affix the approval and acceptance of said City to
such contract, and said City Clerk is hereby authorized and instruc-
ted to attest the same on behalf of said City and to affix tho of-
ficial seal of said City thereto.
SECTION 8. That the City Clerk shall certify to the pas-
sage and adoption of this resolution; shall cause the original of
the same to be entered in the book of resolutions of the said City
of El Segundo, and shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council of
said City, in the minutes of the meeting at which the same is p assn
and adopted.
