CC RESOLUTION 1061r- RESOLUTION OF INTENTION NO. 1061 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA DECLARING ITS INTENTION TO ORDER CON- STRUCTION OF CERTAIN STREET I11PR04EMENTS IN INDIANA STREET IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID W= AND TO PAY THE COSTS AND EXPENSES, AND FIXING A TIME AND PIACE FOR HEARD} OBJECTIONS TO SAID WORK at e• �t * a• at The City Council of the City of El Segundo, pursuant to the provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows= WHEREAS, the City Council of the City of E1 Segundo has heretofore received a petition from property owners for the improve- ments hereinafter described, and the said petition having been sub- mitted to the Title Insurance and Trust Company of Los Angeles for examination and report as to the sufficiency of the signatures thereof; and WHEREAS, the said Title Company under date of August 12, 1949 reported that from an examination of the petition, pursuant to their records, they found and determined that the said petition showed that the record owners of more than sixty per cent (60%) in area of the property within the proposed assessment district, as shown on the map attached to the petition, had signed said petition for the said proposed improvements; SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of E1 Segundo, California, to order the following work to be done, to -wit: DESCRIPTION OF WORK The grading and paving with plant mix surfacing, together with header boards support, and appurtenant work in - 1 - r- '7- INDIANA STREET between the center line of Grand Avenue and the Northerly lines of Lots 375 and 388, Block 123, E1 Segundo, Sheet No. 8, as per Map recorded in Map Book 22, Pages 106 and 107, Records of Los Angeles County, California. PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. All of the said work and improvement to be done shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner sham on the plans, profiles and drawings for the construction of said improvements in a portion of Indiana Street, being Plan No. 500118, on file in the office of the City Engineer of said City, and except as otherwise provided on said plans in further accordance with the specifications for the construction of said improvements, said specifications being on file in the office of the City Clerk of said City, and to which plans, profiles, drawings and specifications here- tofore approved by the City Council of said City, reference is hereby made for a further, fall and more particular description of the said work and by reference thereto, the same are incorporated herein and made a part hereof. SECTION 3. The grades to which the said work shall be done and improvements made are those shown on the plans, profiles and cross -sections herein referred to. Attention is hereby called to the fact that, in many cases, the work of grading will bring the surface of the improved street to a grade different from the surface of such street as it now exists. The plans, profiles and cross - sections herein referred to were all approved by the City Council of the City of E1 Segundo, California, on the 8th day of February, 1950, and reference is hereby made to said plans, profiles and cross - sections for a description of the grades to which said work is to be done and improvement made. -2- DESCRIPTION OF ASSESSMENT DISTRICT SECTION 4. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or ordin- ary public benefit, and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as followst All that certain territory of the City of E1 Segundo, California, exclusive of streets and alleys, included within the exterior boundary line shout upon that certain Map or Plat No. 500118 heretofore approved by the City Council of said City on the 8th day of February, 1950 indicating by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Engineer of said City. Reference is hereby made to said map or plat for a further, full and more particular description of said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. DESCRIPTION OF BONDS SECTION 5. That serial bonds, bearing interest at the rate of six per cent (6%) per annum, shall be issued to represent each assess- ment of Twenty -five Dollars ($25.00) or more, remaining unpaid for thirty (30) days after the date of recording the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October fifteenth following their date. Payments on the principal of unpaid assessments and interest thereon shall be made by property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in the "Improvement Act of 1911" hereinafter referred too THE AND PUCE OF HEARING SECTION 6, NOTICE IS HEREBY GIVEN that on the 22nd day of March, 1950, at the hour of seven o'clock (7 :00) P.M., in the Council — 3 — chamber of the City Council in the City Hall of said City of E1 Segundo, any and all persons having any objections to the proposed Rork or improvement or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. tr•��s,a� SECTION 7. That all of the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California, designated the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 8. The "El Segundo Herald ", a weekly newspaper, published and of general circulation in the City of E1 Segundo, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other public- ations in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last Equalized assessment roll for city taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Code. POSTING OF NOTICE OF IWROVEMEKT SECTION 9. The Superintendent of Streets of the City of E1 Segundo shall cause to be conspicuously posted along the line of said contemplated work or improvement, and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code. - 4 - SECTION 10. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
