CC RESOLUTION 1058RESOLUTION N0. 1058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO HONGOI.A & IffJ OTT CONSTRUCTION COMPANY A CERTAIN CONTRACT FOR THE CONSTRUCTION OF A REINFORCED CONCRETE RESERVOIR, PUMP HOUSE, PIPE LINES, ELECTRICAL AND MECHANICAL EQUIPMENT AND MISCELLANEOUS APPURTENANCES IN AND FOR SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, did heretofore invite bids for the improvement hereinafter referred to under a notice en- titled "Notice Inviting Bids for the Construction of a Re- inforced Concrete Reservoir, Pump House, Pipe Lines, Electrical and Mechanical Equipment and Miscellaneous Appur- tenances.", dated the 8th day of December, 1949; and WHEREAS, pursuant to said notice, various bidders submitted bids for said improvement; and WHEREAS, the said City Council did duly and regularly take all bids submitted under advisement until the 25th day of January, 1950, and did thereupon take said bids under further advisement until the 1st day of February, 1950, and did refer said bids to the City Engineer and Consulting Engineer for checking, analysis, report and recommendation thereon to said Council; and WEDIMEAS, said Council has now received the written report from said City Engineer and said Consulting Engineer -1- in words and figures as follows: Engineering Offices of LIPPINCOTT AND ROWE 4826 Orinda Avenue, Zone 43 Los Angeles February 1st, 1950 "The Honorable City Council City of E1 Segundo E1 Segundo, California "Gentlemen: "On January 18, 1950 your Honorable Body received and opened bids under Specifications No. W.B. -48 -4 for *The Construction of a Reinforced Concrete Reservoir, Pump House, Pipe Lines, Electrical and Mechanical Equipment and Miscellaneous Appurtenances.' "After opening the bids you referred same to the undersigned for analysis and report with recommendations at your regular meeting on Tanuary 25, 1950. "At your meeting on January 25, 1950 we requested an additional week to complete our analysis and report. Our investigations have now been completed and we submit the following report. "Ten bids were received under this call as shown by the accompany- ing tabulation. All of the bids received were regular in that they contained no qualifications and were accompanied by the re- quired checks. The bid prices ranged from a low of $1389000.00 to a high of $173,145.00. The low bid was submitted by T. S. Burrell and Sons of Long Beach, California in the amount of $138,000.00 with completion in 150 days. In investigating the qualifications of J. E. Burrell and Sons we found that at the time they submitted their bid they did not have the type of contractor's license re- quired by State Law for the construction of work of the character required by these specifications. We immediately contacted your City Attorney, Mr. Clyde Woodworth, and acquainted him with this fact and also had Mr. Jack Burrell of Burrell and Sons contact him. Mr. Woodworth, after looking into the matter, advised us that due to the fact that J. E. Burrell and Sons did not have the type of contractor's license required by laws of the State of California at the time they submitted their proposal it was a questionable bid and if the City should enter into contract with them the work might be delayed and serious legal difficulties might result to the City. We were later advised by Burrell and Sons that after conversation with their own attorney and with Mr. Woodworth that they were convinced that if they entered into a contract with the City under the above cited conditions legal difficulties might ensue which would result in embarrassment and delays to themselves as well as to the City. From our discussion with the Burrell brothers we are convinced that their submitting a questionable bid was unintentional on their part. "The second low bid was submitted by Hougola and Elliot of Norwalk, California, in the amount of $141,914.00 with completion in 180 days. We have investigated the qualifications of this firm and are satisfied that they can satisfactorily construct and complete this work. -2- "In view of the above we recommend that the bid of J. E. Burrell and Sons be rejected and that the certified check accompanying their bid be returned to them and we also recommend that the contract under these specifications be awarded to Hongola and Elliot at the price bid and under the conditions set forth in their proposal. SECTION 1. Said Council does hereby find and determine that the bid of the apparently low bidder, d. E. BURRELL & SONS, in the sum of $138,000.00, for said improvement is an irregular bid in this, that said bidder did not, at the time of submitting said bid, hold or possess a type of California Contractor's License Classification required under the laws of said State by contractors upon public works of the nature contemplated in said -4- x. s REGULAR ALTERNATE BIDDER & BID COMPL. BURRELL & SONS, in the sum of $138,000.00, for said improvement is an irregular bid in this, that said bidder did not, at the time of submitting said bid, hold or possess a type of California Contractor's License Classification required under the laws of said State by contractors upon public works of the nature contemplated in said -4- x. s `b improvement; and that if an award were made to such bidder, the potential possibilities of delay, uncertainty, expense and litigation due to possible disciplinary action on the part of the Contractors' State License Board of the Department of Pro- fessional and Vocational Standards of the State of California are imminent. SECTION 2. Said Council, under the circumstances, does hereby find, determine and declare that the bid of HONGOLA & ELLIOTT CONSTRUCTION COMPANY, in the sum of $141,914.00, for said improvement is the lowest regular responsible bid submitted for said improvement. Said bid of said Hongola & Elliott Construction Company is now on file in the office of the City Clerk of said City, is open to public inspection, and is hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 3. That said Council does hereby reject the bids of all bidders on or for said improvement, excepting the said bid of said Hongola & Elliott Construction Company, which said bid said Council hereby accepts, and said Council does hereby award the contract for said improvement to said Hongola &'Elliott Construction Company at the price therefor set forth in its said bid on file, to -wit: $1412914.00, and does hereby authorize the Mayor and City Clerk of said City to execute and deliver such contract in form as approved by the City Attorney in due course. SECTION 4, That the City Clerk be and he is hereby authorized to return the bid checks or deposits of all un- successful bidders. SECTION 5. That this resolution shall take effect immediately. SECTION g. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the -5- mane in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same was passed and adopted.
