CC RESOLUTION 1042RESOLUTION OF INTENTION N0. 1042 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CONSTRUCTION OF STREET IMPROVEMENTS IN WHITING STREET AND ALLEYS IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EX- PENSES, AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of E1 Segundo, pursuant to the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows- WHEREAS) the City Council of the City of E1 Segundo has heretofore received a petition from property owners for the im- provements hereinafter described, and the said petition having been submitted to the Title Insurance & Trust Company of Los Angeles for examination and report as to the sufficiency of the signatures thereof; and WHEREAS the said Title Company under date of April 11, 1949, reported that from an examination of the petition, pursuant to their records, they found and determined that said petition showed that the record owners of more than sixty percent (60%) in area of the property within the proposed assessment district as shown on the plat attached to the petition, had signed said petition for the said proposed improvements SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of El Segundo, California, to order the following work to be done, to wit: OF WORK First: The grading, paving with plant mix material, construction of cement concrete curbs and sidewalks, and appurtenant work in connection therewith, in WHITING STREET -1- f between Franklin Avenue and El Segundo Boulevard except where the plan shows that certain existing surfacing is to remain, as shown on Sheet No. 1 of the plans hereinafter referred to. Second. The grading, paving with plant mix material, construction of cement concrete curb and sidewalk return, and appurtenant work in connection therewith, in EL SEGUNDO BOULEVARD between the Southerly prolongation of the Westerly line of Whiting Street, and a line parallel therewith and distant 80 feet Easterly therefrom. Third: The grading, paving with plant mix material, and appurtenant work in connection therewith, in the ALLEY running North and South through Block 15, El Segundo, Sheet No. 1, and the Southerly prolongation of said alley to the South line of the alley running East and West through said Block 15. Fourth: The construction of a 12 -inch corrugated metal pipe storm drain, together with cement concrete catch basin and headwall in said ALLEYS between the Westerly prolongation of the Northerly line of Lot 17 of said Block 15 and a point distant 40 feet Westerly from the 'Wester- ly line of said Whiting Street, as shown on Sheet No. 2 of said plans 'DTANS, PROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. All of the said work and improvement to be done, shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said im- provements in Eucalyptus Drive and easement, being Drawing No. D -61 consisting of 2 sheets, on file in the office of the City Clerk of said City, and except as otherwise provided on said plans in further y2 accordance with the specifications for the construction of said im- provements, said specifications being on file in the office of the City Clerk of said City, and to which plans, profiles, drawings and specifications heretofore approved by the City Council of said City, reference is hereby made for a further, full and more particular des- cription of said work, and by reference thereto the same are incor- porated herein and made a part hereof. GRADES SECTION 3. The grades to which the said work shall be done and improvements made are those shown on the plans, profiles and cross - sections herein referred to. Attention is hereby called to the fact that in many cases, the work of grading will bring the surface of the improved street to a grade different from the surface of such street as it now exists. The plans, profiles and cross - sections herein referred to were all approved by the City Council of said City of El Segundo, California, on.the 9th day of November, 1949, and reference is hereby made to the said plans, profiles and cross- sections for the description of the grades to which said work is to be done and improvement made. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 4. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as follows: ?11 that certain territory of the City of El Segundo, ex- clusive of streets and alleys, included within the exterior boundary line described as follows. - 3- Beginning at the intersection of the center line of Franklin Avenue with the center line of Loma Vista Street; thence Easterly along the center line of Franklin Avenue to the center line of Whiting Street; thence Southerly along the center line of Whiting Street to the Westerly prolongation of the Northerly line of Lot 5, Block 14, of E1 Segundo, Sheet No. 1, as per map thereof recorded in Map Book 18, page 69, records of Los Angeles County, California; thence Easterly along said prolongation and along the Northerly line of said Lot 5 and Easterly prolongation thereof to the Northerly prolongation of the Easterly line of Lot 11 of said Block 14; thence Southerly in a direct line to the Northeast corner of said Lot 11; thence Southerly along the Easterly line of said Lot 11 and the Southerly prolongation thereof to the Southerly line of E1 Segundo Boulevard; thence Westerly along said Southerly line to the Southerly prolongation of the 'lesterly line of Lot 12, Block 15, of said E1 Segundo Sheet No 1; thence Northerly in a direct line to the Northwest corner of said Lot 12, thence Westerly along the Northerly lines of Lots 11, 10 and 9 of said Block 15 and the Westerly prolongation thereof to the center line of Loma Vista Street, thence Northerly along said center line to the point of beginning A map or plat indicating by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Clerk of said City, is attached to and forms a part of the petit!on for said im- provements herein referred to. Reference is hereby made to said map or plat for a further, full and more particular description of said assessment district, and the said map or plat so on file shall govern for all details as to the extent of said assessment district DESCRIPTION OF BONDS SECTION 5 That serial bonds, bearing interest at the rate of six per cent (6 %) per annum, shall be issued to represent each assessment of Twenty -five Dollars ($?5 00) or more remaining unpaid -4- for thirty (30) days after the date of the warrant. Snid serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October fifteenth following their date. Payments on the principal of unpaid assess- ments and interest thereon shall be made by property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in the "Improvement Act of 1911," hereinafter referred to. TIME AND PLACE OF HEARING SECTION 6. NOTICE IS HEREBY GIVEN, that on the 7th day of December, 1949, at the hour of seven o'clock (7:00) P. M., in the In Council Chamber of the City Council,/the City Hall of said City of El Segundo, any and all persons having any objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of In- tention Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 7 That all of the work herein proposed shall be done and carried through in pursuance of an act of the Legislature of the State of California, designated the "Improvement Act of 1911, being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 9• The "E1 Segundo Herald," a weekly newspaper published and of general circulation in the City of E1 Segundo, Calif- ornia, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Intention -5- The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, all in the manner and form provided for under Sections 5070, 5194, and 5195 of the said "Improvement Act of 1911," of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT SECTION 9. The Superintendent of Streets of the City of E1 Segundo shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code. SECTION 10. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
