CC RESOLUTION 10415-R RESOLUTION NO. 1041 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, IN THE MATTER OF THE PROPOSED GRADING, PAVING, CONSTRUCTION OF CEMENT CONCRETE CURBS AND SIDEWALKS IN A PORTION OF WHITING STREET, ALSO, THE GRADING AND PAVING OF ALLEY IN BLOCK 15 OF EL SEGUNDO, SHEET NO. 1, ALL WITHIN SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, having heretofore received a petition from property owners for the grading, of the alley running North and South through Block 15 of E1 Segundo, Sheet No. 1, as per map thereof recorded in Map Book 18, Page 69, records of Los Angeles County, together with a plat or map showing the exterior boundaries of the proposed assessment district for said improvement; and WHEREAS , the City Engineer has reported to this City Council that, pursuant to the verified report of the Title Insurance & Trust Company, the said petition represents 73.326% of the area of the property subject to assessment of the proposed assessment district, as shown and delineated upon such map or plat attached to said petition, and WHEREAS, the said City Council has duly considered the said Lition and report of the City Engineer with reference to the proposed improve- ments referred to and the said petition, NOW, THEREFCRE, the City Council of the City of E1 Segundo, California, does hereby resolve, declare, determine, find and order as follows: SECTION 1. That the improvement, referred to in said petition, is for the grading, paving, construction of cement concrete curbs and sidewalks in that portion of Whiting Street, lying between Franklin Avenue and El Segundo Boulevard, also, the grading and paving of the alley running North and South through Block 15 of E1 Segundo, Sheet No. 1, SECTION 2. That this City Council does hereby find and determine that the signatures of the record owners to the petition represent all of the - 1 - y construction of cement concrete curbs and sidewalks in Whiting Street wing, ween Franklin Avenue and E1 Segundo Boulevard, also, the grading and paving of the alley running North and South through Block 15 of E1 Segundo, Sheet No. 1, as per map thereof recorded in Map Book 18, Page 69, records of Los Angeles County, together with a plat or map showing the exterior boundaries of the proposed assessment district for said improvement; and WHEREAS , the City Engineer has reported to this City Council that, pursuant to the verified report of the Title Insurance & Trust Company, the said petition represents 73.326% of the area of the property subject to assessment of the proposed assessment district, as shown and delineated upon such map or plat attached to said petition, and WHEREAS, the said City Council has duly considered the said Lition and report of the City Engineer with reference to the proposed improve- ments referred to and the said petition, NOW, THEREFCRE, the City Council of the City of E1 Segundo, California, does hereby resolve, declare, determine, find and order as follows: SECTION 1. That the improvement, referred to in said petition, is for the grading, paving, construction of cement concrete curbs and sidewalks in that portion of Whiting Street, lying between Franklin Avenue and El Segundo Boulevard, also, the grading and paving of the alley running North and South through Block 15 of E1 Segundo, Sheet No. 1, SECTION 2. That this City Council does hereby find and determine that the signatures of the record owners to the petition represent all of the - 1 - y 41 + owners of more than sixty per cent (60%) in area of the property subject to assessment for said proposed improvement within the proposed assessment district, as shown and delineated upon the plat or map attached to said petition. SECTION 3. That this City Council does hereby further find and determine that the said petition for said improvement represents all the requi ments prescribed by Section 2804 of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Division 4 of the Streets and Highways Code of the State of California, and the City Council in adopting this resolution intends to meet each and every condition and to make each and every finding necessary on its part in order to permit the proceedings for said improvements to go forward to completion without further reference to or application of the provisions of said Division 4 of said Streets and Highways Code. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
