CC RESOLUTION 1022._ A RESOLUTION NO. 1022. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CALLING, ORDERING AND PROVIDING FOR, AND GIVING NOTICE OF, A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 8TH DAY OF NOVEMBER, 1949, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A CERTAIN INITIATIVE ORDINANCE, PROPOSITION OR MEASURE THEREIN REFERRED TO; AND CONSOLIDATING SAID SPECIAL MUNICIPAL ELECTION IA71THIN SAID CITY WITH THE CONSOLIDATED SPECIAL ELECTION TO BE HELD IN THE STATE OF CALIFORNIA ON SAID DATE. WHEREAS, the City Council of the City of El Segundo, California, is authorized under the provisions of Section 1719, as amended, of the Elections Code of the State of California, to submit to the voters of said City, without a petition there- for, a proposition for the enactment of the new ordinance hereinafter referred to, to be voted upon at any succeeding regular or special City election; AND, WHEREAS, said Council, after due consideration, feels that it should exercise its said authority and should, on its own motion, submit to the voters of said City, a proposition for the enactment of said new ordinance hereinafter referred to; NOIN, THEREFORE, the City Council of the City of El Segundo, California, does resolve, declare, determine and order as follows: SECTION 1. That a Special Municipal Election shall be held, and the same is hereby called and ordered to be held, -1- in the City of E1 Segundo, County of Los Angeles, State of California, on the 8th day of November, 1949, for the purpose of submitting to the qualified voters of said City a certain proposition or question for the enactment of a certain new initiative ordinance of said City, which said new ordinance is designated and numbered as "Ordinance No. 360 ", and is hereinafter set forth in full in Section 2 of this resolution. SECTION 2. That the said new initiative Ordinance No. 360, hereinabove referred to, and which is to be so sub- mitted to said voters for enactment, is the following ordi- nance, to -wit: " ORDINANCE NO. 360 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROHIBITING DOGS FROM BEING OR RUNNING AT LARGE WITHIN SAID CITY, EXCEPT ON LEASH. The people of the City of El Segundo, California, do ordain as follows: SECTION 1. That notwithstanding any provision or provisions of any other ordinance or ordinances of the City of E1 Segundo, California, no person owning or having charge, custody, possession or control of any dog shall (and it shall be unlawful for any person to) cause, permit or allow the same to be, or run at large in or upon any highway, street, lane, alley, court, or other public place, or in or upon any private property or premises other than those of the person owning or having charge, custody, possession or control of such dog within the City of E1 Segundo, California, unless such dog be restrained by a substantial leash not to exceed six feet in length and is in charge, custody, possession or control of a competent person. -2- �r - SECTION 2. Any person violating any of the pro- visions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed Three Hundred Dollars ($300.00), or by imprisonment in the City Jail of the City of E1 Segundo, California, or in the County Jail of the County of Los Angeles, California, as the committing magistrate may direct, for a period of not to exceed three (3) months, or by both such fine and imprisonment in the discretion of the Court. SECTION 3. That the Mayor of said City shall sign this ordinance and the City Clerk shall attest the same. Said City Clerk shall further certify to the passage and adoption thereof by the electors of said municipal cor- poration; shall enter the same in the book of original ordinances of said City; shall make a minute of such passage and adoption thereof by the electors of said City, in the official records of the proceedings of the City Council of said City; and shall, after such adop- tion, cause this ordinance to be published once in the El Segundo Herald, a weekly newspaper of general circula- tion, published and circulated within said City and which is hereby designated for that purpose. SECTION 4. That as provided in Section 1715 of the Elections Code of the State of California, as amended, if a majority of the voters voting on this ordinance vote in its favor, this ordinance shall become a valid and binding ordinance of the City of E1 Segundo, and shall be con- sidered as adopted upon the date that the vote thereon is declared by the Board of Supervisors of Los Angeles County, California (the Canvassing Board for said election), and shall go into effect ten (10) days thereafter. -3- Passed, approved and adopted by the people of the City of El Segundo, California, at the Consolidated Special Municipal Election held in said City on Tuesday, the 8th day of November, 1949. That for the purpose of submitting the en- actment of said Ordinance No. 360 hereinabove referred to, there shall appear upon the ballots to be used at said election, in addition to any other matters required by law to appear thereon, the following question, proposition or measure, to -wit: ft : Shall Ordinance No. 360, entitled: : YES : : 'AN ORDINANCE OF THE CITY OF EL SEGUNDO, : : CALIFORNIA, PROHIBITING DOGS FROM BEING OR RUNNING AT LARGE WITHIN SAID CITY, , EXCEPT ON LEASH.', be adopted and become NO . effective? n SECTION 4. That the Special Municipal Election hereby called and ordered to be held shall be and it is hereby ordered consolidated with the Consolidated Special Election to be held in the State of California on the 8th day of November, 1949, and such elections shall be held within said City of El Segundo in all respects as if there were only one election, and only one ticket or ballot shall be used thereat. The precincts, polling places, and officers of election for this Special Municipal Election shall be the same as those provided for said state Consolidated Special Election, as fixed, designated, named and -4- established by the Board of Supervisors of Los Angeles County, California, and the polls at said election shall be opened at the same time and closed at the same time on said day of said election as the polls for said state Consolidated Special Election. SECTION 5. In accordance with the provisions of Section 10054 of the Elections Code of the State of California, the City Council of the City of E1 Segundo, California, hereby authorizes the Board of Supervisors of Los Angeles County, California, to canvass the returns of the Special Municipal Election hereby called, and which is consolidated, as aforesaid, with said state Consolidated Special Election. SECTION 6. That the City of E1 Segundo shall, and does hereby agree to, pay to the County of Los Angeles, upon receipt of statement therefor, the just and lawful portion or share of the City of El Segundo of the costs and expenses for and incident to the holding of said Consolidated Municipal and State Election within said City. SECTION 7. That in all particulars not recited in this resolution, said Special Municipal Election, so consolidated, shall be held and conducted as provided by law for holding munici- pal elections in said City. SECTION 8. That the City Clerk of said City is hereby authorized and instructed to make any and all arrangements and to attend to any details which may be necessary in conjunction with the Registrar of Voters of Los Angeles County to properly and lawfully conduct said Special Municipal Election, so con- solidated, within said City. SECTION 9. That the City Clerk be and he is hereby authorized and instructed to give notice of said Special Munici- pal Election in time, form and manner as required by law, and to procure any and all supplies, materials, printed matter and equipment which may be necessary or convenient on the part of -5- said City in order to properly and lawfully conduct said Special Municipal Election, consolidated as aforesaid. SECTION 10. That this resolution shall take effect immediately. SECTION 11. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of the City Council of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, and shall cause said resolution to be published once a week for two weeks, not earlier than the sixtieth (60th) nor later than the thirty -first (31st) day before said Sth day of November, 1949, the day of said election, in the E1 Segundo Herald.
