CC RESOLUTION 1007Q1'Jr RESOLUTION NO. 1007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,ESTABLISHING CERTAIN RULES AND REGULATIONS WITH REFERENCE TO THE SERVICE OF WATER FROM THE MUNICIPAL WATERWORKS SYSTEM OF SAID CITY; FIXING A SCHEDULE OF RATES TO BE CHARGED IN CONNECTION WITH SUCH SERVICE; AND REPEALING RESOLUTIO1 NO. 340 AS AMENDED, AND ALL OTHER RESOLUTIONS AND PARTS OF RESOLUTIONS, IN CONFLICT THEREWITH. The City Council of the City of E1 Segundo, California, does hereby resolve, declare, determine and order as follows: SECTION 1. That on end after the 25th day of June, 1949s and until the further order of the City Council of said City, the rules, regulations and rates hereinafter set forth in this resolution, shall be, and the sane are hereby fixed, adopted and established, as the rules, re- gulations and rates for and governing the service of water from the water works system of the said City of E1 Segundo; and such service shall be rendered subject to each and all of said rules, regulations and rates, and in conformity therewith. SECTION 2. INSTALLATION OF SERVICE (METER INSTALLATION COST): (A) Application for Service: Before service is delivered a written application therefor on a blank furnished by the Water Department of the City of E1 Segundo, must be signed by the person desiring such service, 1- are-. giving in addition to such information as the said department may require, his status as owner, agent or tenant. (B) Deposit: If service is to be delivered to other than a bona fide owner of the property, a cash deposit must be made sufficient to cover twice the department's estimate of the average monthly bill for such service, and in no case shall such deposit be for less than $3.50. Said deposit shall be refunded on demand after the expiration of twelve months from the making thereof, pro- vided no part thereof has been used in payment of water bills incurred by such service. Said deposit will be refunded at any time if service is discontinued and all bills for water furnished such service are paid. (C) Temporary Service: Connection for temporary use will be made upon a deposit eqa al to the department's estimate of the total cost of labor, materials and overhead necessary to male the installation. This amount shall remain on deposit with the Water Department until the termination of such use, during which time regular rates will be charged for water used, when the deposit will be returned to the depositor, less 10% per year deprecia tion on material and labor, etc., cost. SECTION 3. REFUNDS IN CERTAIN CASES: In the event any deposit shall have been made for the installation of any service as bereinabove in Section 2 set forth, and for any reason the installation of 2- the meter and service for which such deposit was deposited is not made, the City Council, in its discretion, in such cases may order refund of such deposit at any time; pro- vided, however, that such refund shall be made at any time aster the expiration of two years from the date such deposit was made, on request of the depositor, in cases cahere such installation has not been made. SECTION 4. METER INSTALLATION COSTS: All meters installed shall be and remain the property of the City of E1 Segundo and the following installation costs sn d charges are hereby fixed and established for the various meters hereinafter mentioned, to wit: (A) For a 3/4" service with 5/8" meter - - - $35.00; it n 1 it n it 1" It - - - 55.00; " n 1; n " rr 12u n _ _ _ 100.00; and It It 2 It " It 2" It - - - 150.00. (B) over 2" meter, the charge to be based upon cost of meter, materials, labor including excavation and repaving, plus 7% of said cost for adminis- tration and incidentals, and the total of such cost must be borne In d paid by applicant. The meter will b e supplied and installed by the City of E1 Segundo Water Department at such time as the applicant pays sai d department an amount e q 91 to the estimated cost of said installation as determin- ed by the Water Superintendent. SECTION 5. METER SIZE FOR SINGLE OR MULTIPLE UNITS ON SINGLE METER: (A) Two or more units may be connected to one meter provided, however, that all units are on the same premises and that only one address shall be re- cognized for billing and collecting purposes; 3- (B) The minimum size of meter to be installed shall be determined by the number of fixture units according to section 1313 of the Uniform Plumbing Code of the said City of El Segundo; (C) The total number of fixture units shall be computed by the Building Department at the time a plumbing perm -t is issued and the applicant is hereby re- quired to submit such computation to the Water Department with his application for water service; (D) The monthly minimum charges and method of billing recommended by the Water Super be applied to existing meters; with the size of such existing accordance with what that size by the total number of fixture (E) No change shall be made in the meters unless such changes are for by the owner or applicant. (2) For water used in excess of first 500 cubic feet per month: First 3500 cubic feet @ :0.10 per 100 cubic feet or major fraction thereof; Next 16,000 cubic feet @ X0.09 per 100 cubic feet or major fraction thereof; Next 50,000 cubic feet @ $0.0825 per 100 cubic feet or major fraction thereof; Next 60,000 cubic feet @ ?$0.0675 per 100 cubic feet or major fraction thereof; and All water used in excess of 13),000 cubic feet @ $0.06 per 100 cubic feet or major fraction thereof. (3) CONSTRUCTION RATES: (A) All water used on construction jobs, other than pipe line trenchin,2, will be metered and the cost will be the same as that set forth under t1(1) General Rates" above, except that a return- able deposit of 4,$100.00 for each meter must be made upon application for sane, which deposit shall secure the payment to said city of any damage suffered and of charges fm water served and which bas not otber%FI se bean paid. (B) The rates for flooding pipe line trenches are hereby fixed and established as follows: (a) For first 100 lineal feet or less of pipe trench less than six Peet in depth $1.00, plus 1¢ pa r lined. foot over 100. (b) For first 100 lineal feet or less of pipe trench six feet or more in depth 42.00, plus 2¢ per lineti foot over 100. l4) AUTOMATIC FIRE SPRINKLERS, FIRE HYDRANTS, AND SEVER MANHOLE FLUSH TANKS rates shall be and the same are hereby established as follows: (a) City Sewer Manhole FluEh Tanks, Automatic, per tank - ,;,1.00 per month; (b) Automatic Sprinkler ystem - 211 - - gg1.00 per month; ,t n n _ 3" - - 1.50 n it e It it rr _ 4" - - 2.00 tt n It "n n - 611 - - 4.00 It It g" ,. - 6.00 n " -10" - - 8.00 " n " -12" - - 11.00 „ n the monthly rates herein specified are to be applied to each such automatic sprinkler system. All services on any premises, whether used or not, dial be considered as used and shall be charged for, so long as the same remain connected. SECTION S. DELINQUENCIES: Bills become de- linquent fifteen days after presentation, and if not paid the water may be shut off without further notice. SECTION 9. No allowance or rebate shall be made in water rates charged against any property or premises so long as the water remains connected therewith, and full rates shall be charged against any and all property or premises as hereinbefore specified until the Water Department ha-. been notified in writing to shut off or disconnect the water therefrom. Any complaint in regard to the rating of property must be made at the office of the ~"dater Department and the Adjustor will properly rate the premises. Collect- ors shall not make rebates or adjust rates. SECTION 10. All water rates shall be charged against the property on which it is furnished and against the owner thereof, and if for any cazse any sums owing therefor become delinquent, the water shall be out off, and in no case shall It be turned on to the same property until all, such delin- quencies shall have been paid in full. No change in owner- ship or occupancy shall of 'ect the application of this section. SECTION 11. An-, damage to meters resulting from carelessness, wilfulness or neglect, or any of them, as well as any damage which may resilt from hot water or stean from boiler, or otherwise, shall be paid for to said ',Mater Department on presentation of bill and in case such bill is not laid the water may be shut off from said premises without further notice and not turned on until al 1 charges are paid, 6- SECTION 12. On f allure to comply with the rules and regulations established as a condition to the use of water, or to pay rates or meter rent, or any charge or penalty imposed, in the time and manner as herein provided, the water may be shut off until payment of the amount due is made, with one dollar ($1.00) in addition for expense of turning water off and on. SECTION 13. Should the owner or occupant of any premises turn on the water or suffer or cause it to be turned on, or cause the disconnected premises to be connected either directly or indirectly with the municipal waterworks system or water supply, after it has been shut off at the curb cock, it shall be shut off at the main,, aid a charge of p5.00 will be made by the said City for the turning off and turning on, which must be paid before the premises will be again connected to the municipal system. It is further provided that if any owner, occupant or tenant of any pre- mises connected to the municipal waterworks system,either directly or indirectly connects or permits the connection of such premises, or water service, with that of any owner, tenant, occupant or consumer, of any other premises whose water has been turned off by the Water Department.. that then and in that event the service through which such disconnected premises is served may likewise be turned off on 24 hours notice to the owner, occupant, tenant or consumer of such premises or service, and same shall not be again connected unless and until a penalty of $5.00 shall have been paid to said City. SECTION 14. That all services applied for, or installed, on and after the 25th day of June, 1949, and until the further order of the City Council, (excepting only such services as the Water Superintendent of said City shall 7- OyfG class as emergency or temporary services, and to which a flat rate to be determined by nim shall apply) shall be metered; provided, however, that nothing herein contained shall be construed as requiring more than one metered service to a hotel or apartment house where the halls and reception rooms are used in common by allfamilies occupying the same; nor as requiring more than one metered service to any store or office building for services to the respective stores or offices actually contained in and made a part of such store or office building; nor as requiring the immediate dis- continuance of existing services where single family units are served through a single present connection, but whenever in the future any such existing services are discontinued, or abandoned, or changed, or the ovanership of the property is divided, no new connection will be made unless same be metered as hereinabove required for services applied for or installed on and after said 25th day of June, 1949. SECTION 15. That notwithstanding any action here- tofore taken by said Council to the contrary, metered rates as herein provided for shall apply and be collected from all metered services on the Municipal Water Works System of said City, beginning on and after said 25th day of June, 1949. SECTION 16. This resolution and the rules and regulations and rates therein contained and established there- by shall repeal and supersede Resolution No. 340 and amend- ments thereof, and all other resolutions, rules, regulations and rates upon the sane subject or subjects, heretofore adopted. This resolution and the rules, regulations and rates herein contained and set forth shall be in full force and effect and shall control on and of ter the said 25th day of June, 1949. EE SECTION 17. The foregoing rules, regulations and rates may be changed , amended or altered at any time by resolution of the City Council of said City, duly passed and adopted, and new rules, regulations, rates and condi- tions may be added thereto. SECTION 18. That this resolution shall take effect and be in full force on and after the 25th day of June, 1949. SECTION 19. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the Book of Resolutions of said City and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
