CC RESOLUTION 969J7t�' RESOLUTION NO. 969 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING A CERTAIN MAP OF TRACT NO. 154550 LOCATED WITHIN SAID CITY, CONDITIONED THAT A CERTAIN BOND IN THE PRINCIPAL SUM OF X30,000.00 FOR THE CONSTRUCTION OF CERTAIN IMPROVEMENTS WITHIN AND ADJACENT TO SAID TRACT BE MADE AND FILED. WHEREAS, a certain map of Tract No. 15455, situated within the City of E1 Segundo, County of Los Angeles, State of California, is now presented to the City Council of said City for its approval; AND, WHEREAS, it appears that said map of said tract was heretofore referred to and approved by both the City Engineer and by the Planning Commission of said City; AND, WHEREAS, said map, as presently presented and as so approved, is satisfactory to this Council in all particulars; NO'W, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO; CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That subject to the making, furnishing and filing of the surety bond hereinafter referred to, approved as to form by the City Attorney and by the Mayor as to Surety, the said map of said Tract No. 15455 is hereby approved by this Council, and the City Clerk, upon receipt of such bond so approved, is hereby authorized and directed to endorse a memorandum of such approval of this City Council upon said map. SECTION 2. That before the approval hereinabove granted becomes effective, and before the City Clerk endorses such memo- randum of approval upon said map, the present owners of the real property comprised within the boundaries of said tract shall, as 1- 552 principals, make, execute and file with the said City Clerk, a good and sufficient surety bond in form approved by the City Attorney and approved by the Mayor as to surety, which said bond shall be in the full principal sum of Thirty Thousand Dollars (30,000.00), and shall be substantially conditioned that if the said principals shall, at their own cost and expense, and within the period of twelve months immediately following the date of said bond, have well and truly constructed, completed, and fully paid for each and all of the following improvements within said tract, in accordance with the plans and specifications relating thereto, hereinafter referred to, and to the full satisfaction of the City Engineer and Street Superin- tendent of said City, to wit: The grading and paving with plant mix pavement of the roadways of all of the public streets and alleys within said tract and of the unpaved portions between the curb to be constructed and existing pavement on the Easterly side of Center Street between Imperial Highway and the Southerly boundary of said tract, and the portions of intersections affected thereby; the construction of concrete curbs and sidewalks; the installation of sanitary sewers; the installation of an adequate water distribution system with re- quired fire hydrants and necessary appurtenances; all of which work must be done in full and strict accordance with plans and profiles to be prepared therefor, and which must first be approved by the City Engineer and the City Council of said City, and placed on file in the office of the City Engineer prior to the execution of the improvements or any part thereof required hereunder; and in full and strict accordance with Specifications No. A -1941, entitled: "General Requirements in Connection with Public Work in and for the City of E1 Segundo, California, "; "Specifications No. 480305 of the City of E1 Segundo, California, for the Construction of Concrete Curbs and Sidewalks March 5, 1948 "; and insofar as the same may apply, the provisions of Sections 10 to 68 inclusive of Specifications entitled: 2- 552- "State of California Department of Public 'dorks Division of Highways Standard Specifications April 1945' and amendments thereof, if any; all of which said specifications are now on file in the office of the City Clerk of said City, open to public inspection and hereby referred to and by this reference expressly incorporated herein and made a part hereof. In the event that any conflict should appear between the above mentioned specifica- tions and the specifications indicated upon said above mentioned plans, in all such cases the specifications referred to on the plans shall control.,- - then said obligation shall be void, otherwise to remain in full force, virtue and effect. Said bond by its terms shall be made to inure to the benefit of the said City of E1 Segundo and to the benefit of any and all persons, firms, associations and corporations (other than said principals) who may at any time within the period of one year from the date of said bond, be or become the owner or owners of, or substantially interested in, any parcel or parcels of real property located within said tract, and with right by or on behalf of each or any of said beneficiaries, to bring independent action on, and to recover under, said bond, not exceeding in the aggregate, however, the said principal sum of 330,000.00. SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of resolutions of the said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted. McCarthy, City Clerk of the City of E1 Segundo, California, do hereby certify that the whole number of members of the City Council of the said City is five; that the foregoing resolution, being Resolution No. 969, was passed and adopted by the said City Council, approved and signed by the Mayor of said City, and attested by the City Clerk of said City, all at a regular meeting of the said Council held on the 27th day of October, A. D., 1948, and that the same was passed and adopted by the following vote, to wit: AYES: Councilmen Peterson, Swanson and Mayor Selby; NOES: Councilmen None; ABSENT: Baker and Thompson.
