CC RESOLUTION 950RESOLUTION NO. 950 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO K. C. MC ILROY AND F. 0. BOOTH, JR., A CERTAIN CONTRACT FOR THE REMOVAL OF A CERTAIN WATER TANK AND TOWER WITHIN SAID CITY.. WHEREAS, the City Council of the City of E1 Segundo, California, did heretofore in the manner provided by law, duly and regularly advertise for bids for the sale and removal of one certain used 100,000 gallon steel water tank and tower; which said notice was entitled: "Notice of Sale and Removal of Steel Water Tank and Tower," and dated April 30th, 1948, - the original of which is on file in the office of the City Clerk of said City, and as so on file is hereby referred to and made a part hereof; AND, WHEREAS, at the time for opening and considering said bids, to wit: the hour of 7:15 o1clock p. m, on Wednesday, the 19th day of May, 1948, said Council had received no bids therefor; AND, WHEREAS, said Council did therefore authorize the Water Superintendent and Commissioner of Public Works to make investigation in the open market with reference to the performing of the work and disposal of the said water tank and tower referred to in said notice, and to report the results of their investigations end findings to this Council in due course; AND, WHEREAS, said Council has now received an offer, dated August 31, 1948, from K. C. McIlroy and F. 0. Booth, Jr., in response to the said "Notice of Sale and Removal of Steel Vater Tank and Tower" above referred to, which said offer is in words and figures substantially as follows, to wit: 1- "E1 Segundo City Council Aug. 31, 1948 E1 Segundo, Calif. Gentlemen:- In response to your add for bids in the taking down and removal of the water tank, located at the City park. We will take the above mentioned tank down & remove It from the premises for said tank. (No Cash bid). We will carry our own insurance in addition to what you might have. It is our intention to scrape the above mentioned tank, and remove same in small portions. Yours for consideration. Sincerely Yours, K. C. McILROY & F. 0. BOOTH, JR. NOW, THEREFORE, the City Council of the City of El Segundo, California, does hereby resolve, declare and determine as follows: SECTION 1. That the said offer of said K. C. McIlroy and F. 0. Booth, Jr., for the removal of said water tank and tower, be and the same is hereby accepted, which said bid is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof. SECTION 2. That said Contractors agree that all work will be done in accordance with the provisions of the "Labor Code" of the State of California, and to pay not less than the general prevailing rates of wages in the City of E1 Segundo, California (the locality in which the said work is to be performed) for each craft or type of workman or mechanic needed to execute this contract for the proposed work. Said d general prevailing rates of wages, so ascertained, declared, determined and specified, are herein specifically set forth as follows, to wit: LARORERS RATE PER HOUR Laborers, General or Construction . . . . $1.35 Operators and Tenders of pneumatic and electric tools, and similar mechanical tools not separately classified herein 1.55 Cutting Torch Operator (demolition) . . . 1.40 Guard and /or Watchman 1.35 OPERATING ENGINEERS Air Compressor Operator . . . . 1_65 Hoisting Engineer . . . . . .. . . . . . 1.90 SKILLED CRAFT Boilermaker . . . . . . . . . . . . . . . 1.95 Boilermaker Helper . . . . . . . . . . . 1.70 FOREMEN Foremen not herein classified shall be paid not less than 17 1/2 cents per hour more than the hourly rate of the highest classification over which he has supervision. The minimum wage paid for all labor for which rates are not shown shall be not less than those in accordance with the provisions of Article XI of the Labor Agreement between the Southern California General Contracors and the A. F. of L. Building and Construction Trades Unions dated June 3, 1946, as revised and amended. rates. Overtime shall be one and one -half times the above Sundays and holidays shall be considered as overtime- Saturday is treated not as a legal holiday or over- time work unless same falls upon a calendar day, the whole of which is declared a legal holiday by law. The minimum of per diem wages as above set forth contemplates in each instance a working day of eight (8) hours. SECTION 3. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof after the 3- Clerk's Certificate, forms for the approval of the success- ful bidder and on the part of the said City, and such copies Of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract or order for the removal of said water tank and tower pursuant to the award hereinabove made, and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and in- structed to attest the same on behalf of said city, and to affix the seal of said City thereto. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof In the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
