CC RESOLUTION 924RESOLUTION N0. 924 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO; CALIFORNIA, AWARDING TO CALIFORNIA ELEC'T'RIC CONSTRUCTION COM- PANY THE CONTRACT FOR THE FURN.LShING AND INSTALLATION OF CERi-AIN LIGHTING FIXTURES IN THE EL SEGUNDO PUBLIC LIBRARY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids for the furnishing and installation of certain lighting fixtures in El Segundo Public Library, in conformity with the information for bidders, the drawings, specifications, and all other documents compris- ing the pertinent contract documents on file and open to public inspection in the office of the City Clerk of said city; AND, WHEREAS, at the time for opening and consider- ing all of said bids, to wit: the hour of 7:15 otolock p. m. on Wednesday, the 3rd day of March, 1948, said Council did publicly open, examine and declare all bids received; AND, WHEREAS, at said hour said Council did take all of said bids under advisement and referred the same to the Library Architects, Austin, Field and Fry, for study, report and recommendation to said Council at its next re- gular meeting, ,arch 10, 1948, AND, WhtRt�AS, said last mentioned time has now arrived, and said Council has received a communication from said architects with recommendations respecting said bids and the award of contract pursuant thereto; and said Council has now reached its decision with reference to said award; NOW, ThEREFOR,,, tae City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: 1- r f; < SECTION 1. Said Council does hereby find and determine that Electric and Machinery Service, Inc. submitted the low bid for said work or improvement for the sum of $4,844.00 on the basis, however, of completing said work or improvement within 40 days from the date of contract; and that the California Electric Construction Company submitted the next low bid for the sum of $4,850.00, but on the basis of completing said work or improvement within 21 days from the date of contract; and that after due consideration the City Council feels and does hereby find and determine that the difference of 46.00 in the amount of said bids would not com- pensate for the 19 days difference in time for completion, specified in said respective bids; and that it would be to the interest, benefit and advantage of the City of El Segundo to have said work completed within the 21 day period above referred to, rather than the 40 day period above mentioned, and that the difference of $6.00 in the bid price between said respective bids would not constitute a sufficient saving to said city in money to offset or equal such difference in com- pletion time, and that therefore the bid of said California Electric Construction Company is the beat bid received for said work or improvement, all factors considered, in and for the Interests of said city. SECTION 2. That the bid of CALIFORNIA ELECTRIC CONSTRUCTION COMPANY, of Los Angeles, California, dated March 3, 1948, which said Council determines to be substantially as follows, to wit: "BID FORM "Bids will be received until 7 :15 p.m. Wednesday, March 3, 1948, in the office of the City Clerk, located in the City Hall, in the City of E1 Segundo, County of Los Angeles, State of California. 0 p_r�4,NiY T0; The Honorable City of E1 Segundo E1 Segundo, California The undersigned hereby proposes and agrees to furnish any and all required labor, materials, equipment, transporta- tion and services, sales tax, use tax and all other costs and profits required for the furnishing and installation of light- ing fixtures in the E1 Segundo Public Library, located in City Park in said city, in strict conformity with the drawings and specifications as prepared therefore by Austin, Field and Fry, Architects, for the sum of Four Thousand Eight Hundred and Fifty DOLLARS (84.850.QQ). The undersigned agrees, if awarded the contract, to complete the work included therein within 21 calendar days from the date of contract. WAGES 1. The undersigned agrees, if awarded the contract, that there shall be paid by the undersigned, and by all subcontractors under him to all laborers, workmen and mechanics, employed in the execution of such contract or any subcontract thereunder, not less than the general prevailing rate of per diem wages, and rates for overtime and legal holidays in the locality in which the work is to be performed, as ascertained and determined, pursuant to State Statutes and /or local law thereto applicable, by the public body awarding this contract, the schedule thereof being set forth in the Advertisement for Bids and /or other Contract Documents. WIThDRAWAL OF BIDS 2. The undersigned agrees that this bid may not be withdrawn for a period of thirty (30) days after the date set for the opening thereof, unless otherwise required by law. DESIGNATION OF SUBCONTRACTORS 3. In compliance with the provisions of Secs. 4100 -4107 of the Government Code of the State of California, and any amendments thereof, each bidder shall set forth below the name and the who will perform work or labor or render service to the contract, In or about the construction of the work or improvement to be performed under these specifications and the portion of the work which will be done by each subcontractor. 4. If the contractor fails to specify a subcontractor for any Portion of the work to be performed under the contract, he shall be deemed to have agreed to perform such portion himself, and he shall not be permitted to subcontract that portion of the work except under the conditions hereinafter set forth. 5. Subletting or subcontracting of any portion of the work to which no subcontractor was designated in the original bid shall only be allowed by special permission of the City of E1 Segundo. BIDDER'S BOND 6. Enclosed find Bidder's Bond, Certified Check or Cashier's Check for x$242.50, which is not less than five (5 %) per cent of this bid, payable to the City of E1 Segundo, County of Los Angeles, State of California, and which is given as a guarantee that the undersigned will enter into contract if awarded the work. SECTION 3. That said Contractor agrees that all work will be done in accordance with the provisions of the " Laoor Code" of the State of California, and to pay not less than the general prevailing rates of wages in the City of E1 Segundo, California, (the locality in which the said work or improvement is to be performed) for each craft or type of workman or mechanic needed to execute this contract. Said general prevailing rates of wages, so ascertained, declared, determined and specified, are herein specifically set forth as follows, to wit: CLASSIFICATION FOREMEN: All foremen not herein separately classified shall be paid not less than $1.40 per day more than the journeyman rate for the craft involved. APPRENTICES: May be employed in conformity with Section 1777.5 of the California Labor Code. HOURLY WAGE RATE LABORERS: General or construction, including all laborers not herein separately classi- fied on all types of construction . . $1.35 4- CARPENTERS: Carpenter . . . . . . . . . . . - 1. 90 Millwright . . . . . . . . . . . 2.10 ELECTRICIANS: Cable Splicer . . . . . . . . . . 2.45 Electrical Foreman . . . . . . . 2.70 Electrician . . . . . . . . . . . 2.15 Apprentices to any of the trades or classifications listed above may be employed upon the project with skilled workmen and mechanics, if such apprentices are employed in accordance with the working rules and conditions set forth in the respective recognized trade agreements in effect at the time of the execution of this contract, copies of which working rules and conditions are on file in the office of the Architects and which may be examined by contractors_ In no event shall the hourly wage rate for any apprentice on the project be less than $1.35 per hour. The minimum of per diem wages as above set forth contemplate in each instance a working day of eight (8) hours. Over -time one and one-half times the regular rate. Sundays and holidays one and one -half times the regular rate. Saturday is treated not as a legal holiday or over- time work unless same falls upon a calendar day, the whole of which is declared a legal holiday by law. It shall be mandatory upon the contractor and upon any sub- oontractor under such contractor, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by said contractors in the execution of the within contract. The contractor shall forfeit as a penalty to the City of 3B1 Segundo Ten (10) Dollars for each laborer, workman or mechanic employed for each calendar day or portion thereof such laborer, workman or mechanic is paid less than the general prevailing rates of wages herein stipulated for any work done 5- ��o- r!•♦ under this contract, or by any sub - contractor under said contractor, in violation of the Labor Code. SECTION 4. The Contractor agrees that, pursuant to the provisions of Article 1 of Chapter 4 of Division 5 of Title 1 of the Government Code of the State of California, as amended to date, only unmanufactured materials produced in the United States, and only manufactured materials manufao- tured in the United States, substantially all from materials produced in the United States, shall be used in the performance of this contract. Any person who fails to comply with such provision shall be subject to the penalties and procedures set forth, indicated and referred to in said Article 1. SECTION 5. That all bids received for said work or improvement, with the exception of the said bid of said California Electric Construction Company, be and the same are hereby rejected, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 6. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said city, and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said city, shall constitute the contract for the furnishing and installing of lighting fixtures for El Segundo Public Library, pursuant to the award hereinabove made, and the Mayor of the City of E1 Segundo is hereby author- ized on behalf of said city to affix the approval and acceptance of said city to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said city, and to affix the sea! of said city thereto. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of re- solutions of the said City of El Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
