CC RESOLUTION 923RESOLUTION NO. 923 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING A CERTAIN VARIANCE PUR6UANL TO THE APPLICATION OF VAHRAM AND YEVNIGE OUZOUNIAN ON APP:.AL FROM THE DECISION RENDERED BY THE CITY PLANNING CODN4IS6ION IN ITS RESOLU- TION NO. 24, ADOPTED ON THE 9TH DAY OF FEBRUARY, 1948. WHEREAS, Vahram and Yevnige Ouzounian did heretofore apply to the City Planning Commission of the City of E1 Segundo, California, for the variance hereinafter referred to, from the provisions of Ordinance No. 306 (the zoning ordinance) of said city; AND, WHEREAS, said Commission, after duly processing the said application, did by its Resolution No. 24 deny said variance; AND, WHZR,?AS, said applicants did, within the time permitted in said Ordinance No. 306, duly and regularly appeal to the City Council of said city from the decision of said Planning Commission in said matter; AND, WHERLA3, said Council has duly processed the matter of said ap %eal before said Council, as contemplated under the provisions of said ordinance, and has reached its decision in said matter, as hereinafter set forth; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, find, declare and order as follows: SECTION 1. That the said aooeal of said applicants from said decision of said Planning Commission was in order, as same relates to a matter or subject upon which the decision of the Planning Commission was not final under the provisions of said ordinance. 1_ SECTION 2. That the City Council hereby finds and determines: (1) That there are exceptional or extraordinary circumstances or conditions applicable to the property involved (hereinafter described), and to the intended use of said property, that do not apply generally to the property or class of use in the same vicinity or zone. (2) That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicants, possessed by other property in the same vicinity and zone. (3) That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the subject property is located; and (4) That the granting of such variance will not adversely affect the comprehensive general land use plan contained and referred to in said Ordinance No. 306. SECTION 3. That the City Council does hereby over- rule the action and decision of the City Planning Commission of the City of E1 Segundo taken and made in its said Resolu- tion No. 24 relating to said application_ SECTION 4. That the said Council does hereby grant the following variance, to wit: A variance applying only to the West 44 feet of the East 90.03 feet of the North 125 feet of Lot 2 in Block 98 in the City of E1 Segundo, County of Los Angeles, State of California, which will (and does hereby) authorize and permit the erection of a single family residence within the required ten per cent (10;x) side yard set back, as stipulated by said Ordinance No. 306, 2- and which contemplates a 5 foot side yard on the East side of said residence, and a 3 foot side yard on the West side of said residence. SECTION 5. That this resolution shall take effect immediately. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book or original resolutions of said Council; shall forward a copy of the same to the City Planning Commission for its information and files; and shall also forward a copy of the same to said applicants as evidence of the granting of the variance hereinabove described. Passed, approved and adopted this 3rd day of March, A. D., 1948.
