A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, EMPLOYING
AND APPOINTING A. S. MONROE, A CIVIL
ENGINEER, FOR THE PURPOSE OF ASSISTING
VARIOUS OrFICERS Or SAID CITx, AND FOR
THE PREPARATION OF THE RESOLUTIONS, NOTICES
AND OTHER PROCEEDINGS INVOLVING CONSTRUCTION
OF VARIOUS IWROVEMENTS, THE COSTS OF WHICH
ARE TO BE PAID FROM SPECIAL ASSESSMENTS.
WHEREAS, it is contemplated that the City Council
of the City of E1 Segundo, California, will, from time to
time in the future, institute and carry through special
assessment proceedings for the construction of various
Improvements within said city; and
WHEREAS, it is recommended by the City Engineer
and the City Attorney of said city that A. S. Monroe, a
Civil Engineer, be employed and appointed for the purpose
of assisting the various officers of said city, and for the
typing and preparing of the resolutions, notices and other
papers and proceedings for any work or improvement involving
special assessments under any of the various improvement
acts of the State of California, which are used in connection
with the making of improvements under special assessment
proceedings;
NOW, TREREFOttE, the City Council of the City of
E1 Segundo, California, does hereby resolve, declare, determine
and order as follows:
SECTION 1. That until the further order of said
Council repealing this resolution, A. S. MONROE, a Civil
Engineer, registered under the laws of the State of California,
be and he is hereby employed for the purpose of assisting the

various officers and employees of the said city and also
for the purpose of typing and preparing the resolutions,
notices and other papers and proceedings, including the
estimating and preparing of the assessments to cover the costs and
expenses of any such proceedings, and the figuring and preparing
of any bonds that may be issued against unpaid assessments
(exclusive of the furnishing of the blank bonds) for the
construction of each and all of the improvements presently
being, or hereafter, prosecuted, provided for, or undertaken
by the City of E1 Segundo, under the provisions of "The Special
Assessment Investigation, Limitation and Majority Protest Act
of 1931 "; the "Improvement Act of 1911", of the State of
California, and /or any of the other various improvement acts
of said state which are used in connection with the making of
improvements under special assessment proceedings.
SECTION 2. That the total compensation of the said
A. S. Monroe for such services, including expenses, i's hereby
fixed at an amount equal to two and one -half per cent (2 1/2 %)
of the total respective total construction costs of said re-
spective improvements, exclusive of incidental expenses, which
said compensation shall be included as incidental expenses and
become a charge against the respective assessment districts
formed for said respective improvements.
SECTION 3. That the payment of said compensation,
as to each of said respective assessment proceedings, shall
be made as follows:
(a) An amount equal to one per cent (1 %) of the
estimated amount of any contract to be entered into
for said improvement, shall be collected from the con-
tractor as incidental expenses and shall be paid to the
said A. S. Monroe within fifteen (15) days after the
date of said contract;

(b) An amount equal to one per cent (1 %) of the
total contract construction cost for said improvements,
shall become due and payable when the assessment for
each of said respective improvements 1s confirmed by
the City Council and recorded by and in the office of
the Superintendent of Streets of the said city;
(o) The balance of said compensation shall become
due and payable when the said bonds to be issued against
unpaid assessments have been prepared, together with the
bond register, and delivered to the City Treasurer of
said city; and
(d) In the event that any of the proceedings
Initiated cease or are abandoned before the awarding of
any contract for such improvements, the City of E1 Segundo
shall only be liable for the time actually incurred by
the said A. S. Monroe (or the actual time of H. C. Mapes,
employed by said A. S. Monroe, to assist in the prepara-
tion of the written report under said Special Assessment
Investigation Limitation and Majority Protest Act of 1931,
or in the preparation of any of such other proceedings)
at the rate of Thirty -five Dollars ($35.00) per day, of
seven (7) hours each, for the preparation of any such
proceedings, together with automobile allowance of six
cents (6¢) per mile, which said amounts shall be submitted
to this City Council by an itemized statement of such
services and expenses; provided, that should said pro -
osedinge cease or be abandoned the amount to be paid by
the City shall not exceed three - quarters of one per cent
(3/4 of 1 %) of the estimated cost of said proposed
Improvements.
SECTION 4. That this resolution shall take effect
immediately upon its passage.

SECTION 5. That the City Clerk shall certify to
the passage and adoption of this resolution; shall enter
the same in the book of resolutions of said city, and shall
make a minute of the passage and adoption thereof in the
records of the proceedings of the City Council of said city
in the minutes of the meeting at which the same is passed
and adopted.

I, Victor D. McCarthy, City Clerk of the City of
E1 Segundo, California, do hereby certify that the whole number
of members of the City Council of the said city is five; that
the foregoing resolution, being Resolution No. 910 , was dulypassed
and adopted by the said City Counoil, approved and signed by the
Mayor of said city and attested by the City Clerk of said city,
all at a regular meeting of the said Council held on the 10th day
of December, A. D., 1947, and that the same was so passed and
adopted by the following vote:
