CC RESOLUTION 900RESOLUTION NO. 900 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING SPECIFICATIONS NO. SP 471007 FOR THE IN- STALLATION OF VITRIFIED CLAY SEWER MAINS IN EL SEGUNDO BOULEVARD AND WHITING STREET. The City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: SECTION 1. That the following specifications, being and to be known as " SPECIFICATIONS NO. SP 471007 OF THE CITY OF EL SEGUNDO, CALIFORNIA FOR THE INSTALLATION OF VITRIFIED CLAY SEWER MAINS IN EL SEGUNDO BOULEVARD AND WHITING STREET ", be and the same are hereby adopted: "SPECIFICATIONS NO. SP 471007 OF THE CITY OF EL SEGUNDO, CALIFORNIA FOR THE INSTALLATION OF VITRIFIED CLAY SEWER MAINS IN EL SEGUNDO BOULEVARD AND WHITING STREET DESCRIPTION OF WORK: The work to be done under these specifications shall consist of furnishing all necessary materials, tools, appliances, equipment, labor, and transportation for the necessary excavation and construction of a 10 inch vitrified clay sanitary sewer line, manholes, and appurtenances, in E1 Segundo Boulevard and Whiting Street in the City of El Segundo, California, all as shown on Plans No. 471002, 471003, SD 410422, SD 410508, and described in these specifications and Specifi. cations Number C -1941 entitled "SPECIFICATIONS FOR SANITARY SEWER" heretofore approved by the City Council of said city for said work. L- 5 INTENT OF PLANS AND SPECIFICATIONS: All work called for in these speo- ifications and not shown on the plans, or shown on the plans and not called for in the specifications, shall be executed and furnished by the Contractor as if described in both these ways. RESPONSIBILITY: When a contract for the work herein specified is executed, the Contractor shall assume the entire responsibility of the fob, and shall hold the City of E1 Segundo, California, its officers, agents, and /or employees free from any liability for damage of any nature whatsoever which may arise or occur in connection with the doing of said work. SUBCONTRACTOR: None of the work specified herein shall be sublet without the written consent of the City Council of the City of E1 Segundo, California, and if any part should be sublet with such consent the Sub - Contractor will be considered only as an employee of the Contractor. REVISIONS: Any revision in or departure from these specifications materially affecting construction must be approved by said City Council. Where any such revisions increase the cost of materials and /or labor, a proper adjustment and agreement shall be reached by a consultation between said City Council, and a representative of the Contractor. TIKE: The Contractor shall commence work within fifteen (15) days after the execution of the contract, and shall agree to complete the work within forty -five (45) days thereafter. CARPENTERS Carpenter 1.90 Table Power Saw Operatior 1.975 All foremen not herein separately classified shall be paid not less than 17 -1/2 cents per hour more than the hourly rate of the highest classification over which he has super.. vision. The minimum wage paid to all labor for which rates are not shown shall be not less than those in accordance with the provisions of Article XI of the Labor Agreement between the Southern California General Contractors and the A.F. of L. Building and Construction Trades Unions dated June 3, 1946, as revised and amended. Overtime shall be one and one -half times the above rates. Sundays and holidays shall be considered as overtime. The minimum of per diem wages as above set forth contemplate in each instanoe a working day of eight (8) hours. PAYMENT; Bidders shall state the total price for work to be performed under this contract upon a blank proposal furnished free at the office of the City Clerk or City Engineer of said City. Said bid must be accompanied by a certified or cashier's check, or bidders bond in an amount not less than ten per cent (10 %) of the total amount of the bid. The check or bidders bond of the successful bidder will be forfeited to said City in the event such successful bidder after being awarded the contract, fails to enter into same within ten (10) days after notice of award. The City of E1 Segundo, California, will pay to the Contractor a sum equal to seventy -five per cent (755) of the total amount earned under the contract within fifteen (15) days after the completion and acceptance of the work by said City Council and the balance or remaining twenty -five per cent (25 %) shall be paid within thirty -five (35) days after the first payment. 4. DEFINITIONS AND TERMS: Whenever in these specifications or In any documents or instruments where these specifications govern, the following terms or pronouns in place of them are used, the Intent and meaning shall be interpreted as follows: CITY - The City of E1 Segundo, California CITY COUNCIL - The City Council of the City of E1 Segundo, California. 'ONTRACTOR - The person or persona, oo- partnership or corporation who have entered into a contract with the City of E1 Segundo, California. ENGINEER - The City Engineer of the City of E1 Segundo, - California, acting either directly or through properly authorized agents, such agents acting within soope of the particular duties entrusted to them. " SECTION 2. That said Council does hereby find and determine that the prevailing rates of per diem wages within said city, set forth in said Specifications No. SP 4710079 are the prevailing rates of per diem wages for each of the respective professions, crafts, trades, callings and vocations, therein mentioned or referred to, and that said rates are hereby fixed and established as, and shall constitute, the minimum rates of per diem wages to be paid in connection with the prosecution of the work under said specifications. SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of resolutions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted.
