CC RESOLUTION 889x• 2 of, t • 1mr, • •• A RESOLUTION OF rHE CITY COUNCIL OF TnE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING A CONDITIONAL PE MIr To JOHN J. CAIN, DOING BUSINESS AS YELLOW CAB COMPANY, TO OPERATE A TAXICAB BUSINESS IN TnE CITY OF EL SEGUNDO. WHEREAS, there has been presented to the City Council of the City of $ Segundo, California, the application of John J. Cain for a permit to conduct a taxicab business in said city, under the name and style of "Yellow Cab Company "; AND, WHEREAS, it appears that said John J. Cain is the purchaser of the taxicab business heretofore operated in said city by Edward L. Bennett and Veda x. Bennett; ANY, WHXKr;AS, said Council has reviewed said appli. cation and has interviewed said applicant, and said '+ounoil believes that said applicant will operate a taxicab business in a prudent and satisfactory manner; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does hereby resolve, declare, determine and order as follows: SECTION 1. That the said application of said John J. Cain, above referred to, be placed on file in the office of the City Clerk, open to public inspection, and that said application as so on file be and the same is hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 2. That in the opinion of said Council the public convenience, necessity and interest will be served by the operation of the taxicab service within said sity, referred to in said application of said John J. Cain. SECTION 3. That said John J. Cain be and he is hereby authorized and granted permission to operate a taxicab business 1- within the City of El Segundo, California, in accordance with the provisions of the ordinances of said city relating to such matters, and subject to the following special and additional terms and conditions, to..wit: (1) That this permit is temporary only and may be suspended by the Chief of Police of said city at any time in his discretion, or may be revoked by said Council at any time in its discretion, and that such suspension or revocation may be so ordered and made at any time without cause, without notice and without liability on the part of the City of El Segundo, or any of its officers, employees, agents or repre. sentatives. (Q) That while operating said business under the permission herein granted, said applicant will conform with and abide by the provisions of ail ordinances of said city, and such regulations as the Police Department of said city may prescribe with respect to the operation of taxicabs and taxicab businesses within said city. (3) That until the further order of said Council said permitter shall be and he is hereby authorized to operate two taxicabs in connection with said business. All taxicabs operated under this permit shall be equipped with a suitable and accurate taxi meter, (4) That the rates to be charged for taxicab service within said city rendered by said permitter, shall be and the same are hereby fixed and established as pro- vided in the following schedule, to wit: E.. "SCHEDULE OF TAXICAB RATES AND CHARGES IN THE CITY OF EL SEGUND09 CALIFCRNIA. For first 1/3 mile or flag - - - - - - 20¢ For each additional 1/3 mile or fraction thereof after flag - - - •- - - - - 10# For waiting time - - - - - - , - -- - ---- -$8.50 per hr. Service Charge - equal to regular fare from cab station to pick up point- payable when cab is required to proceed farther away from cab station than pick up point. No charge for paokages or luggage, but operator may refuse service where same are unusual or excessive. Rates include from one passenger to rated capacity of cab. No dismissal charge. This schedule must be conspicuously displayed in each oab." (5) That the permit herein granted shall not be assigned, or be subject to assignment, without the written consent of the City Council first had and obtained. (8) That the Council reserves the right to make such additional rules and regulations, and to prescribe such additional terms and conditions with reference to the permit herein granted and the business operated or to be operated thereunder, as said Council in its discretion may from time to time determine. (1) That this permit shall not beoome effective until permitter has endorsed upon a copy of this resolution an acceptance of the same, and all of the terms and conditions herein set forth, which said endorsement shall be substan- tially in the following form and may be subscribed to by said permittee at this point, to -wits "The undersigned, being the permittee referred to in the foregoing Resolution No. 889, in consideration of the permit granted to his therein, does hereby state that he has carefully read the said resolution and is familiar with the terms, conditions and provisions thereof; that 3- he accepts the permit therein referred to upon and subject to each and all of the said torus, conditions and provisions, and agrees to observe and be bound thereby. Dated this day of , 1947. '_i'� SECTION 4, That in consideration of the foregoing premises, said City Council does hereby oonsent to the sale and transfer by said above mentioned Edward L. Bennett and Veda R. Bennett to said John J. Cain above named, of the said taxicab business above referred to, effective as of, on and after the effective date of this resolution. SECTION g. That this resolution shall take effect and be in full force and virtue on and after the 31st day of July, 1947. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of resolutions of the said city, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted. MoCarthy, City Clerk of the City of E1 Segundo, California, do hereby certify that the whole number of medbers of the City Council of the said city is five; that the foregoing resolution, being Resolution No. S89, was passed and adopted by the said City Council, approved and signed by the Mayor of said city, and attested by the City Clerk of said city, all at a regular meeting of the said Council held on the 30th day of July, A.
