RESOLUTION N0, 880
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING
TO JOBE AND COX THE CONTRACT FOR PAINTING
TWO STEEL SEDIMENTA'T10N TANKS AND FLUME
AT WATER 'TREATMENT PLANT IN SAID CITY.
WHEREAS, the City Council of the City of Fl Segundo,
California, has heretofore in the manner provided by law,
duly and regularly advertised for bids for the furnishing
of all labor, tools, equipment, transportation and materials
necessary for painting two steel sedimentation tanks and
flume at the water treatment plant in said city;
AND, Wh.RREAS, at the time for opening and considering
all of said bids, to -wit: the hour of 7 o'clock p, m. on
Wednesday, the 30th day of April, 1947, said Council did
publicly open, examine and declare all bids received;
AND, WHEREAS, at said hour said Council did take all
of said bids under advisement until the hour of 7 o'clock p. m.
on Wednesday, the 7th day of May, A. D., 1947;
AND, WHEREAS, said last mentioned hour has now arrived
and said Council has reached its decision in the said matter;
NOW, 'THEREFORE, the City Council of the City of
E1 Segundo, California, does resolve, declare and determine
as follows:
SECTION 1. That the bid of JOBE AND COX, of San
Pedro, California, dated April 30, 1947, which said Council
determines to be substantially as follows, to -wit:

325 Maryland Street, in said city, all labor, tools,
equipment, transportation, and materials to sandblast
and paint the interior surfaces of one three - section
steel flume approximately 39' -0" x 91 -6" x 31 -3", and
two steel sedimentation tanks approximately 481 x 0"
diameter x 16t -00, including launder, interior and
exterior surfaces of steel downtake, exterior surface
of 30" intake pipe and 12" distribution headers, and
all underwalk angle -iron supports up to but not includ-
ing the two 128 channels; all in accordance with
Specifications No. 470325 heretofore approved by the
City Council of said city and on file in the office of
the City Engineer, which said specifications are hereby
referred to for a full and complete description of the
work to be done and are by this reference expressly
Incorporated herein and made a part hereof for all
further particulars with reference to said work;
And all in accordance with the requirements of "NOTICE
TO BIDDERS" attached hereto;
And all at the total price stated below, to -wit:
Three Thousand, five hundred and forty DOLLARS $3,540.00
And as further required in said "NOTICE TO BIDDERS"
encloses Bond in the amount of $400900 Four Hundred
DOLLARS $400.00 which said amount is not less than
ten (10) per cent of the total amount bid.

be, and the same is hereby accepted at the price set forth
in said bid, which is now on file in the office of the City
Clerk of said city, and which said bid so on file is hereby
expressly referred to and by this reference incorporated
herein and made a part hereof for all further particulars.
All work and materials shall be in accordance with
"Specifications No. 470325 for the Painting of Two Steel
Sedimentation Tanks and Flume at the Water Treatment Plant
E1 Segundo, California ", heretofore approved by said Council
and on file in the office of the City Clerk of said city.
SECTION 2. Said Contractor agrees that all work
will be done in accordance with the provisions of the "Labor

Code" of the State of California, and to pay not less than
the general prevailing per diem rates of wages in the City
of E1 Segundo, California (the locality in which the said
work or improvement is to be performed) for each craft or
type of workman or meohanio needed to execute this contract
for the proposed work or improvement. Said general prevailing
rates of per diem wages, so ascertained, declared, determined
and specified are herein specifically set forth as follows,
to -wit:

Over -time shall be One and One -Half times the above
rates.
Sundays and Holidays shall be considered as over -time.
The Minimum of per diem wages as above set forth, con.
template in each instance a working day of eight (8) hours.
Saturday is treated not as a legal holiday, and work
thereon shall not be treated as over -time work, except in those
cases where a Saturday falls upon a calendar day, the whole
of which is declared a legal holiday by law.
It shall be mandatory upon the contractor and upon
any sub - contractor under said contractor, to pay not lose than
the said specified rates to all laborers, workmen and mechanics
employed by said contractor in the execution of the contract.
The contractor shall forfeit as a penalty to the
City of E1 Segundo, Ten (10)Dollare for each laborer, workman
or mechanic employed for each calendar day or portion thereof

prevailing rate of wages herein stipulated for any work done
under this contract, or by any sub- oontractor under said con-
tractor, in violation of the Labor Code.

The Contractor, insofar as said contractor is
legally required so to do, must observe and abide by the
provisions of all laws of the State of California, and of
the United States of America, relating to contracts of the
nature contemplated herein.
SECTION 3. The Contractor agrees that, pursuant
to the provisions of Article 1 of Chapter 4 of Division 5
of Title 1 of the Government Code of the State of California,
as amended to date, only unmanufactured materials produced
in the United States, and only manufactured materials manu.

That resident citizens of the City of El Segundo,
California, will, so far as reasonably possible, be employed
upon the work contemplated hereunder.
SECTION 4. That all bids received for said work
or improvement, with the exception of the said bid of said
Jobe and Cox, be and the same are hereby rejected, and the
City Clerk is hereby authorized and instructed to return the
checks of all unsuccessful bidders.
SECTION 5. That the City Clerk shall prepare copies
of this resolution after the passage and adoption thereof,
and shall affix to such copies at the and thereof after the
Clerk's Certificate, forms for the approval of the successful
bidder and on the part of the said city, and such copies of
this resolution, so approved and accepted by the successful
bidder and by and on behalf of said city, shall constitute
the contract for painting two steel sedimentation tanks and
flume at Water Treatment Plant in said city, pursuant to the
award hereinabove made, and the Mayor of the City of E1 Segundo

Is hereby authorized on behalf of said City to affix the
approval and acceptance of said City to such contract, and
said City Clerk to hereby authorized and instructed to
attest the same on behalf of said City, and to affix the
seal of said City thereto.
SECTION 6. That the City Clerk shall certify to
the passage and adoption of this resolution; shall cause
the original of the same to be entered in the book of re-
solutions of the said City of E1 Segundo, and shall make a
minute of the passage and adoption thereof in the records
of the proceedings of the City Council of said City, in the
minutes of the meeting at which the same is passed and adopted.

number of members of the City Council of the said city is
five; that the foregoing resolution, being Resolution No.
880, was passed and adopted by the said City Council,
approved and signed by the Mayor of said city and attested
by the City Clerk of said city, all at a regular meeting of
the said Council held on the 7th day of May, A. D., 1947,
and that the same was so passed and adopted by the following
