A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING
TO McCLAIN CONSTRUCTION COMPANY THE CON-
TRACT FOR ThE CONSTRUCTION OF REINFORCED
CONCRETE FOUNDATIONS FOR ELEVATED STEEL
WATER TANK AND THE FURNISHING OF CERTAIN
MATERIALS INCIDENT THERETO.
WHEREAS, the City Council of the City of E1 Segundo,
California, has heretofore in the manner provided by law, duly
and regularly advertised for bids for the construction of
reinforced concrete foundations for elevated steel water tank,
and the furnishing of all necessary materials, tools, appliances,
equipment, labor and transportation for the necessary excava-
tions, forms, placing of reinforcing steel and concrete for
the foundations of said tank;
AND, WHEREAS, at the time for opening and considering
all of said bids, to -wit: the hour of 7:15 o'clock P. m. on
Wednesday, the 9th day of April, 1947, said Council did publicly
open, examine and declare all bids received;
AND, WHEREAS, at said hour said Council did take all
of said bids under advisement until the hour of 7:15 o'clock
po m. on Wednesday, the 16th day of April, 1947;
AND, WHEREAS, at said last mentioned time said Council
did then take all of said bids under further
the hour of 7:15 o'clock p. m. on Wednesday,
April, 1947; and has reached its decision in
NOW, THEREFORE, the City Council of
E1 Segundo, California, does resolve, declare
as follows:

SECTION 1. That the bid of MC CLAIN CONSTRUCTION
COMPANY, dated April 9, 1947, which said Council determines
to be substantially as follows, to -wit:
"PROPOSAL FOR THE
CONSTRUCTION OF REINFORCED CONCRETE FOUNDATIONS
FOR
ELEVATED STEEL WATER TANK
AND THE
FURNISHINGF OF CERTAIN MATERIALS THEREFOR.
"To the Honorable Mayor and City Council
of the City of El Segundo, California
Gentlemen:
The undersigned hereby proposes to furnish to the City
of E1 Segundo, California, in said city, all labor,
equipment and material necessary in order to construct
and complete the following work and improvement in and
for said city, to -wit:
The complete excavation, placing of forms, reinforcing
steel, anchor bolts, and concrete, and the backfilling
of same for the foundations of an elevated steel water
tank, all as shown on Plan No. 470305, and in accord-
ance with and conformity to Specifications No. W W- 470312,
all heretofore approved by the City Council of said city
and on file in the office of the City Engineer of said
city, which said plan and specifications are herebyre-
ferred to for a full and complete description of the
work to be done and are by this reference expressly
incorporated herein and made a part hereof for all
further particulars with reference to said work and
Improvement;
And all in accordance with the requirements of "NOTICE
TO BIDDERS" attached hereto;
and all at the price stated below, to wit:
Four Thousand Three hundred Two and 32/100 DOLLARS $4302.32
And as further required in said "NO'T'ICE TO BIDDERS" en-
closes Bid Bond in the amount of Seven Hundred B No /100
$700.00 which said amount is not less than ten (10) per
cent of the total amount bid.

be, and the same is hereby accepted at the price set forth
in said bid, which is now on file in the office of the City
Clerk of said oity, and which said bid so on file is hereby
expressly referred to and by this reference incorporated
herein and made a part hereof for all further particulars.
SECTION 2. That all bide received for said work
or improvement, with the exception of the said bid of said
McClain Construction Company, are hereby rejected, and the
City Clerk is hereby authorized to return the checks of all
unsuccessful bidders.
SECTION 3. That the said Contractor agrees that
all work done under this contract will be done in accordance
with the provisions of the "Labor Code" of the State of
California, and to pay not less than the general prevailing
rates of wages in the City of E1 Segundo, California( the
locality in which the said work or improvement is to be per-
formed), as set forth, for each craft or type of workman or
mechanic needed to execute the contract for said work or
improvement. Said general prevailing rates of wages, so
ascertained, declared, determined and specified, are herein
specifically set forth as follows, to -wit:

UNSKILLED LABOR
Labor

The minimum wage paid to all skilled labor, for which
rates are not shown above, shall be not lees than
$1.375 per hour. The minimum wage paid to all inter-
mediate and unskilled labor, for which rates are not
shown above, shall be not less than $1.15 per hour.
Overtime shall be one and one -half times the above rates.
Sundays and holidays shall be considered as overtime.
The minimum of per diem wages as above set forth contem-
plate in each instance a working day of eight (8) hours.
It shall be mandatory upon the contractor and upon
any sub - contractor under said contractor, to pay not less than
the said specified rates to all laborers, workmen and mechanics
employed by them in the execution of this contract.
That the contractor shall forfeit as a penalty to
the City of E1 Segundo Ten (10) Dollars for each laborer,
workman or mechanic employed for each calendar day or portion
thereof such laborer, workman or mechanic is paid lose than the
general prevailing rates of wages herein stipulated for any
work done under this contract, or by any sub- oontractor under
said contractor, in violation of the Labor Code.
That the contractor hereby agrees to abide by the
provisions of all laws of the State of California, and of the
United States of America relating to contracts of the nature
contemplated herein.
SECTION 4. The contractor agrees that, pursuant to
the provisions of Article I of Chapter 4 of Division 5 of
Title 1 of the Government Code of the State of California, as
amended to date, only unmanufaotured materials produced in the
United States, and only manufactured materials manufactured in

the United States substantially all from materials produced
in the United States, shall be used in the performance of
this contract. Any person who falls to comply with such
provision shall be subject to the penalties and procedures
set forth, indicated and referred to in said Article I.
SECTION 5. That the City Clerk shall prepare
copies of this resolution after the passage and adoption
thereof, and shall affix to such copies at the end thereof
after the Clerk's Certificate, forms for the approval of the
successful bidder and on the part of the said city, and such
copies of this resolution, so approved and accepted by the
successful bidder and by and on behalf of said city, shall
constitute the contract for the construction of reinforced
concrete foundations for elevated steel water tank, pursuant
to the award hereinabove made, and the Mayor of the City of
E1 Segundo is hereby authorized on behalf of said city to
affix the approval and acceptance of said city to such con..
tract, and said City Clerk is hereby authorized and instructed
to attest the same on behalf of said city, and to affix the
seal of said city thereto.
SECTION 6. That the City Clerk shall certify to
the passage and adoption of this resolution; shall cause the
original of the same to be entered in the book of resolutions
of the said City of E1 Segundo, and shall make a minute of the
passage and adoption thereof in the records of the proceedings
of the City Council of said city, in the minutes of the meeting
at which the same is passed and adopted.

five; that the foregoing resolution, being Resolution No.
879, was passed and adopted by the said City Council,
approved and signed by the Mayor of said city and attested
by the City Clerk of said city, all at a regular meeting of
the said Council held on the 23rd day of April, A. D., 19479
and that the same was passed and adopted by the following
vote, to -wit:
