A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING
TO MERRITT WELDING CONTRACTORS, THE CON-
TRACT FOR THE INSTALLATION OF CERTAIN WATER
PIPE AND APPURTENANCES AND FURNISHING OF
CERTAIN MATERIALS INCIDENTAL THERETO.
WHEREAS, the City Council of the City of E1 Segundo,
California, has heretofore in the manner provided by law,
duly and regularly advertised for bids for the installation
of certain water pipe and appurtenances end the furnishing
of all labor, tools and equipment, and certain materials
incident thereto, and their connection to existing mains
including the excavating and backfilling of the trench,
the laying of welded steel pipe and fittings, the setting
of gate valves and other appurtenances, all as shown and
delineated on the plans and specifications for said work
hereinafter mentioned;
AND, WHEREAS, at the time for opening and con-
sidering all of said bids, to -wit: the hour of 7:15 o'clock
p. m. on Wednesday, the 26th day of February, 1947, said
Council did publicly open, examine and declare all bids
received;
AND, WHEREAS, at said hour said Council did take
all of said bids under advisement until the hour of 7:15
o`clock p. m. on Wednesday, the 5th day of March, 1947;
AND, WHEREAS, said last mentioned time has now
arrived and said Council has reached its decision in the
said matter;
NOW, THEREFORE, the City Council of the City of

E1 Segundo, California, does resolve, declare and determine
as follows:
SECTION 1. That the bid of MERRITT WELDING
CONTRACTORS, dated February 26, 1947, which said Council
determines to be substantially as follows, to -wit:
"PROPOSAL FOR
THE INSTALLATION OF WATER PIPE
AND APPURTENANCES
AND
THE FURNISHING OF
CERTAIN MATERIALS
INCIDENTAL THERETO
"To the Honorable Mayor and City Council
of the City of E1 Segundo, California
Gentlemen:
The undersigned hereby proposes to furnish
to the City of E1 Segundo, California, in said city,
all labor, equipment and material necessary in order
to construct and complete the following work and
improvement in and for said city, to -wit:
'The complete installation of a 10 inch
welded steel water main and appurtenances, and its
connection to existing mains, including the excavation
and back - filling of the trench, the laying of the said
welded steel water main, the setting of appurtenances
and fittings, all as shown on Plan 470150, and in
accordance with and in conformity to Specifications
No. 470129 all heretofore approved by the City Council
of said city and on file in the office of the City
Clerk of said city, which said plan and specifications
are hereby referred to for a full and complete de-
scription of the work to be done and are by this
reference expressly incorporated herein and made a
part hereof for all further particulars with refer-
ence to said work and improvement;'
AND all in accordance with the requirements
of the 'Notice to Bidders' attached hereto;
AND all at the prices stated below, to -wit:
ITEM 1.
1200 lineal feet, approximately, ten (10) inch (8) gauge)
and eight (8) inch, 10 gauge, welded
steel water main, installation only,
complete, including excavation and
back -fill, and connection to existing
mains and installation of fittings,
for the sum of fifty -seven and 112 cents
X0.575 per lin. ft. ... $690.00 TOTAL.

AND AS FURTFER REQUIRED IN said 'Notice to Bidders'
incloses United Pacific Insurance Company Bid Bond
in the amount of One Hundred dollars 4100.00, which
said amount is not less then ten per cent (10 %) of
the total amount bid.

be, and the same is hereby accepted at the price set forth
in said bid, which is now on file in the office of the City
Clerk of said city, and which said bid so on file is hereby
expressly referred to and by this reference incorporated
herein and made a part hereof for all further particulars.
SECTION 2. That all bids received for said work
or improvement, with the exception of the said bid of said
Merritt Welding Contractors, are hereby rejected, and the
City Clerk is hereby authorized to return the checks of all
unsuccessful bidders.
SECTION 3. That the said Contractor agrees that
all work done under this contract will be done in accordance
with the provisions of the "Labor Code of the State of
California, and to pay not less than the general prevailing
rates of wages in the City of E1 Segundo, California (the
locality in which the said work or improvement is to be
performed), as set forth, for each craft or type of workman
or mechanic needed to execute the contract for said work or
improvement. Said general prevailing rates of wages, so
ascertained, declared, determined and specified, are herein
specifically set forth as follows, to -wit:

Overtime shall be Onp and One -Half times the above rates.
Sundays and Holidays shall be considered as overtime.
The Minimum of wages as above set forth contemplate in
each instance a working day of eight (81 hours.
Saturday is treated not as a legal holiday and work
thereon shall not be treated as overtime work, except
in those cases where a Saturday falls upon a calendar
day the whole of which is declared a legal holiday by law.

It shall be mandatory upon the contractor and
upon any sub - contractor under said contractor to pay not
less than the said specified rates to all laborers, workmen
and mechanics employed by them in the execution of this contract.
chat the contractor shall forfeit as a penalty to
the City of El Segundo, Ten (10) Dollars for each laborer,
workman or mechanic employed for each calendar day or portion
thereof such laborer, workman or mechanic is paid less than
the general prevailing rates of wages herein stipulated for
any work done under this contract, or by any sub - contractor
under said contractor, in violation of the Labor Code.
That the contractor hereby agrees to abide by the
provisions of all laws of the State of California, and of
the United States of America relating; to contracts of the
nature contemplated herein.
SECTION 4. The contractor agrees that, pursuant
to the provisions of Article 1 of Chapter 4 of Division 5
of Title 1 of the Government Code of the State of California,
as amended to date, only unmanufaetured materials produced in
the United States, and only manufactured materials manufactur-
ed in the United States substantially all from materials
produced in the United States, shall be used in the performance
of this contract. Any person who fails to comply with such
provision shall be subject to the penalties and procedures
set forth, indicated and referred to in said Article 1.
SECTION 5. That the City Clerk shall prepare
copies of this resolution after the passage and adoption
thereof, and shall affix to such copies at the end thereof
after the Clerk's Certificate, forms for the approval of the
successful bidder and on the part of the said city, and such
copies of this resolution, so approved and accepted by the
successful bidder and by and on behalf of said city, shall

constitute the contract for furnishing and installing said
water pipe and appurtenances, pursuant to the award here -
inabove made, and the Mayor of the City of E1 Segundo is
hereby authorized on behalf of said city to affix the
approval and acceptance of said city to such contract, and
said City Clerk is hereby authorized and instructed to attest
the same on behalf of said city, and to affix the seal of
said city thereto.
SECTION 6. That the City Clerk shall certify to
the passage and adoption of this resolution; shall cause the
original of the same to be entered in the book of resolutions
of the said City of E1 Segundo, and shall make a minute of
the passage and adoption thereof in the records of the pro-
ceedings of the City Council of said city, in the minutes of
the meeting at which the same is passed and adopted.

approved and signed by the Mayor of said city and attested
by the City Clerk of said city, all at a regular meeting of
the said Council held on the 5th day of March, A. D., 1947,
and that the same was passed and adopted by the following
vote, to -wit:
