CC RESOLUTION 718RESOLUTION NO. 718 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO CALIFORNIA PIPE LINE CONSTRUCTION COMPANY THE CONTRACT FOR THE INSTALLATION OF A CERTAIN WATER PIPE LINE IN SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids for the installation of certain water pipe and appurtenances and the furnishing of all labor, tools and equipment, and certain materials Incident thereto, all as shown and delineated on the plans for said work hereinafter mentioned; AND, WHEREAS, at the time for opening and consider- ing all of said bids, to -wit: the hour of 7:15 o'clock p. m. on Wednesday, the 5th day of April, 1944, said Council did publicly open, examine and declare all bids received; AND, WHEREAS, at said hour said Council did take all of said bids under advisement until the hour of 7:15 o'clock p, m. on Wednesday, the 19th day of April, 1944; AND, WHEREAS, said last mentioned time has now arrived and said Council has reached its decision in the said matter; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: SECTION 1. That the bid of CALIFORNIA PIPE LINE CONSTRUCTION COMPANY, dated April 4, 1944, which said Council determines to be substantially as follows, to -wit: i" "To the Honorable Mayor and City Council of the City of E1 Segundo, California. Gentlemen: The undersigned hereby proposes to furnish to the City of E1 Segundo, California, in said City, all labor, equipment and material necessary in order to con- struct and complete the following work and improvement in and for said City, to -wit: 'The complete installation of water mains and appurtenances, and their connection to existing mains, including the excavating and backfilling of the trench, the laying of cast iron pipe and /or asbestos cement pipe and oast iron fittings, the setting of gate valves and fire hydrants and other appurtenances and the removal and installation of certain appurtenances in portions of IMPERIAL HIGHWAY and in portions of PINE AVENUE in said City, all as shown on Plans No. W- 44CE14 and W- 440314 and in accordance with and in conformity to Specifications No. 440315, all heretofore approved by the City Council of said City and on file in the office of the City Clerk of said City, which said plans and specifications are hereby referred to for a full and complete description of the work to be done and are by this reference expressly in- corporated herein and made a part hereof for all further particulars with reference to said work and improvement'; AND all in accordance with the requirements of the 'Notice to Bidders' attached hereto; AND all at the prices stated in the SCHEDULE below, to -wit: S C H E D U L E ITEM 1. 1876 Lin. SECTION 2. That all bids received for said work or improvement, with the exception of the said bid of said California Pipe Line Construction Company, are hereby re- jected, and the City Clerk is hereby authorized to return the checks of all unsuccessful bidders. SECTION 3. That the said Contractor agrees that all work done under this contract will be done in-accordance with the provisions of the "Labor Code" of the State of California, and to pay not lees than the general prevailing rates of wages in the City of El Segundo, California (the locality in which the said work or improvement is to be performed) for each craft or type of workman or mechanic needed to execute the contract for said work or improvement. Said general prevailing rates of wages, so ascertained, declared, determined and specified, are herein specifically set forth as follows, to -wit: Classification: Rate per Hour: Foremen - - - - - - - - - - - - - - $ 1.50 All foremen not herein separately classified shall be paid not less than $1.r',O per day more than Journeyman rate for the craft Involved. Sundays and Holidays - One and one -half times the regular rates. The foregoing schedule of wages is based upon a working day of eight (8) hours. It shall be mandatory upon the contractor and upon any sub- contraotor under said contractor to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the execution of this contract. That the contractor shall forfeit as a penalty to the City of E1 Segundo, Ten (10) Dollars for each laborer, workman or mechanic employed for each calendar day or portion thereof such laborer, workman or mechanic is paid less than the general prevailing rates of wages herein stipulated for any work done under this contract, or by any sub- oontractor under said contractor, in violation of the Labor Code. That the contractor hereby agrees to abide by the provisions of all laws of the State of California, and of the United States of America relating to contracts of the nature contemplated herein. SECTION 4. That resident citizens of the City of E1 Segundo, California, will, so far as reasonably possible, be employed upon the work contemplated hereunder. 5- SECTION 5. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said pity, and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said city, shall constitute the contract for furnishing and installing said water mains and appurtenances, pursuant to the award hereinabove made, and the Mayor of the City of E1 Segundo Is hereby authorized on behalf of said city to affix the approval and acceptance of said city to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said city, and to affix the seal of said city thereto. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of El Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
