A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING
TO JOHNS- MANVILLE SALES CORPORATION THE
CONTRACT FOR FURNISHING SAID CITY ALL
MATERIALS SPECIFIED IN ITEMS NOS. 3 AND
4 UNDER THE NOTICE TO BIDDERS DATED
MARCH 7TH, 1944.
WHEREAS, the City Council of the City of
E1 Segundo, California, has heretofore in the manner
provided by law, duly and regularly advertised for bids
for furnishing the said city with certain items of water
pipe and fittings;
AND, WHEREAS, at the time for opening and con-
sidering all of said bids, to -wit: the hour of 7:15
o'clock p. m. on Wednesday, the 5th day of April, A. D.,
1944, said Council did publicly open, examine and declare
all bids received, and reached its decision in the said
matter;
NOW, THEREFORE, the City Council of the City of
El Segundo, California, does resolve, declare and determine
as follows:
SECTION 1. That the bid of JOHNS- MANVILLE SALES
CORPORATION, dated April 1, 1944, for furnishing the said
city with all materials specified in Items 3 and 4 under
the Notice to Bidders dated March 7th, 1944, which said
bid said Council determines to be as follows, to -wit:
"In compliance with the annexed notice inviting
sealed bide, the undersigned hereby proposes to
furnish to the City of E1 Segundo, California, in
said city, at the various locations provided for in
said 'Notice to Bidders', at she prices stated in the
'SCHEDULE' below, and all in accordance with said

'Notice to bidders' and further in accordance with
Specifications No. 440301, heretofore approved and
adopted by the City Council of said City and on
file in the Office of the City Engineer of said
City, as follows, to -wit:

The undersigned agrees to furnish the material
herein bid upon within thirty DAYS after the under-
signed receives written Notice of Award of Contract.
AND AS REQUIRED in said 'Notice to Bidders',
incloses herewith in the amount
of Two Hundred and ninety -six (6296.00);
AND AS FURTHER REQUIRED in said 'Notice to Bidders'
hereby states, that CALIFORNIA STATE 'SALES TAX' or
'USE TAX' and any other State and FEDERAL TAX IS NOT
INCLUDED in the amount bid.

be, and the same is hereby accepted at the prices set forth
in said bid, which is now on file in the office of the
City Clerk of said city, and which said bid so on file is
hereby expressly referred to and by this reference incor-
porated herein and made a part hereof for all further
particulars.

The above expressed lengths of pipe are
estimates only and the same shall not in any manner be
construed as contractual quantities.
ITEM N0. 3 shall be delivered "Trench side" on
Loma Vista Street between Grand Avenue
and Holly Avenue and on Hillcrest
Street between Pipe Avenue and
Mariposa Avenue.
The Simplex Couplings to be furnished
with Items 3 and 4, shall be delivered
at the City Warehouse, located at
611 E. Holly Avenue.
All of said equipment shall be in conformity
with "Specifications No. 440301 of the City of E1 Segundo,
California, for Furnishing of Water Pipe and Appurtenances ",
heretofore adopted by Resolution No. 709 of said city, on
file in the office of the City Clerk of said city.
SECTION 2. That all bids received for said
above mentioned items Nos. 3 and 4, with the exception of
the said bid of Johns- Manville Sales Corporation, be and
the same are hereby rejected, and the City Clerk is hereby
authorized and instructed to return the checks of all
unsuccessful bidders.
SECTION 3. That the City Clerk shall prepare
copies of this resolution after the passage and adoption
thereof, and shall affix to such copies at the end thereof
after the Clerk's Certificate, forms for the approval of
the successful bidder and on the part of the said city, and
such copies of this resolution, so approved and accepted by
the successful bidder and by and on behalf of said city,

shall constitute the contract for furnishing said items
of said water pipe, pursuant to the award hereinabove
made, and the Mayor of the City of El Segundo is hereby
authorized, on behalf of said city, to affix the approval
and acceptance of said city to such contract, and said
City Clerk is hereby authorized and instructed to attest
the same on behalf of said city, and to affix the seal
of said city thereto.
SECTION 4. That the City Clerk shall certify
to the passage and adoption of this resolution; shall cause
the original of the same to be entered in the book of re-
solutions of the said City of E1 Segundo, and shall make
a minute of the passage and adoption thereof in the records
of the proceedings of the City Council of said city, in the
minutes of the meeting at which the same is passed and
adopted.
Passed, approved and adopted this 5th day of
April, A. D., 1944.

city is five; that the foregoing resolution., being
Resolution No. 713, was passed and adopted by the said
City Council, approved and signed by the Mayor of said
city and attested by the City Clerk of said city, all at
a regular meeting of the said council held on the 5th day
of April, A. D., 1944, and that the same was passed and
adopted by the following vote, to -wit:
AYES: Councilmen Hesser Peterson, Selby, Skelley and
Mayor Love;
NOES: Councilmen None;
