CC RESOLUTION 712RESOLUTION NO. 712 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO NATIONAL CAST IRON PIPE, A DIVISION OF JAMES B. CLOW AND SONS, THE CONTRACT FOR FURNISHING SAID CITY ALL ITEMS OF MATERIALS UNDER THE NOTICE TO BIDDERS DATED MARCH 7TH, 1944, ALL WATER PIPE AND FITTINGS EXCEPT ITEMS NOS. 3 AND 4 THEREOF. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids for furnishing the said city with certain items of water pipe and fittings; AND, WHEREAS, at the time for opening and con- sidering all of said bids, to -wit: the hour of 7:15 o'clock p* m. on Wednesday, the 5th day of April, A. D., 1944, said Council did publicly open, examine and declare all bids re- ceived, and reached its decision in the said matter; NOW, THEREFORE, the City Council of the City of El Segundo, California, does resolve, declare and determine as follows: SECTION 1. That the bid of NATIONAL CAST IRON PIPE, a Division of James B. Clow and Sons, dated April 4, 1944, for furnishing said city with all items of materials under the Notice to Bidders dated March 7th, 1944, for water pipe and fittings, except Items Noe. 3 and 4 thereof, which said bid said Council determines to be as follows, to -wit: "In compliance with the annexed notice inviting sealed bids, the undersigned hereby proposes to furnish to the City of El Segundo, California, in said City, at the various locations provided for in said 'Notice to Bidders', at the prices stated in 3. the 'SCHEDULE' below, and all in accordance with said 'Notice to bidders' and further in accordance with Specifications No. 440301, heretofore approved and adopted by the City Council of said City and on file in the Office of the City Engineer of said City, as follows, to -wit: S C H E D U L E ITEM N0. 1. 3050 Lin. Bramman Date: Pacific Coast Sales Manager , April 4, 1944. be, and the same is hereby accepted at the prices set forth In said bid, which is now on file in the office of the City Clerk of said city, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further particulars. The City must furnish the required Federal priorities and certifications under this award. The above expressed lengths of pipe and quantities of materials are estimates only and the same shall not in any manner be construed as contractual quantities. ITEM N0. 1 shall be delivered "Trench side" on Imperial Highway between Sepulveda Boulevard and 3050 feet easterly thereof. 4- ITEM N0. 2 shall be delivered "Trench side" on Hillerest Street between Oak Avenue and Walnut Avenue. ITEMS NOS. 5 to 20, both inclusive, shall be delivered at the City Warehouse, located at 611 E. Holly Avenue. All of said equipment shall be in conformity with "Specifications No. 440301 of the City of E1 Segundo, California, for Furnishing of W ater Pipe and Appurtenances ", heretofore adopted by Resolution No. 709 of said city, on file in the office of the City Clerk of said city. SECTION 2. That all bids received for said above Items of said water pipe and fittings, with the exception of the said bid of National Cast Iron Pipe, a Division of James H. Clow and Sons, be and the same are hereby rejected, and the City Clerk Is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 3. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said city, and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said city, shall constitute the contract for furnishing said items of said water pipe and fittings, pursuant to the award herein - above made, and the Mayor of the City of E1 Segundo is hereby authorized, on behalf of said city, to affix the approval and acceptance of said city to such contract, and said City Clerk 5- is hereby authorized and instructed to attest the same on behalf of said city, and to affix the seal of said city thereto. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of re- solutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said city, in the minutes of the meeting at which the same is passed and adopted.
