CC RESOLUTION 707RESOLUTION NO. 707 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING TO NORTH AMERICAN AVIATION, INC. PERMISSION TO INSTALL CERTAIN STREET IMPROVEMENTS IN A CERTAIN PORTION OF DOUGLAS STREET TAU THIN SAID CITY UPON CERTAIN TERMS AND CONDITIONS THEREIN SET FORTH. The City Council of the City of El Segundo, California, does resolve, declare and determine as follows: SECTION 1. That the application of NORTH AMERICAN AVIATION, INC., dated February 28, 1944, for a permit to install certain asphaltic concrete in a certain portion of Douglas Street,300 feet south of Imperial Highway and located on either side of and adjacent to the paved entry to North American Gate No. 13, within the City of E1 Segundo, California, to —wit: Two areas each of approximately 1680 square feet, quarter — circle in shape, with the base along the east edge of the paved portion of Douy,las Street and the top near the ditch along the west side of the North American fence, to be excavated and filled with 4" Los Angeles City Specification asphaltic concrete,— excavation to be 60 feet long; and 56 feet wide, all in accordance with Drawing PF 170 -116 on file in the office of the City Clerk of said city, open to public inspection and hereby incorporated herein and made a part hereof,— be, and the same is hereby ordered placed on file in the Office of the City Clerk of said city for the purposes of identification and reference. It is necessary that this area be paved in order to provide a location large enough for busses which will be using the new passenger shelters to turn around in one swing, without having, to stop and back around, thus interfering; with traffic. 1— SECTION 2. That the said applicetion hereinabove referred to in Section 1 of this resolution, on file as aforesaid, is hereby referred to and by this reference expressly incorporated herein and made a part hereof. SECTION 3. That the said application of said North American Aviation, Inc. is hereby approved and the permit therein applied for is hereby granted subject to the following terms and conditions, to -wit: First: That all work and materials required in order to construct the improvements above referred to must be furnished by and at the sole cost and expense of the permittee. Second: All work must be performed in accordance with the specifications hereinabove referred to and to the satisfaction of the Street Superintendent of the City of E1 Segundo. Third: All excavations, work, etc., must be properly and adequately protected by suitable and sufficient barriers and /or warning liEhts, so as to guard against damage to persons and property. Fourth: That no representation is made and no guarantee is given by the City of II Segundo that the Improvements referred to when made will remain in place, as it is contemplated that the portion of Douglas Street affected may shortly or at some time hereafter be im- proved, and unless the improvements and facilities permitted hereunder can be incorporated into such proposed improvement, according to good engineering practice, the same may be removed and displaced without any liability upon the part of the City or any of its officers, agents or employees. 2- Fifth: That this permit shall not become effective unless and until the permittee shall have filed with the City Clerk of the City of El Segundo a copy of this resolution bearing the following -endorsement: "North American Aviation, Inc. hereby states and declares that it is, through its proper officers, familiar with the provisions of the foregoing resolution, and the terms and conditions of the permit therein granted to it, and that as permittee it hereby accepts the permit therein granted upon and subject to each and all of the terms and conditions set forth in said resolution, and does hereby agree to the same. That the City Clerk shall issue to said North American Aviation, Inc. such number of certified copies of this resolution as may be reasonably required, and the issuance of such copy or copies shall be and constitute the permit herein authorized and granted, effective according to its terms. SECTION 5. That the City Clerk shall Certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of resolutions of said city and shall make a minute of the passage and adoption 3- thereof in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted. McCarthy, City Clerk of the City of E1 Segundo, California, do hereby certify that the whole number of members of the City Council of the said city is five; that the foregoing resolution, being Resolution No. 707, was duly passed and adopted by the said City Council, approved and signed by the Mayor of said city, and attested by the City Clerk of said city, all at a regular meeting of the said Council held on the let day of March, A. D., 1944, and that the same was so passed and adopted by the following vote: AYES: Councilmen Hesser, Peterson, Selby, Skelley and Mayor Love; NOES: Councilmen None; ABSENT: Councilmen None.
