A RESOLUTION OF THE CITY COUNCIL Cr THE
CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO
ORO GRANDE LINE & STONE CORPORATION THE
CONTRACT FOR FURNISHING SAID CITY 'JITH
CERTAIN HYDRATED LIME.
WHEREkS, the City Council of the City of E1 Segundo,
California, has heretofore in the manner provided by law,
duly end regularly advertised for bids for furnishing said
city with certain hydrated lime;
AND, !WHEREAS, at the time for opening and consider-
ing all of said bids, to -wit: the hour of 7:15 o'clock p. m.
on Wednesday, the 15th day of December, .1943, said Council
did publicly open, examine and declare the bid of Oro Grande
Lime & Stone Corporation, the only bid received therefor;
and reached its decision in the said matter;
NOW, THEREFORE, the City Council of the City of
E1 Segundo, California, does resolve, declare and determine
as follows:
SECTION 1. That the said bid of ORO GRANDE LIME
& STONE CCRPORATION, of Los Angeles, California, dated
December 14, 1943, which said Council determines to be es
follows, to -wit:
"Subject: quotation of Hydrated Lime for Filtration
Plant.
"Dear Sir:
In response to y -ur advertisement of Dec. 2,
9, 1947, invitin bids on hydrated lime for your use,
for the calendar year of 1944, to be delivered to the
water treatment plant of `he City of E1 Segundo,
located at El Segundo, in loads of not less than 20
tons each; we offer the following quotation:-
" "e propose to furnish Colton Chemjcal
Hydrated Lime packed in 50Y paper bats and manufac-
tured by the California Portland Cement Company at

Colton, Cal. Thie lime is of the same quality and
fineness as that which we have furnished during 1943 : -
"x10.50 net per ton f.o.b. Colton, Cal.
.2625 "tate sales tax.
2.10 transportation.
"12.8625 Cost per tor. at Filtration plant.
"'.+e shall be glad to continue to serve yoo."
be, and the same is hereby accepted, which said bid is now
an file in the office of the City Clerk of cold city, and
which said bid so on file is hereby expressly referr-d to anc3
by this reference incorporated herein and made a part hereof
for all further particulars.
The contract is for the furnishing, of ouch hydrated
lime as may be required by said City during the calendar
year 1944.
The lime to be furnishes' hereunder shall in all
respects be furnished in accordance with tre requirements of
the notice to bidders on hydrated limp dated the 1st ivy of
December, 1943, purquant to witch the above mentioned bid ,.es
received, and which said notice is in wirds and figure- as
follows
"NOTICE TO 3IDDEFT ON HYDRATED LI F.
"PUBLIC NOTICE IS HEREBY GIVEN that the City
Council of the City of El Segundo, California, will
receive sealed bids up to tie Your of 7 :15 o'clock
p. m. on Wednesday, the 15th day of December, 1943,
for furnishing the City of El Segundo with such hydrated
lime as said city may require during the calendar year
1944.
"I,UALITY: All lime furnished hereunder shall be
the best quality of hydrated lime, West End Hydrated
lime or equal, and shall contain not less that: 70.5
per cent and not more then 73.5 per cent water soluble
oxide. It shall not contain more than one per cent of
magnesium oxide and not more than one -half of one per
cent of iron aluminum oxides.
"SIZE.: The ;article size, ninety -Aibht per cent
(98'x) shall pass three hundred end twenty -five (325)
mesh screen.
"PACKAGE: The hydrated lime shall be in ,star
proof fifty pound bagq or parer eacko, and steal3 be
fre- of all foreijr matter ^nd substances. Care -hall

be exercised in handlin6 all packa,es. If more
than `.V.o (21) per cent of the ,s received ar6
broken, it will coretitute brounds for rejection
of all broken pecke,es in the shipment.
"TESTS: At least one (11) per cent of the
number of bags shall be sampled. They shall be taken
from various parts of the shipment, dumpel, mixed
and sampled ae follows -
"All ba„s to be sampled shall be dumped, mixed
and 'quartered' to provide t ^o one pound samples,
one of which shall be used for i-rediate testing
and the other shall be kept carefully sealed for use
in a possible retest, as provided in the next
nsragraph.
"RETESTING: Notice of disertisfaction with a
shipment based on these specifications must be in
the hands of the contractor within ten days after the
receipt of the shipment. If the contractor desires a
retest, he shall notify the city enLinpar within fi.e
days of receipt of the notice of complaint. The dup-
licate sample shall then be forwarde! for a retest to
some laboratory a;reed upon by both parties. This
retest shall he made at the expense of the contractor.
The results of the retest shall be accepted as final.
"ACCEPTANCE: Acceptance shall be based upon the
compliance with all terms of these specifications. In
case any shipment or part of shipment is rejected, the
contractor shall remove the shipment or pert thereof
from the water purification plant at his own expense.
"It is estimated that approximately 250 tons of
such hydrated lime mill be required during, the con-
tract period, but this amount is an estimate only and
is not to be construed se a ocntrectual quantity.
"The City reserves the right to call for delivery
of sucY lime in lots of approximately 20 tons each
over the contract period, as its needs may require,
and the contractor will be required to mcl.e delivery
of such 20 ton lots on ten days notice of need therefor.
If any contractor fails to furnish the lime required
within ten days after such notice, the City shall have
the right to purchase its requirements in the open mar-
ket ann charge the contractor with any amount which it
may be required to pay in such case over and above the
amount of the contract price for the quantity of lire
so purchased.
"All bids must contemplate the delivery of thr=
lime et the city water purification plant in said city.
The bid price must include all transportation and /or
other charges and /or taxes of any kind.
"Bidders shall state the discount which will be
allowed, if any, for cash, payment_ within thirty days
after delivery.
"Pursuant to the laws of the State of California,
anfl to resolution of the City Council of said city,

notice is hereby further liven that said Council, in
the purchase of any supplies, goods, wares, merchandise,
manufactures or produce for the use of said city, shall
always, price, fitness and quality bean` equal, prefer
such supplies, goods, wares, zaerchandise, manufactures
or produce as have been grown, manufactured or prodaced
in the utste of California, and shell next prefer such
as have been partially so manufactured, grown or pro-
duced in said State.
"All bids mutt be sealed, marked 'Bid on Hydrated
Lime,' and must be either -railed or delivered so se to
be in the hands of the City Clerk of said City at or
before the hour hereirabove specified, at ^hich time
and in the Council Chamber in the City Hal] of said
City all bids received will be publicly opened, examined
and declared by the City Council of said City.
"The City reserves the rILht to reject any and /or
all bids received.
"The successful bidder will be required to furn'.sh
a ood and sufficient bond in the wim of not less then
25°� of th total amount of the bid, conditioned upon
faithful delivery of the materials bid upon at the price
bid.
"This notice is given by order of the City Council
of said City, and is dated this 1st day of December,
1943.

SECTION 2. That the City Clerk shall prepare copies
of this resolution after the paseage and adoption thereof,
and shall affix to sl_ich copies at the end thereof, after the
Clerk's Certificete, forms for the approval of the successful
bidder and on the part of the said city, and such conies of
this resolution, so approved and accepted by the successful
bidder Pnd by and on behalf of said city, shall constitute
the contract for furnishing said Hydrated Lime to said city,
pursuant to the award hereinabove made, and the Mayor of the
City of E1 Segundo is hereby authorized on behalf of said
city to affix, the approval and acceptance of said city to
such contract, and said City Clerk is hereby authorized and
instruct -d to attest the same on behalf of said city, and to
affix the seal of --aid city thereto.

SECTION 3. That the City Clerk shell certify to
the passage and adoption of this resolution; shall cause
the original of the same to be entered in the book of re-
solutions of the said City of E1 Segundo, and stall make
a minute of the passage and adoption thereof in the records
of the proceedings of the City Council of said city, in
the minutes of the meeting at i-rhich the same is passed
end adopted.
