WMAE'AS, the City of E1 Segundo, California, has heretofore instituted and is now prosecuting a general comprehensive program for the restoration of tax deeded properties within said City to a tax payin`; basis; A'D L-EREAS, said Council has, pursuant to said procedure as so established, caused to be given and published a notice of intention to sell the interest of said City in certain of such tax deeded parcels, which said notice is aesignated as "notice Do. 3 n of Intention to Sell City of El Segundo owned real property and inviting bids or offers therefor ", and which said notice was duly published in the El Segundo Herald in the issues of lay 20th, :.ay 27th and June brd, Is40; A.,J) ',= —,FAS, responsive to said notice the bid herein- after specifically mentioned for the property nereinafter des- cribed was filed, and has been duly considered by this Council; Ai,D PII-IEREAS, this Council has reached a aecision with reference to the sale of said property; eUn ""', i'lFit rOrS, E I`1' RESOLVED, by the City Council of the Cite of El Segundo, California, as follows: First: That the particular property which is the subject of this resolution and the sale therein contemplated, is located in the City of El Segundo, County of Los Angeles, State of California, and is describes as follows, to -wit: Lot 5 in Tract he. 10076, as per Book 146, rage 21 of i_aps Records of Los Angeles County. Second: What in the opinion of said City Council said property is not of a value great enough that it can be sold for a sum equal to the aggregate of all assessment liens levied upon said property, together with all costs paid or incurred for acquirinE title thereto. Third: That it would be for the best interest of said City to accept the bid hereinafter specifically referred to in the sum of QOO.00 for said property. 1. Fourth; That the bid of ChAl.LES E. and Ai .,A husband and wife, as joint tenants, hereinafter called the purchaser, dated the 6th day of October , 1943, to purchase said property by a good and sufficient deed with policy of title insurance from said city for the sum of ,2300.00, to be paid at the time of delivery of such deed, be and the same is hereby accepted, and all other bids on said property, or any part thereof, are hereby rejected. fifth; That the said acceptance of said bid and the sale herein made by virtue of this acceptance thereof are so accepted and ,-Wade subject to the iollowino conditions; 1. The terms and conditions of said "Notice iio. Three of Intention to Sell City of El Segundo Cwned peal rroperty and lnvitinS Rids or Offers Therefor. "; 2. That the full purchase price for said real property to be so conveyed, as above stated, is paid by said purchaser on or before the 6th day of November , 1943; and 3. That unless said purchase price is so paid by said purchaser within the time nereinabove limited, then and in that event the said City at the option of the City Council thereof, shall be relieved of its obligation to convey hereunder, and any amount or amounts theretofore paid and deposited on said property shall be forfeited to said City as full and liquidated lama -es, and said City shall thereupon be free, without liaoility to said pur- chaser, to sell said property to any other purchaser. Sixth; That the ayor of the City of E1 Segundo is hereby authorized ana instructed to execute, in the nare of said City and on its benalf, a quitclaim deed of said real property to said pur- chaser, in form approved by the City Attorney or Special City attorney, and the City Clerk is hereby authorized and instructed to attest the same and affix the corporate seal of said City thereto, and to deliver said deed to.-ether with policy of title insurance to said purchaser upon receipt by said City Clerk for said City of said full purchase price. Seventh% That the bid of said purchaser, hereinabove referred to be placea on file in the office of the City Clerk 2. of said City, and the said bid and said "Aotice i:o. Eighth: That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the boot: of resolutions of said City of Ei Segundo, anu shall make a ninute of the passage and adoption thereof in the records of the proceedings of the said City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
