CC RESOLUTION 674RESOLUTION NO. 674 A RESOLUTIONV OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO$ CALIFORNIA, ORDERING AND PROVIDING FOR THE HOLDING OF AN ELECTION BY SECRET BALLOT AT WHICH THE EMPLOYEES OF SAID CITY MAY EXPRESS THEIR APPROVAL OR DISAPPROVAL OF THE RETIREMENT SYSTEM OR PROPOSAL REFERRED TO IN RESOLUTION NO. 672 OF SAID COUNCIL, ENTITLED: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO APPROVE CONTRACT PROVIDING FOR PARTICIPATION IN STATE EMPLOYEES' RETIREMENT SYSTEM. ", PASSED AND ADOPTED ON THE 21ST DAY OF JULY, 1943. WHEREAS, the City Council of the City of E1 Segundo, California, did heretofore on the 21st day of July, 1943, adopt Resolution No. 672, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO APPROVE CONTRACT PROVIDING FOR PARTICIPATION IN STATE EMPLOYEES' RETIREMENT SYSTEM. "; AND, WHEREAS, one step in the procedure for the participation of municipal corporations in the State Employees' p Retirement System, as contemplated in said resolution, and in I, the State Employees' Retirement Act therein referred to, contemplates that the employees proposed to be included in the retirement system shall have an opportunity to express by their secret ballots their approval or disapproval of said retirement proposal; AND, WHEREAS, it is the duty of the City Council of said City to prescribe the manner in which said election shall be conducted; M NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does hereby resolve, declare, determine and order as follows: SECTION 1. That an election of the employees of the said City of E1 Segundo shall be and the same is hereby called and ordered to be held and conducted in said city for the purpose of permitting the policemen and the other city employees proposed to be included in the State Employees' Retirement System, separately to express their approval or disapproval thereof. SECTION 2. That there shall be two forms of ballots to be used at said election, one being for use by city policemen and the other being for use by employees other than city policemen. The form of such ballot to be furnished to and used by city policemen shall be substantially as follows: "ELECTION BALLOT For Use By CITY POLICEMEN TO DETERMINE THEIR APPROVAL OR DISAPPROVAL OF THE PROPOSAL OF Ve OF THE TO ENTER INTO A CONTRACT WITH THE BOARD OF ADMIN- ISTRATION OF THE STATE EMPLOYEES' RETIREMENT SYSTEM TO INCLUDE SAID EMPLOYEES IN SAID RETIREMENT SYSTEM Shall the above designat- ed employees of the sub. division named above, be included in the State Employees' Retirement System? 2- to by making a cross (X) the space to the right of the word indicating your desire. YES ; I NO SUMMARY OF MAJOR PROVISIONS OF THE PROPOSED RETIREMENT SYSTEM 1. The System is administered by a board of eight members, composed of three members of the System, an official of a bank, an official of an insurance com- pany, the Director of Finance, a member of the State Personnel Board, and an official of the University of California. 2. Retirement for service is optional upon attain- ment of an age which shall be not less than 55 or more than 60, as provided in said contract, by city firemen and city policemen, and age 60 by other employees, and completion of twenty years of service for the municipal corporation, and is compulsory at age 65 for city fire- men and city policemen, and at age 70 for other employees. 3. The monthly retirement allowance payable upon retirement for service is dependent upon such factors as age, sex, salary and years of service. For city firemen and city policemen, retiring at the optional age in paragraph 2, or at a higher age with 20 years of service, the monthly allowance is approximately one -half the average monthly salary during the five years immediately preceding retirement. For other city employees, the monthly allowance, upon retirement at age 65, is approxi- mately 1 /70th of the average monthly salary during the five years immediately preceding retirement, for each year of service after the effective date of participation, plus approximately 1 /70th, or less as may be provided in said contract by the municipal corporation for its em- ployees, of the average monthly salary during the three years immediately preceding the effective date of participation, for each year of service prior to that date. 4. Retirement for disability, except in the case of city firemen and city policemen disabled from injury arising out of and in the course of employment, is per- mitted only after ten years of service and upon proof of incapacity for the performance of duty. 5. The monthly retirement allowance payable upon disability retirement, described in preceding item 4, is dependent upon such factors as age, salary and years of service, but generally is equal to 90% of 1 /70th of the average monthly salary during the five years imme- diately preceding retirement, for each year of service, with a guarantee of 25% of said salary, subject to certain restrictions and modifications. 6. Disability retirement of city firemen and city policemen, in the event of disability arising out of and in the course of employment, is permitted regard- less of age and service, the monthly retirement allowance being one -half the average monthly salary during the five years immediately preceding retirement. 7. The benefit payable at death, except in the case of city firemen and city policemen dying from injury arising out of and in the course of employment, consists of the contributions of the member plus interest, and plus 1 /12th of the member's annual salary during the year immediately preceding death, for each year, not I'm exceeding six years, of service as a member of the system. 8. The monthly allowance payable to the widow and children, at the death of city firemen and city policemen arising out of and in the course of employment, is one -half the average monthly salary during the five years immediately preceding death. 9. The benefit upon separation from service by other cause than death or retirement, is the refund of the member's contributions, with interest. 10. Contributions required of city firemen and city policemen, without credit for prior service, depend upon salary and upon age of entry into the retirement system, the contributions per 4100 of salary varying from $4.69 at entry age 21, to $8.42 at entry age 35, for example. Contributions of firemen and policemen having credit for prior service, depend on salary, entry age and amount of rior service, the amount of contribution per $100 being 13.28 for example, at entry age 59, with 19 years of prior service. 11. For other city employees, the contributions de- pend upon sex, salary and age of entry into the service, the contributions varying from $3.77 at age 20, to $6.62 at age 64, for men, and from 04.59 at age 20, to J7.60 at age 64, for women. 12. The city is required to contribute the balance of the funds necessary to meet the cost of the benefits provided under the retirement system for the city's employees. The city also is required to pay its proportionate share of the administrative cost of the system. 13. Ability of the Retirement System to pay benefits is safeguarded by a provision authorizing the Board of Administration to revise contributions of both employees and the city, in the light of experience under the system. For other city employees, the contributions depend upon sex, salary and age of entry into the service the contributions varying from 83.77 at age 20, to J6.62 at age 64, for men, and from $4.59 at age 20, to $7.60 at age 64, for women. 12. The city is required to contribute the balance of the funds necessary to meet the cost of the benefits provided under the retirement system for the city's employees. The city also is required to pay its proportionate share of the administrative costs of the system. 13. Ability of the Retirement System to pay benefits is safeguarded by a provision authorizing the Board of Administration to revise contributions of both employees and the city, in the light of experience under the system. " 6- SECTION 3. The said election shall be held on the lath day of August, 1943, between the hours of 8 o'clock A. M. and 5 o'clock P. M. of said day, and the polling place shall be and the same is hereby designated, fixed and established as in the office of the City Clerk in the City Hall of said City, in said City. SECTION 4. That at said election the City Clerk shall furnish to each policeman of said city a ballot in the form of the ballot hereinabove indicated for use by policemen, and shall furnish to each of the other employees a ballot in the form of ballot hereinabove indicated for use by employees other than policemen. Said City Clerk is hereby authorized and instructed to procure any and all supplies, paraphernalia and equipment, and to do and perform any and all acts necessary in order to properly conduct said election. SECTION 5. Said City Clerk shall provide a locked ballot box in which all ballots voted shall be deposited as soon as voted; shall provide suitable facilities to enable all employees voting to secretely mark their respective ballots, and shall conduct said election in such manner as to preserve the secrecy of the respective ballots cast until such time as the same are canvassed, as hereinafter stated. SECTION 6. The said looked ballot box containing the voted ballots shall be kept by the City Clerk locked and unopened, until the first regular meeting of the City Council held subsequent to the day of said election, at which said meeting the City Clerk shall present to the City Council the said ballot box containing such voted ballots. At said meeting the City Council shall cause said ballot box containing such ballots to be opened, 7. and the said Council shall thereupon immediately canvass all such ballots and shall declare the results of said election. SECTION 7. Notice of said election shall be given by the posting of a copy of this resolution on the official bulletin board of the City of E1 Segundo,nearthe Council Chamber door in the City Hall of said City, and the City Clerk shall either deliver personally or mail to each such policeman or other employee of said city entitled to cast a ballot at such election, a post card or letter addressed to each such policeman or other employee at his or her address as shown on the municipal records, on file in the office of the Chief of Police of said City as to policemen, and as shown on the municipal records on file in the office of the City Clerk as to other employees of said City. Such personal delivery shall be made or such letters or post cards shall be mailed at least 72 hours prior to the day upon which said election is to be held and conducted. Each such post card or letter, in cases where the same are mailed, shall be deposited in the United States post office at E1 Segundo, California, addressed to the respective employees at their respective addresses, as hereinabove indicated, and shall have the postage fully pre -paid thereon. The notice contained in said letters or post cards shall be substantially in the following form: "The City Council of the City of E1 Segundo, California, has adopted a resolution, being Resolution No. 672, entitled: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DECLARING ITS INTENTION TO APPROVE CONTRACT PROVID- ING FOR PARTICIPATION IN STATE EMPLOYEES' RETIREMENT SYSTEM. ", In which said resolution the said Council declares its M intention to approve a contract between said City Council and the Board of Administration of the State Employees' Retirement System of the State of California, providing for the participation of said city in said retirement system and the making of the employees of said city members of said system. Said resolution No. 672 is on file in the office of the City Clerk, open to public inspection and is hereby referred to and by this reference incorporated herein and made a part hereof. Said resolution contains a summary of the mayor provisions of the proposed retirement system. "You are a policeman or other employee of said city and as such you are entitled to participate and cast a ballot expressing your approval or disapproval of said retirement proposal. "The said Council has called and ordered an election to be held on the 17th day of August 1943, between the hours of 8 o'clock A. M. and 5 o'clock P. M. of the said day, and has designated the polling place at which ballots are to be cast as in the office of the City Clerk of said city, in the City Hall thereof. "You are hereby notified of the time, place and purpose of the said election and of your right to vote thereat. " You are further notified that the City Council nas ordered that each city policeman or other employee shall be entitled to, and may absent himself or herself from his or her duties for said city on said day without penalty or loss of compensation, for such period of time as may be reasonably necessary to enable each such policeman or other employee to go to the said office of said City Clerk and cast his or her ballot at the said election. 0 "This notice is given by order of the City Council and is dated this 5th day of August, 1943. That as indicated in the form of notice above set forth, each policeman or other employee of the City of E1 Segundo, California, is hereby authorized to absent himself or herself from his or her duties for said city on said day of said election, without penalty or loss of compensation for such period of time as may be reasonably necessary to enable each such employee to go to the said office of said City Clerk and cast his or her ballot at the said election. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of said city, and shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted. SECTION 10. That this resolution shall take effect immediately. SECTION 11. Said Resolution No. 672 of said city council hereinabove referred to is on file in the office of the City Clerk of said City in the City Hall of said City in said city, is open to public inspection and is hereby referred to and by this reference expressly incorporated herein and made a part hereof for all further particulars respecting its contents, which include a summary of the mayor provisions of said proposed retirement system. i Passed, approved and adopted this 4th day of August , A.
