CC RESOLUTION 650RESOLUTION N0, 650. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 20TH DAY OF APRIL, 1943, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID CITY, THE QUESTION AS TO WHETHER OR NOT SAID CITY SHALL PARTICIPATE IN THE STATE EMPLOYEES' RETIREMENT SYSTEM OF THE STATE OF CALIFORNIA, UNDER THE PRO- VISIONS OF THE ACT OF THE LEGISLATURE OF SAID STATE, DESIGNATED AND KNOWN AS THE "STATE EMPLOYEES' RETIREMENT ACT ", AS AMENDED. WHEREAS, under the provisions of that certain act of the Legislature of the State of California, generally designated, known and referred to as the "State Employees' Retirement Act ", as amended, any municipal corporation in the State of California, may participate in the State Employees' Retirement System, making its employees members of said system by contract entered into between the legis. lative body of the municipal corporation and the Board of Administration of the said retirement system, subject to the provisions of said act, as amended; AND, , WHEREAS, various cities of the State of California have heretofore, pursuant to the provisions of said act, as amended, elected to participate in, and are now participating in, said State Employees' Retirement System, and have made their respective employees members of said system, as contemplated in said law, as amended; AND, WHEREAS, the City Council of the City of E1 Segundo has, over a period of several years last passed, 1. had under serious consideration and investigation the subject of the establishment of a proper and suitable retirement system for the employees of said City, and has studied the said subject from every angle; AND, WHEREAS, said Council, as a material part of its investigation, has sought to determine as far as reasonably possible, what the estimated annual cost of full participation by said City in said system would be, and has determined the facts with reference thereto to be as follows: First: That based on present number of employees and present compensations of such employees of the City, the amount of the total annual cost to be paid by the employees themselves out of their own salaries, would be the estimated sum of 'P5,549.16. Second: That based on such present number of employees and compensations, the amount of the total annual cost to be paid by the City itself (including amortization costs on a twenty —five year basis) would be the sum of X9,690.21. Third: That at the end of the twenty —five year amortization period, the amount of the annual cost to be paid by the City would be less, as at that time the sum of "3,584.58 would be deducted from the City's portion only of the annual cost. Fourth: That based on such present number of employees, and compensations, and present assessed value, the annual special tax required to meet the obligation of the City under said retirement system would be six and six. tenths cents on each ''100.00 of assessable property within said City for the twenty—five year amortization period and four and one - .tenth cents thereafter. Fifth: That the estimated figures above set forth are subject to variations in comparatively nominal degrees, M more or less,as the number of employees and their re- spective compensations, and the assessed value of the City, et cetera, may change from time to time; AND, "HEREAS, after consideration of the said costs, both that portion thereof to be paid by the employees themselves and the portion thereof to be paid by said City, the Council feels that such costs are reasonable and not excessive in view of the benefits to be derived from such full participation; AND, WHEREAS, after such consideration, investiga- tion and study, the members of said City Council feel that full participation by the City of E1 Segundo in the State Employees' Retirement System, as contemplated in and under the provisions of said State Employees' Retirement Act, as amended, would provide for said City and its employees the best, most economical, workable, actuarily sound, and other- wise satisfactory, retirement system reasonably obtainable for said City and its employees; ,ND, WHEREAS, said City Council desires to learn the attitude of the electors of the City of E1 Segundo with reference to said City so participating, and to receive the authority of such electors to so participate; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does hereby resolve, declare, determine and order as follows: SECTION 1. That in view of the foregoing premises there shall be, and there is hereby, ordered held in the City of E1 Segundo, County of Los Angeles, State of Cali- fornia, on Tuesday, the 20th day of April, 1943, a special municipal election of the qualified electors of the said City for the purpose of submitting to the qualified electors of said City the following question, proposition 3" or measure, to —wit; Shall the City of E1 Segundo fully participate in the State Employees' Retirement System of the State of California, making the employees of said City members of said system in and under the provisions of the State Employees' Retirement Act of said State, as amended, and levy and collect annually, as contemplated in said act, a special tax sufficient to raise the amount estimated by said Council to be required to provide sufficient revenue to meet the obli- gation of said City to said retirement system? NO SECTION 2. That a vote (+) on the proposition hereinabove referred to in Section 1 of this resolution placed in the voting square after the word "Yes" on the ballots to be used at said election, shall be counted as a vote in favor of said proposition or question, and as in favor of the City of E1 Segundo participating in said State employees' Retirement System under said State Employees' Retirement Act; and ae consenting to and authorizing; the levy anc. collection of the annual special tax contemplated under said act. A vote (+) on said proposition placed in the votint square after the word "No" on the ballots to be used at said election, shall be counted as a vote not in favor of said proposition or question, and as not in favor of the City of E1 Segundo participating in said State Employees' Retirement System under said State Employees' Retirement Act; and as not coneentin-. to or authorizing the levy and collection of the annual special tax contem- plated under said act. If a majority of the voters voting on said propo. sition at esid election vote in favor of said proposition the City Council proposes to and will enter into the required contract with the Board of Administration of the said State Employees' Retirement System for the full participation by said City in said system, all in the manner as contemplated in and under the provisions of said State Employees' Retirement Act, as amended. SECTION 3. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used there- at, and shall also have printed thereon, immediately above the proposition to be voted on, the following information for voters: "INFOR&JATION FOR VOTERS "','ith reference to the proposition appearing below on this ballot, the City Council of the City of El Segundo has sought to determine as far as reasonably possible what the estimated annual cost of full participation by said City in the State Employees' Retirement System of the State of California, as contemplated in said proposition, would be. Said Council, as a result of its investigation has found: "First: That based on present number of em- ployees and present compensations of such employees of the City, the amount of the total annual cost to be paid by the employees themselves out of their own salaries, would be the estimated sum of ,,5,549.16. " SECTION 4. That the City Clerk of said City is hereby authorized, instructed and directed to procure any and all official ballots, and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 5. That for the purpose of holding said election there shall be three (3) consolidated voting precincts within said City, which said precincts are hereby designated and established as follows: Consolidated Voting Precinct "A" shall be known as such, and shall include all of the territory in the City of E1 Segundo included within the exterior boundaries of E1 Segundo City Precincts Nos. 1, 2 and 7, as established by the Board of Supervisors of Los Angeles County, California, for state and county elections, said E1 Segundo City precincts Nos. 1, 2 and 7 being hereby consolidated for the purposes of said election. That the polling place in said Consolidated Voting Precinct "A" shall be in Room 3, Recreation Center Building, West located at 220 /Palm Avenue, in said City, and the Board of Election to conduct the said election in said Consolidated Voting Precinct "A" shall be and the same is hereby appointed as follows: Inspector: Mrs. Edith Murphy Judge: Mrs. Nellie J. Weller Clerks: Mrs. Adeline F. Gorman and Mrs. Adeline W. Catalano. Consolidated Voting Precinct "B" shall be known as such, and shall include all of the territory in the City of E1 Segundo included within the exterior boundaries of El Segundo City Precincts Nos. 4, 5 and 6, as established by the Board of Supervisors of Los Angeles County, Cali- fornia, for state and county elections, said El Segundo City precincts Nos. 4, 5 and 6 being hereby consolidated for the purposes of said election. That the polling place in said Consolidated Voting Precinct "B" shall be in the Council Chamber of the City Hall, located at 203 Richmond Street, in said City, and the Board of Election to conduct the said election in said Consolidated Voting Precinct "B" shall be and the same is hereby appointed as follows: Inspector: Mrs. Paula Hillig&s Judge: Mrs. Ada B. Kenney Clerks: Miss Harriet Lawler and Mrs. Effie Magee. Consolidated Voting Precinct "C" shall be known as such, and shall include all of the territory in the City of El Segundo included within the exterior boundaries of E1 Segundo City Precincts Nos. 3 and 8, as established by the Board of Supervisors of Los Angeles County, California, for state and county elections, said El Segundo City precincts Nos. 3 and 8 being- hereby consolidated for the purposes of said election. That the polling place in said Consolidated Voting Precinct "C" shall be in the Womans Club House, located at 541 Standard Street, in said City, and the Board of Election to conduct the said election in said Consolidated Voting Precinct "C" shall be and the same is hereby appointed as follows: 7-. Inspector: Mrs. Alma C. Foster Judge: Mrs. Mae A. Ellerman Clerks: Mrs. Minnie L. Hughes and Mrs. Gertrude N. Cullen. SECTION 6. All of the persons hereinabove named are hereby appointed as such officers respectively, and their compensation is hereby fixed at the sum of '8.00 each for said election. SECTION 7. That the rental for each precinct polling place for which a rental is required to be paid, shall be the sum of w5.00 each for said election. SECTION B. That the polls for said election shall be open from six o'clock A. M. to seven o'clock P. M. of the said day of said election, except as provided in Section 5734 of the Elections C ode of the State of California. SECTION 9. That notice of the time and place of holding said election is hereby given; and that the adop- tion of this resolution and the publication thereof, as hereinafter directed, together with such other notice, or notices, as may be required to be given or published by law, shall constitute the notice of said election. SECTION 10. That the City Clerk of said City is hereby authorized, instructed and directed to give notice of said election in the time, form and manner as required by law. SECTION 11. That the word "Employees ", as used in this resolution, shall include officers and employees of said City, all as contemplated in, by and under the pro- visions of said State Employees' Retirement Act above referred to. SECTION 12. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same In the book of original resolutions of said City; shall make a minute of the passa6e and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same was passed and adopted, and shall cause the same to be published once before the day of said election in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and circulated �,Yithin said City, and which is hereby designated for that purpose.
