CC RESOLUTION 628RESOLUTION NO. 628 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO BYRON JACKSON CO. THE CONTRACT OR ORDER FOR FURNISHING AND INSTALLING ONE CERTAIN DEEP WELL TURBINE PUMP IN WATER WELL NO. 8. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids for furnishing and installing certain pumping equipment in the City'a Water Well No. 8, located on Lots 6 and 7, Block 67, E1 Segundo, Sheet No. 7, in the said City of E1 Segundo, as shown on map thereof, recorded in Book 22, pages 54 and 55 of Maps, Records of the County of Los Angeles, State of California; AND, WHEREAS, at the time for opening and consider- ing all of said bids, to -:sit: the hour of 7:15 o'clock p, m. on Wednesday, the 17th day of June, 1942, said Council did publicly open, examine and declare all bids received; AND, WHEREAS, at said hour said Council did take all of said bids under advisement until the hour of 7 :30 o'olock p. m. on Wednesday, the 24th day of June, 1942; and did thereafter take all of said bids under further advisement from time to time until the 10th day of September, 1942, at an adjourned regular meeting, of said Council; AND, WHEREAS, said last mentionea time has now arrived and said Council has reached its decision with reference to Item No. 1 of said Notice to Bidders; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: 1- SECTION 1. That Item No. 1 of the bid of BYRON JACKSON CO., dated June 17, 1942, which was the only bid received for said Item No. 1, and which said Council determines to be as follows, to-wit: "Item No. 1. The undersigned hereby proposes to furnish to the City of E1 Segundo, California, in said City - - - CNE SUBMERSIBLE DEEP WELL TURBINE PUMP with a capacity of not less than Five Hundred (500) Gallons per minute against a total differential head of Two Hundred and Ten (210) feet, consisting of: 1 - 9 Stage Deep Well Bowl Assembly, 200 Feet - STANDARD Discharge Column Pine, 7" Diameter, 1 - Set of Cable, Column Clamps, 1 - Steel Surface Plate, complete, with flanged 90 degree elbow and standard pipe 3lscharge flange, 1 - 10", 40 HP, 400 Volt, 50 Cycle, 3 Phase, 4 Pole, 1450 RPM, Vertical Byron Jackson Submersible Motor, complete, 225 Feet (approximately) of No. 3 Armour Clad Submersible Electric Cable, 1 - 40 HP, 440 Volt, Pumping Plant Panel; and hereby also proposes to furnish all labor, mater- ials, equipment,tools, apparatus and supplies necessary for the installation of such pump in proposed Water Well No. 8, located on Lots 6 and 7, Block 67, E1 Segundo, Sheet No. 7, in the City of El Segundo, Cali- fornia, as shown on map thereof, recorded in Book 22, pages 54 and 55 of Maps, Records of the County of Los Angeles, State of California. and all in accordance with the 'Notice to Bidders' attached hereto; and all for the Lump Sum of: Two Thousand Five Hundred Fifteen & 23/100 DOLLARS . .(.12515.23) Subject to 3% California Sales Tax. 3% Cash 30 Days. " be, and the same is hereby accepted at the price set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby expressly referred to and by this reference incorporated herein and made a part hereof for all further particulars. IMP SECTION 2. That all bids received for Item No. 2 of said Notice to Bidders are hereby taken under further advisement until the next regular meeting of said Council, to -wit: the 16th day of September, 1942. SECTION 3. That the said Contractor agrees that all work done under this contract will be done in accordance with the provisions of the "Labor Code" of the State of California, and to pay not less than the general prevailing rates of wages in the City of E1 Segundo, California, (the locality in which the said work or improvement is to be per- formed) for each craft or type of workman or mechanic needed to execute thiscontract for furnishing and installing said pumping equipment. Said gerwal prevailing rates of wages, so ascertained, declared, determined and specified, are herein specifically set forth, as follows, to -wit: Classification: Machinery Erector, not less than . . . . . . . Machinery Erector's Helper, not less than . Rate per Hour: 41.00 per hour w .70 per hour Any classification not included herein, not less than . . . . . . . ; .70 per hour. Over -time, one and one -half times the regular rate.. Sundays and Holidays, one and one -half times the regular rate. Saturday is treated not as a legal holiday or over- time work unless same falls upon a calendar day, the whole of which is declared a legal holiday by law. It shall be mandatory upon the contractor and upon any sub - contractor under said contractor to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the execution of this contract. That the contractor hereby agrees to abide by the provisions of all laws of the State of California, and of the 3- United States of America relating to contracts of the nature contemplated herein. That the contractor shall forfeit as a penalty to the City of E1 Segundo, Ten (10) Dollars for each laborer, workman or mechanic employed for each calendar day or portion thereof such laborer, workman or mechanic is paid less than the general prevailing rates of wages herein stipulated for any work done under this contract, or by any sub - contractor under said contractor, in viola- tion of the Labor Code. SECTION 4. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies st the end thereof after the Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City, and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing and installing said pumping equipment, pursuant to the award hereinabove made, and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City, and to affix the seal of said City thereto. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. 4- Passed, approved and adopted this 10th day of September, A.
