CC RESOLUTION 612Ft ✓ RESOLUTION NO. 612 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, RELATING TO THE PURCHASE BY SAID CITY OF ONE NEW SEDAN TYPE AUTOMOBILE AND CERTAIN EQUIPMENT THEREON FOR USE OF THE POLICE DEPARTMENT OF SAID CITY. WHEREAS, the City Council of the City of E1 Segundo, California, did heretofore, pursuant to published notice inviting bids, award the contract or order for furnishing the equipment hereinafter referred to, to Ira E. Escobar, by Resolution No. 601 of said Council, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO IRA E. ESCOBAR THE CONTRACT FOR FURNISH- ING SAID CITY WITH ONE NEW SEDAN TYPE AUTOMOBILE AND EQUIPMENT FOR USE OF THE POLICE DEPARTMENT. ", passed and adopted on the 4th day of February, 1942; AND, WHEREAS, after the adoption of said resolution several months elapsed during which it was impossible for said City to procure the necessary priority order from the War Production Board to obtain delivery of the automobile and equipment referred to in said Resolution No. 601; AND, WHEREAS, said City is now in a position to procure said automobile, having obtained the necessary quota certificate therefor, but in view of the long elapse of time between the present and the date said Resolution No. 601 was adopted, it is no longer equitable or just to require said successful bidder to deliver said automobile and equipment upon the basis contemplated in said Resolution No. 601, which delay was due to no fault on the part of said bidder; AND, WHEREAS, said Council has received from said bidder a communication in words and figures as follows: 1- I'M Segundo, California June 10, 1942 "City Council, City of E1 Segundo, E1 Segundo, California. "Gentlemen: "In January you advertised in the E1 Segundo Herald for bids on a new passenger automobile. "We quoted you a bid on a new 1942 Ford V8 engine, DeLuxe Fordor with the necessary extras and painting to equip this unit for a police car. "The prices quoted and our ability to deliver this unit was based upon your ability to secure for us the proper rationing certificate at that time. "The automobile sales were frozen at time of bid and some with a double freeze. The program of rationing frozen automobile sales and the regulations determining eligibility and classifications was delayed for a considerable length of time which prevented you from being able to secure for us the proper certificates. "I understand - that a quota certificate for the ao- quisition of a new passenger automobile has been issued to you. "During the period in which the sales of automobiles were frozen, additional regulations and changes in prices make it necessary for me to revise the price quoted you in my original bid. "For that reason I am taking the liberty of submitting for your consideration the new price at which this equip- ment can now be delivered to you as advertised with one exception; i.e. due to the present restrictions this car will come equipped with 4 - 4 ply tires and tubes Instead of 5 - 6 ply tires and blowout -proof tubes as advertised. "This car can be delivered within approximately twoveeks. One new 1942 Ford V8 engine, DeLuxe Fordor, $1257.35 Plus California Sales Tax, 37.72 Total 12' 295.07 If 600xl6 spare tire and tube is desired add $21.34. If 600xl6 spare tire and tube (600xj 6 6 ply and life protector tube) add V34.391 If 5-600x 16 6 ply tires and 5 - 600xl6 life protector tubes is desired add $86.59, If Federal regulations permit. Exemption certificates to be furnished by the City of E1 Segundo. Priority certificates to be furnished by the City of E1 Segundo. Very truly yours, Ira E. Escobar " 2- AND, WHEREAS, after consideration of said letter and of all matters connected with said transaction, the City Council has reached its decision that it would be for the best interests of said City of E1 Segundo to take the action hereinafter set forth, in view of the foregoing premises, and of the existing war emergency; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, declare, determine and order as follows: SECTION 1. That said Resolution No. 601, above referred to, be and the same is hereby repealed and the action therein taken is hereby rescinded, in view of the action hereinafter taken in Section 2 of this resolution. SECTION 2. That said City Council does hereby accept the proposal of said Ira E. Escobar, contained in his above quoted letter of June 10, 1942, to furnish the following automobile to said City at the price stated therefor in said bid, to -wit: One new 1942 Ford V8 engine, DeLuxe Fordor, $1257.35 Plus California Sales Tax, 37.72 Total $1295.07 but said bidder is not required or requested to furnish any of the spare tires or spare tubes referred to in his said communication. Said purchase price of 41295.07 shall be paid promptly by municipal warrant in due course after receipt of said automobile, equipped as stated in said communication. SECTION 3. That the Chief of Police of said City Is hereby authorized and instructed to make and procure the necessary application for a suitable spare tire and spare tube for said automobile, and after procuring the necessary priority order therefor, to purchase the same In the open market. 3- SECTION 4. That the City Council hereby finds and determines that an emergency exists in the premises, in this, that the said automobile and equipment, spare tire and tube, are urgently needed for the proper per- formance of the duties of the Police Department of said City, and that unless such automobile and equipment and spare tire and tube are obtained at once, the public peace, health, safety and general welfare will be adversely affected, and that the said purchase is therefore an emergency matter and is urgent for the reason stated. SECTION 5. That this resolution shall take effect immediately. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
