CC RESOLUTION 596RESOLUTION N0. 596 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, MAKING CERTAIN FINDINGS AND DETERMINATIONS WITH REFERENCE TO THE PLACING OF THE LIBRARY BUILDING NOW IN PROCESS OF CONSTRUCTION WITHIN SAID CITY, IN CONDITION FOR TEMPORARY USE FOR EMERGENCY PURPOSES; MAKING CERTAIN PROVISIONS FOR THE FURNISHING OF MATERIALS, SUPPLIES AND SERVICES IN CONNECTION THERE- WITH; AND MAKING CERTAIN FINDINGS AND DETERMINATIONS WITH REFERENCE TO EXISTING CONTRACTS RELATING TO SAID STRUCTURE. WHEREAS, there has been under construction over a period of many months last past a new public library building in and for the City of El Segundo; AND, WHEREAS, it was contemplated when said building was started that the same would be constructed and completed under a National Youth Administration Project; AND, WHEREAS, after commencement of said project said National Youth Administration was unable to furnish to the City workers in sufficient numbers to permit the said project to proceed as contemplated, which resulted in a very considerable delay in the work involved; AND, WHEREAS, said National Youth Administration has now abandoned said project completely, and no further aid may be expected from that source, due to no fault on the part of the City of E1 Segundo; AND, WHEREAS, due to existing emergency and war conditions, this Council feels that the action hereinafter taken with reference to said library building at this time, 1- 0a t" Is for the best public interest and general welfare of said City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of E1 Segundo, California, as follows: First: That said Council hereby finds and determines that the immediate completion of said building as a library building, under existing conditions, is not deemed advisable at this time but should be delayed until conditions are more settled. Second: That the said building should be placed in condition for use for emergency purposes until such time as its ultimate use as a library building is indicated. Third: That in view of the foregoing findings and determinations of this Council, the respective materialmen and persons holding contracts in connec- tion with the construction of said building and the furnishing of materials therefor, be requested to cooperate with the City under the circumstances in the solution of the problem which is so presented, and to that end the City Council requests considera- tion and action on the part of such contractors and materialmen, as hereinafter in paragraph "Fourth" of this resolution set forth. Fourth: That the architects on said building representing the City of E1 Segundo, be requested to contact the various contractors and materialmen on the said building and acquaint such contractors and materialmen with the facts and circumstances which now prevail and the determinations of the Council with reference to said building and its immediate adap- 2- tion for emergency use, as hereinabove set forth, and to that end that they solicit such respective con- tractors and materialmen to cooperate with the City In the premises, substantially as follows: A. 'Phat Seaside Industries, Inc. be requested to cancel its contract for the furnishing of linoleum for said structure, as said material will not be needed at this time. B. That Harold E. Shugart Company be requested to cancel its contract for acoustic materials, as such materials will not be needed at this time. C. That Pacific Clay Products be requested to furnish to the City the 300 pieces of buff ruffle brick already out and which represents a cost of $38.68 for labor and material, which the City will pay, and that said vendor be requested to cancel the remaining por- tion of its contract. D. That Blue Diamond Corporation be requested to furnish the following materials at the prices shown, to -wit: 300 Ft. 3/4" Channels 150 " Corner Beads 100 Lbs. 18 -gauge Galv. annealed tie wire ® J1.465 Per C.Ft. 44.40 6 3.00 " " " 4.50 ® 6.35 " " Lb. 6.35, and that it thereupon cancel its existing contract as to all other items not heretofore furnished or herein- above mentioned. E. That Edward Sidebotham and Son, Inc. be re- quested to furnish the following materials at the prices shown, to -wit: 10 Tons Plaster Sand 0 0.70 Per Ton 7.00 10 " Concrete Sand 0 0.70 " " 7.00, and that it thereupon cancel its existing contract as to all other items not heretofore furnished or herein- above mentioned. 3- . F. That Eastslde Building Materials Co., Inc. be requested to furnish the following materials at the prices shown, towit: 250 Yards Metal Lath $ 0.20 Per Sq.Yd. 050.00 1 Ton Gypsum Plaster 5 13.65 " Ton 13.65, and that it thereupon cancel its existing contract as to all other items not heretofore furnished or herein- above mentioned. G. That Westinghouse Electric Supply Company be requested to furnish the following materials at the prices shown, to -wit: 12 -Rolls Friction Tape 9 .17 Per Roll 2.04 12 -Rolla Rubber Tape @ .18 " " 2.16, and that it thereupon cancel its existing contract as to all other items not heretofore furnished or herein - above mentioned. H. That Soule' Steel Company having completed or furnished all items under its existing contract (Steel Sash and Doors), excepting the item of $41.00 which was deferred at the City's request, be requested to complete its contract in full. I. That Inglewood Mercantile Co. be requested to complete its contract (Hardware) in full. J. That McCullough & Co. be requested to complete Its contract (Tile Roof) in full. K. That National Cornice Works be requested to complete its contract (Kalamein Doors & Fire Doors) in full. L. That Western Iron & Metal Co. be requested to complete its contract (Structural Steel and Iron) in full. M. That Long Beach Marble & Tile Co. be re- quested to complete its contract (Marble and Tile) in full. 4.- N. That Deats Sash and Door Company (Mill Work) having already delivered fabricated materials to the extent of approximately $416.12, and having fabricated ready for delivery approximately $511.91 worth of materials, which leaves only the following items not manufactured as yet, to -wit: 5- aY a. Cabinets for Work Rooms b. Stops, casings and aprons for windows W-1 and W -2. Aprons for windows W -3, W -4 and W -5, stools for windows W -1, W -2, W -3, W -4 and W -5, be requested to deliver all materials actually fab- ricated and cancel items "a "and "b; above mentioned, which said items "a" and "b" amount to a contract price of approximately $141.00. Fifth: That said architects in contacting said respective vendors be requested to advise said vendors of the circumstances which compel the City Council to ask for the considerations above set forth and to ac- quaint said respective vendors with the fact that the unfortunate circumstances which prompt the action here - inabove taken is in no way the fault of the City of E1 Segundo or of the City Council thereof, but is due entirely to circumstances over which said City and the said City Council have no control, and that their best cooperation is respectfully solicited in the premises. Sixth: That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of resolutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
