A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EL SEGUNDO, CALIFORNIA, GRANTING
TO B. WARREN VINETZ A PERMIT, SUBJECT TO
CERTAIN TERMS AND CONDITIONS, TO CONSTRUCT
A CERTAIN LATERAL SANITARY SEWER LINE IN A
PORTION OF EAST WALNUT AVENUE, WITHIN SAID
CITY.
The City Council of the City of E1 Segundo, Cali-
fornia, does resolve, declare and determine as follows:
SECTION 1. That subject to the terms and conditions
hereinafter set forth, B. Warren Vinetz is hereby granted
permission to construct and install an 8 inch lateral sani-
tary sewer line, together with necessary appurtenances in
Walnut Avenue in the City of E1 Segundo, from Sepulveda
Boulevard to a point 465 feet westerly from the westerly
property line thereof. The terms and conditions upon which
this permit is granted are the following, to -wit:
First: That the entire cost of the construction
of said lateral and appurtenances, including the cost of connec-
tion thereof to the municipal sewer system, shall be borne by
the permittee.
Second: Full, true, accurate and complete records
and accounts of the cost of the construction and installation
of the said lateral sewer line and of its appurtenances shall
be kept, which records and accounts shall be subject to in-
spection and audit by the City of E1 Segundo. Immediately
upon the completion of the improvement the permittee shall
file with the City Clerk in writing a final statement of the
total cost of the improvement, which shall reflect the cost of
the constituent items thereof and be signed as approved by the
said permittee.

Third: The entire improvement must be constructed
and completed in accordance with specifications of the City
of E1 Segundo relating to such matters and to the satisfac-
tion and approval of the City Engineer.
Fourth: All work must be properly and adequately
protected by red lights and barriers as the same progresses,
so as to protect persons and property against injury.
Fifth: All street surfaces disturbed must be
restored to as good a condition as same were in immediately
prior to excavation and to the satisfaction and approval of
the City Engineer.
Sixth: That upon the completion of said improve-
ment, the said sanitary sewer lateral and its appurtenances
shall be conveyed to the City by the conveyance approved as
to form by the City Attorney.
Seventh: That the permittee, by electing to pro-
Geed, and proceeding under the permission herein granted,
shall thereby automatically agree to assume all liability
for damages to persons or property which may be occasioned
or suffered by reason of the making of the improvement or
the execution of the work, or any matter connected therewith,
permission for which is hereby granted, and to indemnify and
save harmless the City of E1 Segundo and each and all of its
officers, agents, servants and employees from any such loss,
damage or damages.
Eighth: That this resolution relates only to the
particular sanitary sewer lateral project herein referred to,
and shall not be construed in any sense as a precedent with
reference to any other project or improvement within said
City.
Ninth: The work involved hereunder shall be commenc-
ed promptly and shall be prosecuted with due diligence to the
end that the public will be inconvenienced as little as

reasonably possible during the construction period.
Tenth: That the City Clerk shall prepare two
certified copies of this resolution (one for the City and
the other for the permittee), upon which shall appear the
following endorsement signed on behalf of the City of
E1 Segundo by the Mayor and City Clerk, and which shall
also be signed by said permittee, to -wit:
"The foregoing resolution and the terms
and conditions, agreements and arrangements
therein set forth and referred to, are hereby
approved, accepted and agreed to by the under-
signed, this day of ,19_.

The said certified copy, so executed and delivered,
shall constitute the written evidence of the permission here-
in granted, and of the arrangement and agreement set forth
in this resolution.
SECTION 2. That in consideration of the payment by
said permittee of all costs involved in the making of said
improvement and the production b„, permittee of evidence satis-
factory to the City Clerk that such costs have been so fully
paid by said permittee, the City of E1 Segundo agrees that
the following described real property within said City owned
by said permittee may connect with said lateral for sanitary

sewer service without further charge for such service
so far as such lateral 1s concerned, to -wit:
Lot 4, Block 107, El Segundo Sheet No. 5,
Map Book 20, pages 114 and 115;
And said City does further agree that if, as and
when other properties located within said City, and which
are to be directly connected with said 8 inch lateral sani-
tary sewer line hereinabove referred to in Section 1, apply
for sanitary sewer service through said lateral, that the
City will charge a connection fee for the connection of such
properties, which said fee shall be the pro rata portion
for such respective properties so applying, using as a base
all properties which may logically and according to good
engineering practice be directly connected to said 8 inch
lateral sanitary sewer line, and said City does further agree
that the amount or amounts of any such connection fee or fees
shall be paid to said permittee or his lawful heirs, repre-
sentatives or assigns, until there shall have been refunded
to said permittee and /or his said lawful heirs, representa-
tives or assigns, an amount which shall be equal to the total
approved cost of said improvement, as above contemplated,
less the pro rata portion of such cost, which would, using
the same level of proration of cost, be assigned to the
property of said permittee hereinabove described in Section
2 of this resolution.
It 1s specifically provided, however, that the
City of E1 Segundo shall not, nor shall any of its officers,
agents, servants or employees, be liable for the payment of
any such amount or amounts, or refund or refunds, except out
of moneys actually received by said City from such connection
charges.

SECTION 3. That the City Clerk shall certify to
the passage and adoption of this resolution; shall cause
the same to be entered in the book of resolutions of said
City, and shall make a minute of the passage and adoption there-
of in the records of the proceedings of the City Council of
said City in the minutes of the meeting at which the same
is passed and adopted.
SECTION 4. That this resolution shall take effect
immediately.

Clerk of said City, all at a regular meeting of the said
Council held on the 3rd day of December, A. D., 1941, and
that the same was so passed and adopted by the following vote:
