CC RESOLUTION 578RESOLUTION N0. 578 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AWARDING TO NATIONAL CAST IRON PIPE THE CONTRACT FOR FURNISHING SAID CITY WITH CERTAIN CAST IRON WATER PIPE AND FITTINGS. WHEREAS, the City Council of the City of E1 Segundo, California, has heretofore in the manner provided by law, duly and regularly advertised for bids for furnishing the said City with certain cast iron water pipe and fittings: AND, WHEREAS, at the time for opening and con- sidering all of said bids, to -wit: the hour of 7:15 o'clock p. m. on Wednesday, the 20th day of August, A. D., 1941, said Council did publicly open, examine, and declare all bids received, and reached its decision in the said matter; NOW, THEREFORE, the City Council of the City of E1 Segundo, California, does resolve, declare and determine as follows: SECTION 1. That the bid of NATIONAL CAST IRON PIPE, dated August 19, 1941, which said Council determines to be as follows, to -wit: "With reference to your notice to bidders calling for sealed bids for furnishing cast iron water pipe and fittings. We would be pleased to furnish your requirements as listed below at the following prices f. o. b. store - yard or trenchside, wherever accessible to truck and trailer delivery, E1 Segundo, California. APPROXIMATELY: 716' 6 "x18' B &S Class 150 SUPER DELAVAUD Cast Iron Pipe O 0.89 per it. 200' 8 "x18' DITTO .................... O 1.355 per ft. 1 8 "x8"x6" TEE All Bell L. A.Pattern® 16.05 each 4 6 "x6" DITTO 0 ................. O 12.75 each 1 6 "x4" Reducer SEB ............ O 1 5.25 each TERMS: Thirty days net, no discount allowed. Any Bales or Use Tax applying to this quotation to be paid by you and same is NOT included in prices named herein. 1- If furnished with your order promptly we could make immediate shipment of the cast iron pipe from our Los Angeles stock and we could make delivery of the fitt- ings listed within one week to ten days following receipt of order, both subject to strikes, embargoes and /or any other delays beyond our control. In addition to all other conditions noted this proposal is based upon orders on hand at present; our ability to secure raw materials and equipment. any Governmental regula- tions including Priorities; allocations, etc., our ability to secure necessary trucks, freight care or steamship space; strikes; Acts of God; or any other conditions beyond our control. Our certified check No. 6189 in the amount of $110.00 drawn on the California Bank of Los Angeles is attached hereto as per your requirements. Wall, Pacific Coast Sales Manager" be, and the same is hereby accepted at the price set forth in said bid, which is now on file in the office of the City Clerk of said City, and which said bid so on file is hereby express- ly referred to and by this reference incorporated herein and made a part hereof for all further particulars. The above expressed lengths of said pipe are esti- mates only and the same shall not in any manner be construed as contractual quantities. SECTION 2. That all bids received for said cast iron pipe and fittings, with the exception of the said bid of said National Cast Iron Pipe, be and the same are hereby re- jected, and the City Clerk is hereby authorized and instructed to return the checks of all unsuccessful bidders. SECTION 3. That the City Clerk shall prepare copies of this resolution after the passage and adoption thereof, and shall affix to such copies at the end thereof after the 2- Clerk's Certificate, forms for the approval of the successful bidder and on the part of the said City, and such copies of this resolution, so approved and accepted by the successful bidder and by and on behalf of said City, shall constitute the contract for furnishing said cast iron water pipe, pursuant to the award hereinabove made, and the Mayor of the City of E1 Segundo is hereby authorized on behalf of said City to affix the approval and acceptance of said City to such contract, and said City Clerk is hereby authorized and instructed to attest the same on behalf of said City, and to affix the seal of said City thereto. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the original of the same to be entered in the book of re- solutions of the said City of E1 Segundo, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. D., 1941, and that the same was passed and adopted by the following vote, to -wit: AYES: Councilmen Gerow, Hesser, Love, Selby and Mayor Binder; NOES: Councilmen None; ABSENT: Councilmen None.
