A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA, AUTH3BIZING AND
ORDERING THE FILING OF AN APPLICATION ON THE
PART OF SAID CITY TO PURCHASE FROM THE COUNTY OF
LOS ANGELES CERTAIN TAX DEEDED PROPERTY WITHIN
SAID CITY; AUTHORIZING AND INSTRUCTING THE MAYOR
AND CITY CLERK OF SAID CITY TO EXECUTE THE AGREEMENT
BETWEEN SAID CITY AND SAID COUNTY FOR SUCH PURPOSE,
SUBJECT TO THE APPROVAL OF THE STATE CONTROLLER OF
THE STATE OF CALIFORNIA; AND AUTHORIZING THE SPECIAL
CITY ATTORNEY OF SAID CITY TO PREPARE AND PRESENT
THE NECESSARY FORM OF APPLICATION, QUESTIONNAIRE,
AND ANY AND ALL DOCUMENTS NECESSARY IN THE PREMISES,
AND TO ATTEND TO ANY AND ALL FUTgRE DETAILS IN
CONNECTION WITH SAID MATTER.
THAT WHEREAS, that certain parcel of real property
situate in the City of E1 Segundo, more particularly described
as Lot 1, Block 399 as per Map Book 22, Page 54 of Maps, Records
of Los Angeles County, California, was heretofore, on the fifteenth
day of August, 1934, deeded to the State of California for non-
payment of taxes which had been legally levied and which were a
lien upon said parcel of real property; and,
WHEREAS, said taxes so levied upon said parcel of real
property, the non - payment of which caused said property to be
deeded to the State of California, included taxes levied by the
City of E1 Segundo which were to be collected by the County
officials of the County of Los Angeles; and,
WHEREAS, said parcel of property yields no revenue, either
to the City of E1 Segundo, or to the County of Los Angeles, or to
any school district or other political subdivision of the State
because of the fact that it has heretofore been sold to the State
of California and is no longer on the tax rolls; and,
WHEREAS, the City of E1 Segundo is desirous of obtaining
title to said parcel of property far a public purpose, to -wit, for
widening and improving the intersection of Grand Avenue and
Eucalyptus Drive in the City of E1 Segundo.
WHEREAS, it is believed by the Council of the City of

E1 Segundo that the acquisition of said parcel of property by the
City can best be accomplished by an agreement to purchase tax
deed thereto, pursuant to Sections 3897.3 and 3897d, Political
Code of the State of California;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO
DOES RESOLVE, DECLARE, AND DETERMINE AS FOLLOWS:
Section 1. That the Mayor of the City of E1 Segundo is
hereby authorized and ordered to subscribe the name of the City
to an application to the Board of Supervisors of Los Angeles
County, for an agreement to purchase a tax deed to that certain
parcel of real property situate within the City of E1 Segundo,
and more particularly described as follows, to -wit:
Lot 1, Block 39, Tract E1 Segundo,
as per Map recorded in Book 22, Page
54 of Maps, Records of Los Angeles
County, California;
and the City Clerk is hereby authorized and directed to attest
the same, and to affix thereon the seal of said City.
Section 2. That the Mayor is hereby authorized and direct-
ed t o subscribe the name of the City of E1 Segundo to an agreement
with the Board of Supervisors of the County of Los Angeles, sub -
ject to the approval of the State Controller of the State of
California, to purchase said parcel of property heretofore des-
cribed in Section 1, which said agreement shall contain the pro-
vision that the purchase price of said parcel of property shall be
the sum of Five ($5.00) Dollars; and the City Clerk is hereby
authorized and directed to attest the same, and to affix thereon
the seal of the City.
Section 3. That the Special City Attorney be, and he is
hereby authorized to take such steps and proceedings, to make such
arguments, to prepare questionnaires and any and all documents
necessary and to take such action as, in his opinion, may be

indicated, required or advisable in order to accomplish the
purposes as set -out in said application, and as contemplated by
law, and to preserve and protect the interests of the City.
Section 4. That said agreement shall be approved by the
City Attorney and Special City Attorney as to form.
Section 5. That the City Clerk shall certify to the
passage and adoption of this resolution, shall enter the same
among the original resolutions of said City, shall make a minute
of the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of
the meeting at which the same is passed and adopted, shall attach
a certified copy of this resolution to the original application
heretofore referred to and shall forward a certified copy of this
resolution to the City Attorney and Special City Attorney.

for a public purpose, to -wit, for the
widening and improving of the intersection
of Grand Avenue and Eucalyptus Drive in the
City of El Segundo.
TO THE HONORABLE BOARD OF SUPERVISORS OF THE COUNTY OF
LOS ANGELES; TO THE HONORABLE H.L. BYRAM, County Tax Collector of
the County of Los Angeles; and to the HONORABLE HARRY B. RILEY,
State Controller:
Comes now the City of E1 Segundo, a municipal corporation,
and a political subdivision of the State of California, and files
this, its Application to purchase the State's title to the herein-
after described parcel of real property, and with respect thereto
alleges:
1. That said parcel of real property is situate in the City
of E1 Segundo, more particularly described as follows:
Lot 1, Block 39, Tract El Segundo,
as per Map Recorded in Book 22, Page
54 of Maps, Records of Los Angeles
County, California.
2. That said parcel of real property was heretofore, on the
29th day of June, 1929, sold to the State of California for non-
payment of taxes which had been legally levied, and which were
1 lien upon said property; that thereafter, and on the fifteenth
day of August, 1934, said parcel of property was, by deed No.
557395, deeded to the State of California, no redemption having
been made by any person entitled to redeem.
3. That said taxes so levied upon said parcel of real pro-
party, the non - payment of which caused said property to be deeded
to the State of California, included taxes levied by the City of
E1 Segundo, which were to be collected by the County officials of
the County of Los Angeles.

4. That said parcel of property yields no revenue either to
the City of E1 Segundo, or to the County of Los Angeles, or to any
school district or other political subdivision of the State of
California, because of the fact that it has heretofore been sold
to the State of California, and is no longer on the tax rolls.
5. That the City of E1 Segundo is desirous of obtaining

and the Board of Supervisors of the County of Los Angeles, to pur-
chase a tax deed thereto, as provided by Sections 3897.3 and 3897d,
Political Code of the State of California.
7. That the Supreme Court of the State of California did,
on February 25, 1935, approve the constitutionality of the said
Political Code Section 3897d.
8. That the City of E1 Segundo, being fully advised in res-
peat to all of the matters heretofore set out, does hereby offer
and agree to enter into an agreement with the Board of Supervisors
of Los Angeles County to purchase said parcel of real property
heretofore described, for the sum of Five Dollars ($5.00), said
agreement to further provide that the City of E1 Segundo shall
pay the necessary expenses of entering into said agreement, includ-
ing the costs of giving notice and other costs, as provided by
Section 3897d, Political Code of the State of California.
WHEREFORE, the City of E1 Segundo prays that this application

AGREEMENT FOR THE PURCHASE BY THE CITY OF
EL SEGUNDO, AS PROVIDED BY SECTIONS 3897d
AND 3897.3 OF THE FOLITICAL CODE OF fHE
STATE OF CALIFORNIA, OF THE STATE'S TITLE
TO ONE PARCEL OF REAL PROPERTY WITHIN SAID
CITY DESIRED BY THE CITY FOR A PUBLIC
PURPOSE.
THIS AGREEMENT, made this __ day of ,
1940, by and between the Board of Supervisors of the County of
Los Angeles, State of California, and the City of E1 Segundo, a
municipality of the State of California, subject to the approval
of the State Controller of the State of California;
W I T N E S S E T H:
THAT WHEREAS, that certain parcel of real property
situate in the City of E1 Segundo, County of Los Angeles, State
of California, more particularly described as Lot 1, Block 399
Tract El Segundo, as per Map Recorded in Book 22, Page 54, Records
of Los Angeles County, California, was heretofore, on the fifteenth
day of August, 1934, deeded to the State of California for non-
payment of taxes which had been legally levied by the duly con -
stituted authorities of said County, and which were a lien upon
said property, and also whereas said property had been sold and
deeded for delinquent taxes to said City within the meaning of
Section 3897d of the Political Code of the State of California,
as provided by Section 3897.3 of said Political Code, and said
State now holds the same under tax deed; and,
WHEREAS, said taxes so levied upon said parcel of real
property, the non - payment of which caused said property to be
deeded to the State of California, included taxes levied by the
City of E1 Segundo which were to be collected by the County
officials of the County of Los Angeles; and,
WHEREAS, said parcel of property yields no revenue,
either to the City of El Segundo, or to the County of Los Angeles,
or to any school district or other political subdivision of the

State because of the fact that said parcel has heretofore been
sold to the State of California and is no longer on the tax
rolls; and,
WHEREAS, the City of E1 Segundo is desirous of obtaining
title to said parcel of property for a public purpose, to -wit,
for widening and improving the intersection of Grand Avenue and
Eucalyptus Drive in the City of E1 Segundo.
WHEREAS, it is believed by the Council of the City of
E1 Segundo that the acquisition of said parcel of property by
the City can best be accomplished by an agreement to purchase
tax deed thereto, pursuant to Sections 3897.3 and 3897d of the
Political Code of the State of California; and,
WHEREAS, in the judgment of the Board of Supervisors
it would be to the best interest of the County of Los Angeles
and the State of California to sell its interest in said parcel
of property to the City of E1 Segundo;
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS:
1. That pursuant to the provisions of Sections 3897d
and 3897.3 of the Political Code of California, the said City
shall purchase from the State of California its title to the
hereinafter described property.
2. That as provided by Section 3897d, Political Code,
the cost of the giving of the notice of this agreement shall be
paid by the City of E1 Segundo.
3. That the City shall buy and pay for said parcel
of real property hereinafter described upon the following terms
and conditions: That said City shall pay to the County Tax
Collector of said County the sum of Five Dollars ($5.00) for said
parcel of real property; upon receipt by the Tax Collector of
said sum, said Tax Collector shall make, execute, and deliver to
said City a, deed to said parcel of real property in substantially
the form set forth in said Section 3897d, Political Code. In the

event said parcel is redeemed before the City of E1 Segundo has
complied with all of the terms of the purchase herein set forth,
this agreement shall be ineffectual as to said parcel.
4. The real property which is the subject of this
agreement is the property described as follows:
Lot 1, Block 39, Tract E1 Segundo,
as per Map Recorded in Book 22, Page
54 of Maps, Records of Los Angeles
County, California.

their respective names to be hereto subscribed and their re-
spectre seals to be hereto affixed by their respective
officers thereunto duly authorized.
