A RESOLUTION OF THE CITY OF EL SEGUNDO,
CALIFORNIA, REQUESTING THE COUNTY OF LOS
ANGELES, CALIFORNIA,TO ENTER INTO AN AGREE -

XITHIN SAID CITY.
it'HEREAS, there are presently in the City of E1 Segundo, Cal-
ifornia, approximately 194_ parcels of land which are delinquent
in the payment of general taxes, all of which properties have been
deeded to the State for the non - payment of taxes and as such are
not presently bearing their proportionate cost of City and County
Government; and,
NHEREAS, approximately 180 parcels of the property herein-
after set forth are, in addition to being delinquent in the payment
of general taxes, delinquent in the payment of special assessments
levied for the payment of certain bonds issued pursuant to the pro-
visions of the "Improvement Act of 1911 ".
dEREAS, all of said parcels have been deeded to the State
heretofore for the non - payment of said taxes and /or assessments
and are now completely off the tax rolls, said parcels being
set forth hereafter; and,
,rHEREAS, the general tax and assessment debt against said
parcels is so heavy that the taxpayers of the City are not only
unable to, but would find it financially unsound to redeem said
parcels; and,
dHEREAS, it is the opinion of the City Council of the "'ity
of E1 Segundo, that said properties should be rehabilitated and
placed on the tax rolls of the City and County in order that
additional tax income may be forthcoming to all tax agencies, and
further, by reason of increased levies reasonably anticipated to

be forthcoming on account of improvements reasonably contemplated
to be made if said properties could be rehabilitated and have the
heavy tax load against them lifted; and,
dHEREAS, in order to rehabilitate said properties it is
necessary that the tax burden be greatly reduced so that the
same may be successfully disposed of and again placed on the tax
rolls; and,
ZIEREAS, the legislature of the State of California, did in
1933, adopt and the Governor approve that certain section of the
Political Code known as 3897d, which said section was amended in
1937, to aid in the liquidation of the tax frozen properties; and,
WHEREAS, the Supreme Court of the State of California did
on February 25, 1935, approve the constitutionality of said
section 3897d; and,
,7HEREAS, it is considered that the said code section, and
code section as amended by section 3897.3, offer the most feasible
and practical means of accomplishing the rehabilitation of said
delinquent properties; and,
4HEREAS, it will be necessary in order to accomplish the
purpose intended that such delinquent tax deeded properties be
purchased for the amounts set forth in the proposed agreement
attached hereto;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF EL SEGUNDO AS FOLLOWS;
SECTION 1. That the Board of Supervisors of the County
of Los Angeles are hereby urged and respectfully requested to enter
into an agreement with the City of E1 Segundo for the sale and pur-
chase of all properties described in the proposed agreement attached
hereto; said agreement to be entered into under the provisions of
Section 3897d of the Political Code of the State of California.
3ECTIOii 2. That the uoard of Supervisors is hereby urged
and respectfully requested not to permit the sale, other t11an to

the City, of any of the property listed in the Schedule set forth
and incorporated in the proposed agreement attached hereto.
SECTION 3. That the Mayor of said City shall sign this
Resolution and the agreement attached hereto, and he is hereby
authorized to sign all corrected and /or amended agreements in
accord with the intent of the agreement submitted with this
resolution.
SECTION 4. That the City Clerk shall certify to the
passa"e of this resolution, and thereafter the same shall be
in full force and effect.

A G R E E U E N T
Giving the City of El Segundo the right
as provided in Section 3897.3 and 3897d
of the Political Code to purciiase the
State's title to certain lands within
said City.
THIS AG.3EEI'ENT, made this day of
1940, by and between the Board of Supervisors of the County of
Los Angeles, State of California, and the City of E1 3egundo, a
municipality of the State of California, subject to the approval
of the State Controller of the State of California.
61 I T N E S S E T H:
THAT, '+`- iEREAS, certain real property within said County
and within said City of El Segundo, and hereinafter more partic-
ularly ddscribed, has been deeded to the State of California for
delinquent taxes levied by the duly constituted authorities of
said County of Los Angeles; and,
WHEREAS, the general tax debt against said parcels is
so heavy that the taxpayers of the City are not only unable to,
but find it financially unsound to redeem said parcels; and,
aa(HEREAS, the owners of approximately 180 of the parcels
hereinafter described have failed to pay the special assessments
levied for the payment of certain Bonds issued pursuant to the
provisions of the Improvement Act of 1911, and on account of which
failure the City of E1 Segundo has heretofore filed foreclosure
actions in the Superior Court of the State of California, in and
for the County of Los Angeles, against all of the 180 parcels,
and,
WHEREAS, it is the opinion of the City Council of the
City of E1 Segundo that said properties should be rehabilitated
and placed on the tax rolls of the City and County in order that
additional tax income may be forthcoming to all tax agencies,

and further, by reason of increased levies reasonably anticipated
to be forthcoming on account of improvements reasonable contem-
plated to be made if said properties could be rehabilitated and
have the heavy tax burden against them lifted; and,
WHEREAS, in order to rehabilitate said properties it is
necessary that the tax burden be greatly reduced so that the same
may be successfully disposed of and again placed on the tax rolls;
and,
WHEREAS, the legislature of the State of California did
adopt and the Governor did approve that certain section of the
Political Code known as 3897d to aid in the liquidation and re-
habilitation of tax frozen properties, and by the addition of
section 3897.5 of the same Code in 1937 did make such section
3897d available for use by the City of E1 Segundo, and other
cities similarly burdened with tax debt; and,
WHEREAS, the Supreme Court of the State of California
did on February 25th, 1935, approve the constitutionality of said
section 3897d; and,
WHEREAS, it is considered that said named code sections
offer the most feasible and practical means of accomplishing the
rehabilitation of said delinquent properties; and,
WHEREAS, it will be necessary in order to accomplish the
purposes intended that such delinquent tax deeded properties be
purchased for the amounts hereinafter set forth;
NOW, THEREFORE, IT IS HEREBY AGREED, that the property
hereinbefore mentioned and which is the subject of this agreement,
is all located in the City of El Segundo, County of Los Angeles,
State of California, and is more particularly described in the
followin„ Schedule:

IT I3 HEREBY AGREED that the said City shall have, and
it is hereby given, for the term of two years from the date hereof,
an option to purchase from the State of California all right,
title and interest of the State in and to all or any portion of
the real property hereinbefore described, upon the following terms
and conditions, to -wit:
That said City may elect to purchase any portion or
portions of said land in such parcels as it may deem proper, except
that it may not purchase any portion of any lot in a recorded
sabdivision unless said portion shall be all of such lot to which
the State holds title under tax deed or deeds.
That said City shall pay to the County Tax Collector of
said County for each parcel of land it may elect to purchase, at
the time when it shall notify the County of its election to purchase
the same, a sum equal to 4'5.00 per parcel and shall be paid for
accordingly as herein set out, in cash at the time of the election
to purchase.
Upon the receipt by the County Tax Collector of said
County of the price herein fixed for a parcel or parcels of land
wnich said City may elect to purchase, the Tax Collector of said
County shall make, execute and deliver to said City a deed or deeds
to said parcel or parcels of land in the form set forth in Section
3897d of the Political Code. The City shall pay all costs of
giving the notice or notices required in said section.
That during the term of this option, the title of the
State in or to any of the land hereinbefore described shall not be
conveyed or offered for sale as provided herein, but this shall
not effect the right of any person entitled to redeem any of said
land to redeem the same at any time before the said City shall
have elected to purchase it as provided herein and shall have paid
the purchase price thereof as herein fixed and a deed to the
City has been executed by the said Tax Collector. This para;;raph

however, shall not be construed as an admission by the City that
any former owner, or any former holder of any interest in any
of said land has any ri,;ht to redeem the same.
IN WITNESS WHEREOF, the parties hereto have caused their
respective seals to be affixed hereto by the respective proper
officer thereunto duly authorized.
